The regular meeting of the City Council was called to order by Mayor Merritt at 7:30 P. M., followed by invocation given by 2. Councilman Harker. Mayor Merritt then led the Pledge of Allegi- 3. ance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Harker, Tyrell, Merritt ABSENT: Councilman - Nunamaker ALSO PRESENT: Assistant City Attorney Walter Shatford and Assistant City Manager Karl Koski 5. APPROVAL OF MINUTES: Regular meeting of August 10, 1964. The following corrections were made to the minutes: Item 3., comma be placed after Followed, Item 6 line 11 should be corrected to Ev Greenberg- Cloverly School, page 2 paragraph 2 under roll call vote should read "ABSENT - Councilman Merritt, page 2 item 9 roll call vote should be corrected under "AYES" to remove Merritt and add Tyrell, page 4 item 16 under (a) line 4 should read "would result if alley ", page 5 item 21 Tine 6 should read "Commissioners" to replace "Engineers ". Councilman Dickason moved to approve the minutes of August 10, 1964, as corrected, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker UNFINISHED BUSINESS: PUBLIC HEARING: 7:30 P. M. COOPERATIVE STREET PROJECT, :;EST SIDE OF GOLDEN WEST, OLIVE TO BLACKLEY. Assistant City Manager Koski advised this involved :installation of curb and gutter, dedication of right of way and a wide pave - out. Also a petition had been 'received signed by all property owners or 100 %. The new curb and gutter would require about a 16 ft. pave -out because of right of way requirement and would be for the distance of one block. Councilman Tyrell moved to open the Public Hearing, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Hrker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Counc i lman- Nunamaker Mayor Merritt asked if anyone in the audience wished to speak for or acainst these improvements. No one came forward to speak, Councilman Dickason moved to close the Public Hearing, Council- man Tyrell seconded, carried by the following called vote: AYES: Councilmen-Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman- Nunamaker Councilman Tyrell moved to determine the installation to be in the pul:lic interest and to instruct the Supt. of Streets to cause the work to be. done, & instruct City Manager to sign agreement, , Councilman Harker seconded, carried by following, called vote: AYES: Councilmen- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker PUBLIC HEARING: 7 :30 P. M. Re -CURB & GUTTER INSTALLATIONS: a. Olive St., north side, Hilton to Cloverly The Assistant City Manager advised the petition received request- ing this improvement represented 64.9% of the lineal footage on the block which is 1231 ft. lone, Councilman Tyrell moved to open the Public Hearing, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 646 Council Minutes, August 24, 1964, page 2 Mayor Merritt asked if anyone wished to speak in favor of this project. Mrs. Larry Zaniot, 9327 Olive, advised she was very much in favor of the installation as children were walking in the street and also to take care of the drainage problem where water stands in the street. No one else came forward and Mayor Merritt asked if anyone wish- ed to speak against the installation. Tom McInerney, 9423 Olive, asked for information regarding the petition, costs etc. Mrs. Ronald Paris, 9323 Olive St., ad- vised she had received a bid for the work and she was instructed to keep it for future development following the hearing. Mrs. Margaret Mock, 9417 Olive, was concerned about tree removal and the drainage and was advised by the Assistant City Manager that indications were that only two trees on the east end of the pro- ject would have to be removed and that the engineering and de- sign work should take care of the drainage problem. Councilman Tyrell moved to close the Public Hearing, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Hrker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker Councilman Dickason moved to determine the installation to be in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker b. Longden Ave., north side, Sultana to Livia. Assistant City Manager Koski advised the petition received re- presented 64.3% of the lineal footage of the property owners of the block. Councilman Tyrell moved to open the Public Hear - ing, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker The Mayor asked if anyone wished to speak in Favor of the in- stallation and no one came forward. He then asked if anyone wished to speak against it. Mr. Milton Severenson, 9087 