MINNEGASCO Kit Nissam and Gary Petricka of Minnegasco presented cost information for installing gas lines along Co. Rd. 24 from Hickory Dr. to Mohawk Dr. near city hall. They explained that a deposit of $28,749 would be required for the gas main with $6114 contributed by the city; $15,090 by the residents and $7545 from the owners of SouthRidge Farm. They explained that the cost for installing the line from the main to the house is $4.67 per foot, with no charge for the first 50 feet. Also they listed costs to convert furnaces and other appliances. They then met with individual property owners in an adjacent office to discuss specific situations. 5. KATHY COOK Kathy Cook presented a. petition from property owners adjacent to Co. Rd. 19, north of the present 45mph sped zone on Co. Rd. 19, requesting that a study be done to determine if the speed in that area could be reduced from 55 mph to 45mph. Police Chief Rick Rabenort stated that foot traffic in the area had increased. Kathy Cook stated that there will be more pedestrian traffic after the Maple St. hark is completed. Moved by Acromite, seconded by Zietlow to request that a speed study be done on Co. Rd. 19 from the existing 45mph zone, northerly, to Maple St.; for the possibility of reducing the speed limit in that area to 45mph. Motion declared carried 6. LANDFILL SI`1ING Robert Mitchell explained that lobbiest Larry Redman is working to set up a meeting of city council members with Senator Merriam to discuss what the state plans are for additional landfill space when landfills are filled. `.CONSENT AGENDA. 62 8. PUBLIC WORKS DEPARMENT * Wright -Hennepin Electric Moved by Scherer, seconded by Zietlow to adopt Resolution 91-28, allowing Wright -Hennepin Electric to install underground lines in South Ridge Farm. Motion declared carried Civil Defense Sirens, Public Hearing, 8:00 P.M. Jim Dillman explained that the city had purchased three sirens from the City of Richfield at a cost of $500 each and the purpose of this hearing was to inform residents of the planned locations of the sirens. Don Anderson of. Hennepin County Emergency Preparedness stated that the city had made an exceptional purchase, as new sirens cost from $7000 to $12,000 and decoders cost $2700. The sirens purchased for $500 have new decoders in them. He indicated on a map where staff would like to place the sirens; one at the Medina Morningside well house; one at either the Independence beach well house or on park property and one at Holy Name Lake park: Ellen Olson, principal of Holy Name school,asked if the siren could be located on church property as the facility is in use most of the time, not just during church and school hours and a siren on the property would definitely be heard. Don Anderson stated that the sirens were for weather alerts and were activated from the weather service to the county sheriffs radio. Moved by Mitchell, seconded by Scherer to close the public hearing. Motion declared carried Public Hearing was closed at 8:15 p.M. Moved by Mitchell, seconded by Scherer to authorize installation of three storm warning sirens; one at the Medina Morningside well house; one on Holy Name Church property and one in the Independence Beach area, _location to be determined by staff. Motion declared carried Cherry Hills Farm, 4th Addition, Street and Utility Improvements Glenn Cook reported that fifteen bids had been received for street and utility improve- ments at Cherry Hill Farm, 4th Addition, on April 30, 1991 at 10:00 A.M., with B and D Underground the low bidder at $142,809.00. He stated that they had worked with the com- pany on other projects and because they are a small company the work may not be completed as quickly as if they were a larger firm, but they do satisfactory work. Moved by Acromite, seconded by Scherer to adopt Resolution 91-29, awarding bid for Cherry Hill Farm 4th Addition street and utility work, to B and D Underground at a cost of $142,809.00. Motion declared carried Independence Beach Water Information Philip Zietlow reported that water filter tests will be run at three problem houses and that Minnesota Water Treatment Co. had agreed to do the testing at no cost to the city. He stated that Culligan had been contacted but they wanted some of the costs of the test to be paid by the city. Gary Acromite asked how long the testing would continue. Philip Zietlow stated that a report would be gotten in June. Orlo Eisinger and Emil Jubert stated that Robert Hill Co. in St. Louis Park should be contacted as they have a very good filter. Philip Zietlow stated that after the testing he would not want to recommmd a specific filter and that information received from the residents in the survey indicated that they wanted to solve their own problems if the city would provide them with information. Charlie Pangier, Conciliation Court Summons Jim Dillman stated that he and Philip Zietlow would work on this matter with Ron Batty. * Summer Youth Employment Program Moved by Scherer, seconded by Zietlow to enter into agreement with Twin City Tree Trust for administration of the Summer Youth Employment Program. Motion declared carried Data Base Map Glenn Cook explained that Hennepin. County had base maps of eachcity on a computer disk which Medina can purchase for about $150., but because Medina does not have a CAD system Bonestroo would use the disk and prepare maps for city projects. He stated that Medina must agree that the disk will be used only by t'-e-city and must_not be sold to anyone else. Moved by Scherer, seconded by Zietlow to enter into an agreement with Hennepin County for the purchase of an electronic map data base and to agree not to distriute the data base disk to anyone except city consultants. Motion declared carried Elm Creek Interceptor Gary Acromite asked that this item be discussed at time Comprehensive Plan is discussed. 