AN ORDINANCE VACATING CERTAIN PUBLIC WAYS WITHIN THE
CITY OF RICHMOND, INDIANA, BEING THOSE PORTIONS OF
NORTH "J" STREET, NORTH 13th STREET, AND THE TWENTY
FOOT ALLEY BETWEEN LOTS NOS. 55 AND 56 IN THE PERRY
ADDITION.
WHEREAS, the City of Richmond, Indiana,ae-p-artm'en•t-o-f•-C-orrmLtrri•ty,

Commission has petitioned the Common Council requesting
vacation of those portions of North "J" Street, North
13th Street and the twenty foot alley between Lots
Nos. 55 and 56 in the Perry Addition; and,
WHEREAS, the Common Council, pursuant to the provisions of
I.C. 36-7-3-12, conducted a public hearing on said
vacation petition on November 21, 1983;
and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission the 22nd day of November
1983, at which time remonstrances were heard from all
parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the Richmond City Plan Commission was
6 to 0 in favor of/i.n_appositinn-to recommending
passage of Ordinance No. 66-1983.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of Richmond, Indiana, as follows:

SECTION 1. That subject to the preservation of all easements
for existing utilities, all public ways within the territory
described below are hereby vacated:
Tract One:
Being part of North "J" Street between North Twelfth
(12th) Street and relocated North Thirteenth (13th)
Street and that part of North Thirteenth (13) Street
west of relocated North Thirteenth (13th) Street in
the City of Richmond, Indiana and being in the North-
west Quarter of Section Thirty -Three (33), Township
Fourteen (14) North, Range One (1) West and being
more particularly described as follows:
Beginning at the intersection of the east line of
North Twelfth (12th) Street and the south line of
North "J" Street at the northwest corner of lot
number eight (8) in Reeves and Foulke's Addition,
and running thence north fifteen (15) degrees and
fifteen (15) minutes east, along the east line of
said North Twelfth (12th) Street, sixty-two and
nine hundredths (62.09) feet to the southwest corner
of lot number seven (7) in said Addition and the
north line of North "J" Street; thence south eighty-
nine (89) degrees and thirty-nine (39) minutes east,
along the north line of said North "J" Street, one
hundred sixty-seven and eleven hundredths (167.11)
feet to the west line of North Thirteenth (13th)
Street and the southeast corner of said lot number
seven (7); thence north zero degrees and forty-four
(44) minutes east, along the west line of North
Thirteenth (13th) Street, forty-eight and sixteen
hundredths (48.16) feet to a point on a curve; thence

(8.50) feet to a point of curve; thence southwardly,
along a three hundred thirty-three foot radius curve
to the left a distance of one hundred ten and thirty-
one hundredths (110.31) feet to a point in the west
line of said North Thirteenth Street; thence north
twenty-one (21) minutes east fifty-one and ninety-five
hundredths (51.95) feet to the northeast corner of Lot
Number Nine in Reeve's add Foulke's Addition and the

of the proposed relocation of North Thirteenth (13th)

minutes west, along the north line of said Lot ten (10)
and the south line of North "J" Street, a distance of

feet to the east line of relocated North Thirteenth

(12) foot wide alley and west of a twenty (20) foot

at the northwest corner of Lot Number Four Hundred
Thirty-nine (439) on the Official Map of the City of
Richmond, and running thence north zero (00) degrees
and twenty-nine (29) minutes east, along the east
lineof said alley, forty and eighty-seven hundredths
(40.87) feet to the south line of relocated North "J"
Street; thence south seventy (70) degrees and forty
(40) minutes east, along said south line, forty-seven
and ninety-four hundredths (47.94) feet to the west
line of a twenty(20) foot alley; thence south nineteen

five (55) in said addition and running thence south
zero (00) degrees and twenty-nine (29) minutes west,
along the west line of said lot, one hundred twenty
and seventy hundredths (120,70) feet to the north line
of relocated North "J" Street; thence north seventy
(70) degrees and forty (40) minutes west, along said
north line, twenty-one and thirteen hundredths (21.13)
feet to the east line of lot fifty-six (56); thence
north zero (00) degrees and twenty-nine (29) minutes
east, along said east line, one hundred thirteen and
eighty-two hundredths (113.82) feet to the northeast

SECTION 2. This Ordinance shall be in full force and effect
from and after the passage and approval as by law required.

PETITION TO THE COMMON COUNCIL OF
THE CITY OF RICHMOND, INDIANA FOR
THE VACATION OF PUBLIC WAYS
The Petitioner, the City of Richmond, Indiana, Department of Redevelop-
ment, acting by and through Richmond Redevelopment Commission, pursuant
to the provisions of IC Section 36-7-3-12, hereby petitions the Common
Council of the City of Richmond, Indiana, as follows:
1. That Petitioner is a duly organized and existing Commission
pursuant to the laws of the State of Indiana, and as such is authorized
to act for and on behalf of the Department of Redevelopment of the City
of Richmond.
2. That as a part of the execution of the North Richmond Urban
Renewal Plan, the Petitioner was instrumental in causing the relocation
of North "J" Street immediately east of North 12th Street in the City of j
Richmond, which relocated North "J" Street has been constructed and
dedicated to the City of Richmond as a public way, across real estate
acquired by your Petitioner for that purpose. j

3. That as a part of the execution of the North Richmond Urban
Renewal Plan, the Petitioner was instrumental in causing a portion of
North 13th Street lying immediately south of relocated North "J" Street
relocated over real estate acquired by your Petitioner and dedicated j
to the City of Richmond as a public way.
4. That as a consequence of the relocation of portions of North
d "J" Street and North 13th Street in the City of Richmond as set forth
in paragraphs 2 and 3 of this Petition, a portion of North "J" Street
and of North 13th Street is no longer required for use as a public way,
and should be vacated.
5. That an alley 20 feet in width running north from relocated
North "J" Street and bounded by Lots numbered 55 and 56 in The Perry
Addition on the east and west respectively is shown as a public way to
be vacated on the North Richmond Urban Renewal Plan and is no longer
required as a public way and should be vacated. That your Petitioner
owns both Lots 55 and 56 in The Perry Addition.
6. That legal descriptions of those portions of the existing North
"J" street, the existing North 13th Street and the existing 20 foot
alley between Lots numbered 55 and 56 in The Perry Addition which are no
longer needed for use as a public way and which your Petitioner requests
be vacated are attached hereto, together with a plat depicting the areas
to be vacated as shaded areas on said plat, the legal descriptions
hereby being designated as "Exhibit A" consisting of four pages and the
plat hereby designated as "Exhibit B" to this Petition.
7. That the Petitioner owns most of the land east of North 13th
Street and north of North "J" Street which abuts the public ways sought
to be vacated by this Petition, and the names and addresses of all
persons in addition to the Petitioner who own land abutting the property
proposed to be vacated are attached hereto, made a part hereof, and
marked "Exhibit C".
S. That said vacation will not deprive any owner of ingress or
egress to his property.
9. That such vacation should be subject to easements for the
continued location, maintenance, and repair of existing public utilities,
if any, located in the land proposed to be vacated.
WHEREFORE, the Petitioner, respectfully requests that a public
hearing be conducted on its Petition for the vacation of the above
described public ways in accordance with the provisions of IC Sections
36-7-3-12 and 36-7-4-512.