E. Longden, advised he already had curbs and was advised this would not effect him in that case. Councilman Tyrell moved to close the Public Hearing, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilman- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker Councilman Harker moved to determine the installation to be in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 6. TRAFFIC COMMISSION APPOINTMENTS: Councilman Tyrell moved to hold this over until Monday, August 31, 1'354, at 7:30 P. M. to discuss and take care of this item, Councilman Dickason seconded, and carried. NEW BUSINESS: 7. RESOLUTION NO. 64 -394: re- request to State Bd. of Equalization Assistant City Manager read title to Resolution No. 64 -394 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RE- QUESTING THE STATE BOARD OF EQUALIZATION TO PERMIT THE TAX COLLECTOR OF TEMPLE CITY TO EXAMINE CERTAIN SALES it USE TAX RECORDS. Councilman Tyrell moved to adopt Resolution No. 64 -394, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 647 Council Minutes, August 24, 1964, page 3 0. RESOLUTION NO. 64 -395: appointing stenographer -clerk The Assistant City Manager read title to Resolution No. 64 -395 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AP- POINTING A STENOGRAPHER- CLERK. Councilman Dickason moved to adopt Resolution No. 64 -395, Councilman Tyrell seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 9_ RESOLUTION NO. 64 -396: Re- expenditures 1963 -64 report The Assistant City Manager advised the Collier -Unruh Transporta- tion Development Act requires this Resolution and the report prepared by the City Auditor. Councilman Harker moved to adopt Resolution No. 64 -396, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman- Nunamaker 10. RESOLUTION NO. 64 -397; Setting no tax rate 1964 -65. The Assistant City Manager read in full Resolution No. 64 -397 titled as follows, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY INDICATING NO CITY TAX RATE FOR THE FISCAL YEAR 1964 - 1965. Councilman Tyrell moved to adopt Resolution No. 64 -37, Councilman Harker seconded, roll call vote to carry as fol lows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 11. RESOLUTION NO. 64-390: Re-representative to City Selection Com- mittee. Assistant City Manager Koski advised according to the instructions of the Council at their last meeting this Resolu- tion was prepared titled as follows, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING A MEMBER OF SAID COUNCIL OF SAID CITY TO THE CITY SELECTION COM- MITTEE PURSUANT TO PART 3 OF DIVISION 10 OF THE PUBLIC UTILITIES CODE, which Resolution appoints'-Jiltiam A. Harker as Council representative. Councilman Dickason moved to adopt Resolution No. 64-393, Councilman Tyrell seconded, carried by called vote as follows: AYES: Councilmen- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman- Nunamaker 12. TRACT #29140: Re- survey monuments & tie points and release of Faithful Performance Bond in amount of $730.00 ;'Jeber Dev. Co. The :assistant City Manager presented a letter from John A.Lambie; City Engineer, stating this work had been completed and recommend ed the Council approve the work and cancellation of the Faithful Performance Bond in amount of $730., No. C- 7050776, Fireman's Fund Insurance Co., Tract #2914@, J. B. Weber Dev. Co., Inc. Councilman Tyrell so moved, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 13. INSTALLATION OF STEEL POLES & OVERHEAD STEEL CABLES ON LAS TUNAS DRIVE, Mr. Koski advised funds for this program are in the budget and recommended the permanent installation of 16 poles or 8 sets to replace some of the temporary poles on Las Tunas Dr. at locations indicated on the posted map. Councilman Tyrell moved to approve and authorize the expenditure, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT; Councilman- Nunamaker 61+8 Council Minutes, August 24, 1964, page 4 14. POLICY ON CITY PARTICIPATION IN COST OF INSTALLING SIDEWALKS: Assistant City Manager Koski presented a recommendation to pro- vide a $.25 foot rebate on all installation of sidewalks where 100' or more of continuous sidewalk is constructed even though it does not complete the block. This recommendation was made to stimulate construction of needed sidewalks. It was also re- commended where sidewalk projects terminate at the corner of the block that the City install the portion of sidewalk in that area of the curb return. Following discussion it was agreed to only participate in the $.50 per lineal foot rebate when a block was