HomeMy Public PortalAboutResolution 65-543follows: RESOLUTION NO. 65 -543 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 65 -167 The City Council of the City of Temple City does resolve as Section 1. That the City Council does hereby find, deter- mine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, locat• ed at 5434 Temple City Boulevard in said City, more particularly des- cribed as the South 80 feet of N. 150 feet, of W. 189.23 of Lot 52, Mission View Acres in Map Book 448 -2, Page 226; have heretofore filed an application for a zone variance to create a second dwelling unit and detached garage with less than the required distance between acces- sory buildings and less than the required side and rear yards on a non - severance development; and (b) That the Planning Commission has conducted a duly notic- ed public hearing on such application; that said hearing was duly clos.• ed and Resolution No. 65 -181PC adopted recommending such variance; that this City Council has held a public hearing on the appeal thereof! (c) That based upon the evidence adduced at said hearing, the files and applicable staff reports, and each member of the City Council being familiar with the proposed site, said City Council deter- mines that the facts required by Section 1802 of the Temple City Zon- ing Ordinance are present and therefore the zone variance application should be granted for the reason that the denial would constitute an unnecessary hardship and a denial of privileges enjoyed by surrounding properties; that there are special circumstances extant; that no de- triment to neighboring properties will occur, and the grant is not inconsistent with the General Plan. Section 2. That the•zone variance application, hereinabove described be and the same is hereby granted subject to the following conditions for the reasons above set forth. (a) Development of the subject property shall be substan- tially in accord with the plot plan, Exhibit "A" dated October 26, 1965. (b) The Property shall be developed on a non - severance bash . and a covenant and agreement to that effect shall be executed and re- corded with the Office of the County Recorder and a copy thereof placed on file with the City Clerk. (c) This variance shall expire and be of no effect unless exercised within a period of one year from and after the date of adop- tion of this resolution. (d) Applicant shall file, or cause to be filed, with the City Clerk a document which the City may record, which shall acknow- ledge that the owner of the subject property is aware of and accepts the conditions set forth in paragraphs (a) through (c) above, and that the subject property, regardless of any change in ownership is bound by and subject to the provisions of this Resolution and the con- ditions contained herein. (e) Applicant shall sign an acknowledgement that said prop- erty shall be used for two dwelling units and no more. (f) Applicant shall countersign this Resolution indicating its acceptance of the conditions set forth herein. 757 Resolution No. 65 -543, page 2 Section 3. The City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED this 16th day of November, 1965.
