PROFESSIONAL SERVICES CONTRACT
FOR LEGAL SERVICES
WHEREAS, there exists a need for professional services to prosecute litigation against Pikes
Peak Nursery, and
WHEREAS, pursuant to N.J.S.A. 40A:l 1-5(1 ) (a) professional services are exempt fi'om the
requirements of competitive bidding; and
WHEREAS, the local finance officer has certified tim! funds are available,
NOW, THEREFORE BE IT RESOLVED that tile Mayor and Council of tile Borough of Carleret
does hereby approve the appointment ofMcGowan & Coughlin, P.C. at a maximum cost of not
to exceed $5,000.00 billable per attached contract;
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby authorized to
execute said contract:
IT IS FURTHER RESOLVED that tl~e contract is awarded without competitive bids in
accordance with N.J.S.A. 40A:I I-5(I) (a) due lo file specialized and professional nature of the
services provided
BE IT FURTHER RESOLVED that a notice of this action be published in the Home News and
Tribune on September 09 , 1997.

and certified as a true copy of the original