9. PLANNING AND ZONING DEPARTMENT Lance Beaulieu, Subdivision Loren Kohnen explained that Lance Beaulieu had made application to subdivide 39.5 acres at 2662 Hamel Rd. into two parcels; a 23.33 acre parcel which is their homesite and a 15.59 acre parcel which they intend to sell. He stated that access to the front parcel "B" would be obtained through a 60 ft. by 60 ft. outlot at Hamel Rd.; over the existing driveway. Robert Mitchell asked that access for a future subdivision of the 15 acre parcel be discussed. Attorney, Clarkson Lindley, stated that the purchaser of Parcel "B" should be made aware of the necessity to obtain an easement from the owner of Parcel "A" should Parcel "B" ever by subdivided. Moved by Mitchell, seconded by Zietlow to authorize staff to prepare a resolution allowing subdivision of the Lance Beaulieu property at 2662 Hamel Rd. according to Planning Commiss- ion recommendations, recommendations from the city engineer regarding easements along Hamel Rd. and access to Parcel "B" if ever subdivided. Motion declared carried Juergen Holzer, Conditional Use Permit Loren Kohnen explained that Juergen Holzer had made application to construct an auto.body/ training facility on Pioneer Tr. south of Hwy. 55. He stated that the application also included a motel facility on the upper floor with all of the facilities allowable under city ordinance. Philip Zietlow asked if a potential .sel tic problem will be created if the motel is allowed. Loren Kohnen stated that if they maintain the number of students and employees at 15 the septic system will be sufficient. Robert Mitchell explained that the Metropolitan Council has criticized Medina for allowing commercial businesses in an unsewered area. Juergen Holzer stated that the motel facility would be excellant for his students who come from out of state. He asked if offices could be constructed on the upper floor or if a caretakers livin<vcuarters would be allowed. Robert Mitchell stated that it is unusual to have living quarter above a business. Philip Zietlow stated that there are living quarters above the stable across Pioneer tr. Loren Kohnen explained that the site plans need to be revised to accomodate the realignment of Pioneer Tr. and relocating the septic system site. Moved by Mitchell, seconded by Zietlow to table the matter untilMay 21 and ask applicant to revise the site plan to accomodate the realignment of Pioneer Tr. and to ask him to reconsider his application for a motel on the upper level of the building. Motion declared carried Walter Diachuk, Conditional Use Permit Loren Kohnen explained that Walter Diachuk had made application for a Conditional Use Permit at the southwest corner of Co. Rd. 24 and Hunter dr. to accomodate a home occupation in a new house that is to be built. He stated that normally home occupation applications are not brought before the planning commission and council but because this facility is large, covering three floors, plus an elevator, he had brought it before the city. Robert Mitchell stated that those working in the office must be family members who live in the house. Mrs. Diachuck stated that only she and her husband would work in the office, other employees are in Shoreview and that they have two teenage children living at home. 64 Jim Dillman stated that some additional information is needed regarding the driveway entrance. Moved by Mitchell, seconded by Zietlow to authorize preparation of a resolution granting a home occupation Conditional Use Permit to Walter Diachuk according to Planning Commiss- ion_ recommendations with no family members except those living in the house to be working in the office, owners to work with staff to finalize entrance requirements, permit to be issued to- the'Diachucks with a new owner needing to apply for a new permit. Motion declared carried Robert Pierce, Subdivision Loren Kohnen explained that Robert Pierce had made application to subdivide approximately 21 acres west of Willow dr.; south of Medina Morningside, into 29 lots. He stated that the applicant needs direction from the city as to how to proceed, should he approach the cities of Long Lake and Orono regarding sewer to the property? Robert Mitchell stated that the Metropolitan Council is negative to - e— iee extending se;ae � a. Pv�k f's o v c6an- lse5rcleniiit1, e,i\C1 s 1on Robert Pierce stated that the proposal is not out of character with Medina Morningside housing and would act as a transition to the larger lots in Orono. Philip Zietlow stated that the Metropolitan Council does not support sewer expansion in that area. Attorney, Richard Schieffer, stated that the owner of the. property, Fred Keller, had made application to have a number of lots sewered in the 1970's, but Orono would not allow vacant property to be sewered, merely the 80 lots in Medina Morningside. Then in the late 1980's he had made application for subdivision but he stated that he did not know how far that application had gotten. Donna Roehl explained that there had been applications for subdivision and for sewer in the late 1970's but Orono would only agree