A RESOLUTION APPROVING AN AGREEMENT
FOR ANIMAL WELFARE SERVICES BETWEEN
THE CITY OF RIVERDALE AND
THE HUMANE SOCIETY OF SCOTT COUNTY, IOWA
WHEREAS, the City Council of the City of Riverdale ("City")has met its
responsibilities for animal control and welfare by means of an agreement with the Humane
Society of Scott County(the"Society") executed the first day of September, 2015 with a term
ending the first day of July, 2018 and expiring June 30, 2019; and,
WHEREAS, on June 26, 2018, the City received from the Society a succeeding
agreement for consideration by the City Council, setting forth responsibilities, obligations and
authority for animal control and welfare, with a term beginning the first day of July, 2018 and
ending June 30, 2021; and,
WHEREAS, the City Council has taken no exception to the service provided by the
Society over the term of the expiring agreement and acknowledges that the costs for service
remain the same as the prior agreement, and finds it to be in the best interest of the community to
continue the relationship with the Society to meet the City's obligations for animal control and
welfare under the Iowa Code.
NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF RIVERDALE IN THE STATE OF IOWA:
1. That the Agreement between the City and the Society, made effective the first day of
July, 2018 (the "Agreement") is attached hereto and made a part of this Resolution.
2. That the City Council does approve and authorize the City Administrator to execute
and the City Clerk to attest the aforesaid Agreement and transmit the executed copy
to the Humane Society of Scott County.

AGREEMENT RECEIVE:

This agreement is made and entered into this first day of it/_ , 2018, by and between the City of Riverdale, a
municipal corporation of the State of Iowa hereafter referred to as "City", and the Humane Society of Scott County,
hereafter referred to as "Society", a non-profit corporation devoted to the welfare, protection and humane treatment
of animals as defined by section 162.2(1) Iowa Code.
WITNESSETH
In consideration of the mutual covenants and agreements hereinafter set forth, the City and the Society agree as
follows:
A. Society's obligations:
1) Society shall provide an animal shelter for the animal welfare of City which will comply in all respects to
Iowa Administrated Code Rules Chapter 20(Animal Welfare) Department of Agriculture Section 20.2(1)
entitled Housing Facilities and Section 20.2(2)entitled Primary Enclosures and will be register with same
as a welfare shelter.
2) Society shall carry out all that is mandated in the Agreement: all ordinances, Statutes and Departmental
Rules.
3) All stray or abandoned animals within City that are brought in by a City official or Animal Control will be
held in its shelter for the period of time required by pertinent ordinance, statutes or Iowa Departmental
Rules for return to its owner upon owner's payment of costs as set by Society and compliance with
Licenser and health ordinances of City. However, animals which are sick or diseased with an infectious and
contagious condition which will constitute a health hazard to other animals or animals suffering by reason
of injury may be disposed of within a shorter period of time by euthanasia with approval by a shelter
Health Technician,Animal Control Officer, Executive Director and/or a licensed veterinarian.
4) Society shall provide the forms, means, procedure and personnel at the shelter for adoption of suitable
animals and to require all adopters of animals to comply with City ordinances, statutes and Iowa
Department rules relating to health and animal welfare.
5) Society shall investigate and process complaints of cruelty to animals within the City and where cruelty is
believe to have occurred will have its Animal Control Officer attend the trial of the cause and assist therein
by providing the documentation of such cruelty to the prosecuting legal officer.
6) Society shall provide for the humane euthanasia of sick, diseased and unclaimed City animals according to
standards required by the Code of Iowa, Sec 162.2 Subsection 15 relating to euthanasia.
(7) Society shall require the owner of all City animals involved in bite cases to confine said animals as
directed by the Scott County Health Department and in the event of a stray dead animal involved in a bite
bite case,to take such dead animal to a veterinarian designated by the Scott County Health Department
for necropsy(Animal autopsy).
• 8) Society shall honor all legal requisitions from the University of Iowa laboratories for animals
pursuant to Chapter 351A code of Iowa.
(9) Society shall transport all living animals, whether captured, given or otherwise received by Society, in
vehicles with equipment and appurtenances which shall protect and shelter the animals from drafts and
extremes of hot and cold temperatures to which they are not acclimated and which protect them
from other types of injury in order to comply with the requirements of Iowa Departmental Rule 20.4(2)
entitled Vehicles.
(10) Society shall pick up and transport to the shelter or veterinarian, animals that have been injured and
the owner is not known or the owner cannot be found at that time. The owner shall be responsible for
any veterinary bills.
• 11) Society shall provide forms and procedures for requiring the spay and neutering of all adopted
animals from the shelter for monitoring compliance.
• 12) Society shall provide for the disposal of all euthanised animals in compliance with Section 167.12
Code of Iowa entitles Use and Disposal of Dead Animals.
(13)The Society will only have its Animal Control Officers respond upon the request of a City Official,
Sheriff's Dept. or Police Department. The Society will not accept requests for calls from your citizens
without clearance of a City Official, Sheriff's Dept. or Police Dept.
B. City's Obligations
• 1) City shall make a payment to the Society for the performance of the covenant herein in the amount of
$50.00 dollars per trip fee or a$50.00 impoundment fee for every request to respond to your city or when
a domesticated animal is picked up by Animal Control as well as a$10.00 daily board fee on said animal,
until this Agreement is terminated or expires by its own terms as provided below. If Animal Control is
requested by your city to respond to your city and an animal is impounded the Society will only charge
the City one $50.00 fee.The City will be charged a$50.00 dollar trip fee for any follow up call regarding
an investigation-determined necessary by the Senior Animal Control Officer. If the owner of said animal
claims that animal then the owner is responsible for fees.
• 2)City shall provide a liaison office in the Police Department to assist Animal Control
Officers under this agreement.
• 3)City shall handle all complaints relative to dead animals and be responsible for removal of same.
C. Mutual Agreements
1) This Agreement shall have a term of three(3) years from the first day of July 2018 and shall expire on the
30th day of June 2021. Either party, at its option, may terminate this Agreement by giving ninety (90)days
written notice to the other party.
2) In the event this Agreement is not terminated upon written notice in accordance with paragraph 1 of this
subsection, it may be renewed for one(1) year upon substantially the same terms and conditions as set
forth herein, provided, however,that the Society's compensation for services hereunder shall be
renegotiated by the parties hereto prior to such renewal. In this regard, Society shall submit any written
proposals for renewal to City on or prior to December 1, 2018.This Agreement shall not be renewed if City
and Society fail; to reach an accord on matters to be renegotiated prior to February 28,2021.
3) That the Society will be afforded an opportunity to appear before the City Council for the purpose of
making a presentation relating to the services provided by Animal Control.
