Our client wishes to add a small maids quarters above the existing garage, and by doing so would require a variance in the front yard set back of 10.05 ft and further small variance to the western side yard set back of 4.0 ft. As it is an existing building with an existing garage, the most logical place for such an extension is to make a second floor addition to the garage. If one were to enforce the present day set backs, the resulting structure would be unattractive, and would not supply the space necessary for the comforts of the maid. The garage, as mentioned, is an existing structure built to the previous set back requirements. To grant this variance, will in no manner or form confer on the applicant any special privilege that is denied by the Zoning Code to other lands, building or structures in the same Zoning District. If one were to literally interpret the existing provision in the Code, the applicant would be deprived of rights commonly enjoyed by other properties in the same Zoning District, and would cause the applicant unnecessary and undue hardship, as this is an existing structure over which the room is being placed. It is the absolute minimum variance that can be granted to allow the construction of this space on this site. As can be seen from the drawings, and if one knows the area, it is in absolute harmony, and hence, in harmony with the general intent and purpose of the ordinance.