completed. Councilman Tyrell then moved to approve the recommen- dation that the City install the portion of sidewalk in that area within radius points of curb return, and to continue the discussion to next meeting regarding the recommendation of $.25 rebate, Councilman Dickason seconded, roll call vote to carry as fol lows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker 15. CHARITABLE SOLICITATION PERMIT REQUESTS: a. Temple City Chapter of De Molay, request for car wash, Aug. 15 -22. Councilman Harker moved to approve, Councilman Dickason seconded, and carried. b. Boy's Christian League, permit to sell advertising space in football programs for equipment, uniforms, etc. Councilman Tyrell moved to grant a permit, Councilman Dickason seconded, and carried. c. United Crusade: fund drive Sept. 15 through Dec. 31, 1964. Councilman Tyrell moved to grant, Councilman Harker seconded, and carried. d. (onions: request for car wash, Rays Station, Aug. 29. Councilman Tyrell moved to approve, Councilman Dickason seconded, and carried. 16. RESOLUTION NO. 64 -399: Warrants & Demands Following discussion Councilman Harker moved to adopt Resolution No. 64 -399, warrants and demands in the sum of $93,821.60, #5463, and #5465 through #5491, Councilman Tyrell seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman- Nunamaker 17. COMMUNICATIONS: a. City of Alhambra: inviting Councilmen of cities in the area to meet Aug. 25 in the Council Chambers in Alhambra at 8 P. M. regarding legislative responsibility toward control of gambling. Following discussion it was agreed that as many Councilmen as could would attend. b. T.C. Y. M. C. A: request to place banner across Las Tunas Dr. between Primrose & Temple City Blvd. from Sept. 21 through Oct. 12 advertising antique car show. Councilman Tyrell moved to approve subject to required liability insurance, Mayor Merritt seconded, and carried. c. Local Agency Formation Committee: re annexations #343, #348 & #351 -City of El Monte, and annexation #1964 -1 City of San Gab- riel. Councilman Tyrell moved to receive and file, Councilman Dickason seconded, and carried. 18. TIME FOR THOSE I N THE AUDIENCE .'HO WISH TO SPEAK: No one came forward at this time to speak. 19. MATTERS FROM CITY OFFICIALS: Assistant City Manager Koski advised the Council that we had re- ceived a letter from the Calif, Highway Patrol advising that they would no longer furnish crossing guards for the City. He pre- sented Resolution No. 64 -400 requesting the L. A. Following discussion Council- man Tyrell moved to adopt Resolution No. 64 -400, Mayor'Merritt 649 1 1 Council Minutes, Aug. 24, 1964, pare 5 seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker Mr. Koski presented Resolution No. 64 -401 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING THE CITY ENGINEER TO MAKE AND DELIVER A DIAGRAM OF ACQUISITION FOR AND OF PROPERTY WITHIN VEHICLE PARKING DISTRICT NO. 2 OF SAID CITY. He explained this was the next step necessary in the acquisition of the properties in this parking district. Councilman Tyrell moved to adopt Resolution No. 64 -401, Council. man Harker seconded, roil call to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman- Nunamaker The Assistant City Manager advised the contract had been award- ed by the Board of Supervisors for Double Drive for $166,000. and the City share is around $70,000. Discussion followed re -. garding the island. It was moved by Councilman Tyrell to put in the electric and water stubs at this time for future use and also to use green asphalt for the island part until such time as it can be landscaped, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilman - Nunamaker The County will not agree to the landscaping and as they pre- sently own the eastern half of the street and adjacent proper- ties are in unincorporated area, this improvement will be held up as far as the landscaping is concerned. There is a possi- bi bility.the County will turn the street over to the City and if so the City can again consider the landscaping. Councilman Tyrell referred to the northwest corner of Encinita and Broadway as violating the obstruction abatement ordinance which the staff will take care of. Mayor Merritt asked about the corner at Encinita and Las Tunas and Assistant City Manager Koski advised it was primarily a matter of enforcement at this time, and Sgt. lailace will check this out and report back. 20. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman Dickason second- ed, and carried. Council adjourned at 9:07 P. M.
