A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD, CALIFORNIA CLARIFYING FUNDING LIMITS FOR
EXPENSES UNDER THE CITY'S TRAINING, CONFERENCE AND
MEETING POLICY (RESOLUTION NO. 2004-017) AS THE SAME
APPLY TO MEETINGS AND EVENTS AND DISTINGUISHING
CONFERENCES AND RELATED ACTIVITIES AS NON-
REMUNERATED FUNCTIONS
WHEREAS, the City Council of the City of Lynwood (the "Council") previously
adopted Resolution No. 2004-017 (the "Resolution") to govern the manner in which Council
members receive training and education on matters of municipal affairs, governance, and legal
developments, and can participate in legislative actions and developments at the local, state and
federal level; and
WHEREAS, the Resolution further provides for remuneration for efforts by Council
members to sustain their participation as members of various boards, commission, association
and working groups whose mission impacts local municipal affairs and the quality of life of
Lynwood residents, which remuneration was set by the adoption of Resolution 2004.190 (the
"Funding Resolution"); and
WHEREAS, the ability of Council members to serve constituents is enhanced through
the consultation process with other local elected officials at formal and informal gatherings acrd
considerable benefits are derived from the experiences of other communities in tackling
problems similar to the ones faced by the City and its residents; and
WHEREAS, the common experience of local elected officials demonstrates the value of
continued training and education for local officials in both formal and informal settings, and the
costs associated with such opportunities are reasonable and necessary to the fulfillment of the
duties of Council members, and further such experience is integral to the delivery of quality
services to residents and business alike; and
`~ WHEREAS, the assessment of value For conferences, meetings and events to each
Council member is a matter of personal evaluation by individual Council members and this
Policy must take into account the diversity of backgrounds, knowledge and interests of
individuals; and
WHEREAS, the Council intends to establish by this action to provide funding for a
policy that can provide equitable standards, consistent and fair treatment to all Council members
who have an interest in enhancing their knowledge, skills and relationships to better serve this
community, and desires that the funding be in compliance with all legal requirements applicable
to the governance of a public entity; and
WHEREAS, it is also the desire of the Council to adopt this resolution to support <t
policy that, in its application, can maintain effective control over expenses related to attendance
at conference, training, meetings, and events related to the performance of official duties, while
at the same time not impede the ability of the elected of5cials to fully participate in such
programs as each of them may deem necessary or appropriate to the effective representation of
their constituents; and
WHEREAS, the Council further recognizes that all expenses deemed to be ordinary and
necessary to the performance of Council members official duties are reimbursable.
WHEREAS, Council desires to distinguish between remuneration for attendance at
"meetings" and "events" (for which remuneration is established by the Resolution), and
"conferences" (for which no remuneration is provided to the elected officials but a "subsistence
allowance" is permitted) (all as defined in the Resolution), clarify its previously adopted policy
contained in the Funding Resolution, and establish funding limits for participation in events
defined in the resolution as "events" or "meetings"; and
WHEREAS, Council wishes to provide a meaningful opportunity for Council members
to attend all activities covered under the Resolution but also desires to limit the total financial
impact of individual decisions by Council members regarding "meetings" and "events" .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNW'OOD.
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
l . Council adopts in their entirety all findings, recitals and determinations previously
made under the Resolution and its adoption as though set out in full hereat.
2. Council hereby repeals the Funding Resolution and in its place and stead adopts
this resolution which sets the following amounts as limits to the expenditures by
the indicated elected officials under the Resolution for participation in "meetings"
and "events":
a. Mayor: $25,000
b. Council Member $16,000
c. City Treasurer $_8,500(including $2,000 for Deputy Treasurer) _
d. City Clerk $_8,000(including staff training)_
Nothing contained herein shall reduce or limit the ability of Council members to
participate in any "conference" as defined in the Resolution, nor limit the ability
to participate, and receive remuneration therefor, in "meetings" or "events' when
the same require travel of more than 100 miles from the City of Lynwood.
3. The amounts set forth in Section 2, above, shall be fiscal year amounts.
Moreover, notwithstanding the current status of activities under the Resolution
and the Funding Resolution, said limits shall go into effect July 1, 2006 and shall
be set for the fiscal year (i.e., ending June 3Q, 2007).
4. At no time shall City staff process or make any arrangements for expenditures
pursuant to the Resolution and this resolution without a written request from an
elected official and confirmation that the necessary funds are available for the
requested travel or payment. In the event an elected official has no funds
available in his or her account, no payment shall be processed by the City for anv
request for travel or compensation under the Resolution.
5. Notwithstanding the foregoing the City shall reimburse its elected officials for
out-of-pocket expenses such as parking, mileage (where appropriate) and other
incidentals when the same are incurred in the performance of official duties. By
way of example, incidental expenses like parking fees or meals may be covered
by the City when the same are incurred by an elected official in the performance
of his or her official duties even if the official is no longer eligible for a stipend or
subsistence payment under the Resolution.
The provisions of this resolution may be changed from time to time by action of the Council.
