HomeMy Public PortalAbout01-20-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, TUESDAY, JANUARY 20, 2009 The Common Council of the City of Richmond, Indiana met in regular session Tuesday, January 20, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WISSEL President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Kelley Cruse - Nicholson. APPROVAL OF MINUTES Councilor Miller moved to approve the minutes of the meeting of January 5, 2009, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ The Fire Department received a grant for radios REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the January 8, 2009 meeting was accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS A. POLICE COMPLAINT ADVISORY COMMITTEE: Rev. Rick White has expressed his desire to be reappointed to the Police Complaint Advisory Committee. Additional nominations can be submitted for consideration until the February 2, 2009 meeting. B. SANITARY DISTRICT: ■ Superintendent Sam Lahanis reviewed Chapter 93 (Refuse) violation procedures. Mr. Lahanis announced a Public Hearing for rates for Sanitary and Stormwater charges on January 27, 2009, 7 PM in the Council Chambers. ■ Johnson Controls presented information regarding additional projects. Funding details will be presented at a later date. Mr. Parker will update Council regularly. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 1, 2 & 4 -2009 on first reading by title only, supported by Councilor Goodwin. Upon a vote viva voce, the motion passed. ORDINANCE NO. 1 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 74 OF THE RICHMOND CODE REGARDING PARKING FACILITIES The Clerk read Ordinance No. 1 -2009 on first reading by title only Traffic Division Captain Hopkins reported on January 8, 2009, the Board of Public Works and Safety approved the elimination of certain charges associated with certain parking facilities. This Ordinance would amend Chapter 74.47 of the Richmond Code to reflect the changes. A meeting of the Parking Committee relative to off - street parking has been scheduled for January 23. Councilor Welch moved to advance Ordinance No. 90 -2008 to second reading and to suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion failed. Dissenting was Councilor Pappin. Ordinance No. 90 -2008 will be held on second reading. ORDINANCE NO. 2 -2009 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -4 TO R -4 SPECIAL USE (126 North 7" Street) The Clerk read Ordinance No. 2 -2009 on first reading by title only. Presented by City Planner Scott Zimmerman, this Ordinance is a petition to rezone the property at 126 North 7th Street from R -4 Multi Family Residence District to R -4 Multi Family Residence Special Use District in order to allow the owner to develop the property for a Financial Services Office. Ordinance No. 2 -2009 will be referred to the Plan Commission for public hearing at its January 22, 2009 meeting. ORDINANCE NO. 4 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 91: ANIMALS OF THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 4 -2009 on first reading by title only. Presented by Assistant City Attorney Vessels, this Ordinance would replace Richmond Code Chapter 91: Animals. Proposed Ordinance 55 -2007 would be stricken due to the passage of time and numerous changes. Ordinance No. 4 -2009 will be heard by the Committee of the Whole on March 9, 2009, at 7:00 PM Common Council Minutes January 20, 2009 Page 3 of 3 ORDINANCES ON SECOND READING ORDINANCE NO. 55 -2007 — A GENERAL ORDINANCE AMENDING CHAPTER 91: ANIMALS OF THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 55 -2007 on second reading by title only. Councilor Parker moved to strike Ordinance No. 55 -2007, supported by Councilor Welch. Upon a vote viva voce, the motion passed. This Ordinance will be replaced by Ordinance No. 4 -2009. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