to allow sewer to the existing Medina Morning - side houses Gary Acromite stated that the Metropolitan Council would look with disfavor on pockets of sewer. Richard Schieffer stated that the Metropolitan Waste Control Commission has said "give us a problem and we'll solve it," Voile the Metropolitan Council draws a line regarding development. He asked that council give favorable consideration to this request. Fred Keller stated that there is a lift station on his property which anticipated sewer expansion. Gary Acromite asked if the city would want to change the zoning of the property. Philip Zietlow stated that there now is large lot zoning and sewer could be requested for 5 acre lots. Robert Pierce stated that if sewer can be brought in for 5 acre lots it could just as well serve one half acre lots. Wilfred Scherer stated that the city should contact Long Lake and Orono before the Metro Council. Robert Pierce stated that he wanted direction from the city council. Philip Zietlow stated that the direction is for 5 acre lots. Moved by Mitchell, seconded by Zietlow t of rezoning the Keller property to urban sewer C o_ i d e.Y14%a\ con o O Q o Se Motion carried Voting No -Scherer rw rQ r e 5' a ,n. a + Laurel Awes, Rezoning and Conditional Use Permit Robert Mitchell stated that action on the Awes application needed to be preceded by amending the RR-2 ordinance; then rezoning to RR-2 PUD and then approve the PUD conditions. He stated that the drainage problem in the southeast corner will be corrected by putting the pipe in at the correct elevation; the operation does not meet the cities ordinance but the PUD would allow 28 horses; hardcover is 47% while ordinance requires 40%; the apartment in the barn can be considered a residential unit and the water flow can be metered because the drainfield is not sufficient to accomodate what is being allowed on the property; portable toilets are to be used for special events. Moved by Mitchell, seconded by Zietlow to adopt Or.d.inance::#.253 amending the RR-2 dis- trict and to authorize staff to prepare a summary ordinance for publication. Motion declared carried Moved by Mitchell, seconded by Zietlow to authorize preparation of an ordinance to rezone the Awes property at Hwy. 55 and Pioneer Tr. to RR-2 PUD. Motion declared carried 65 Moved by Mitchell, seconded by Zietlow to authorize preparation of a development agreement for Laurel Awes to operate a horse facility at 4555 Pioneer Tr. according to Planning Comm- ission minutes with the number of horses, percentage of hardcover, no separate house, septic system to be monitored and staff to work with Richard Schieffer on the details. Motion declared carried Loren Kohnen thanked Robert Mitchell for attending the Planning Commission meeting to explain what was needed to complete the application. Tuckborough Farm, 3rd. Addition, Preliminary Subdivision Moved by Acromite, seconded by Zietlow to adopt Resolution 91-29, granting preliminary sub- division approval to Tuckborough Farm 3rd Addition. Motion declared carried North/South Road Easement Vacation Moved by Mitchell, seconded by Acromite to hold a public hearing on June 4, J_991, at 8:00 p.m. for the purpose of vacating the north/south easement in Tuckborough Farm 3rd Addition. Motion declared carried Comprehensive Plan Amendment Gary Acromite presented a report he had prepared from the Planning Commission/City Council committee meeting in response to a letter received from Barbara Senness of the Metropolitan Council. City Councilmembers reviewed the report, discussing the ultimate sewer area; residential units; service to six existing commercial establishments experiencing septic problems; the Elm Creek Interceptor and how it is to be sized and in what form the response to the Metro Council should be. Representatives of Loram, W.G. Anderson, Temroc and Lundgren Bros. comments on the amend- ments. Moved by Mitchell, seconded by Acromite to authorize Glenn Cook to prepare a letter of response to Barbara Senness of the Metropolitan Council explaining that council will for- ward a revised copy of the plan which addresses their concern; Gary Acromite and Robert Mitchell to meet with John Bergley to secure maps and software of the June 19, 1990 plan and Philip Zietlow to prepare a vision statement for the June 4th meeting. Motion declared carried Elm Creek Interceptor Moved by Acromite to approve resolution regarding timing for planning and construction of the Elm Creek Interceptor. Motion not seconded. * 10. IMPREST FUND Moved by Scherer, seconded by Zietlow to transfer $738.69 from General to Imprest Fund.. Motion declared carried * 11. HAMEL FIRE DEPARTMENT Moved by Scherer, seconded by Zietlow to tranfer $12,000 from the Hamel Fire department Relief Ass'n. to the fire department Pension Fund. Motion declared carried 12. TREE PLANTING PROJECT Wilfred Scherer reported that funds were being collected.for the pioneer tree planting project at city hall. Orlo Eisinger has teen doing a great deal of the organizing and no city funds will be spent. 13. HUNTER FARMS PARK Philip Zietlow stated that a resident of Hunter Farms would like another survey of the area taken and if favorable he would also dedicate 5 feet for an easement. 1.4. PAYMENT OF BILLS Moved by Mitchell, seconded by Zietlow to pay the bills; Order Checks # 9605-9675 in the amount of $85,206.88 and Payroll Checks # 12131-12165 in the amount of $25,018.71; and payroll checks $8933-8934 in the amount of $150.00.
