AN ORDINANCE TO ESTABLISH A HEALTH INSURANCE FUND AND PROVIDE FOR
A SURVIVING SPOUSE OR RETIREE TO PARTICIPATE IN THE INSURANCE PROGRAh;
WHEREAS, the City of Richmond has a self -insured health insurance
plan administered by a health insurance carrier which is
offered to the City employees; and
WHEREAS, the City of Richmond pays 70 percent and the employees pay
30 percent of the premium as established annually in December
each year forthe following year.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Wayne County, Indiana:
SECTION 1. That the fund known as the Health Insurance Fund be
established; and,
SECTION 2. That the employee's share (30 percent) be placed into
the fund at the time it is withheld by the City along with
the City's share (70 percent) from the respective employee's
department budget; and,
SECTION 3. That a surviving spouse of an employee of the City of
Richmond may elect to continue the health insurance
at 30 percent payment of premium to be placed in this
fund for a period not to exceed: One year from the
month of death; and,
SECTION 4. That a retiree's electing to continue the health
insurance without lapse in coverage, may pay into
this fund 100 percent of the premium plus a 30 percent
surcharge. A retiree from the City employment with a
minimum of ten (10) years service, and be a minimum
age of 55 years, except the City's Police and Fire Depart-
ment employees, who must have served twenty (20) years,
regardless of age, or become disabled while on duty,
both being certified bythe Pension Board. A surviving
spouse may participate on the same basis as a retiree
after the expiration of the time limits set forth in
Section 3; participation is limited to age 65 or
eligibility for medicare; and
SECTION 5. That any lapse in coverage by a surviving spouse or
retiree voids his/her opportunity to participate in the
City insurance plan. Any surviving spouse or retiree
will have ninety (90) days to enroll in this plan from
date of passage of this Ordinance. No additional
dependents may be added for coverage without furnishing
evidence of insurability for coverage under Sections
3 or 4 above, except those unborn children who were
conceived on or prior to the date of death or retirement
of the City employee; and,
SECTION 6. That any retiree or surviving spouse who is on or
qualified for other Group Health Insurance coverage can
not participate in this fund; and,
SECTION 7. That this Ordinance be subject to acceptance by claims
administrator, specific deductible excess carrier and/or
aggregate stop loss carrier.
PASSED AND ADOPTED by the Common Council of the City of Richmond,

AMENDMENTS
ORDINANCE NO. 73-1983
Section 3.
1. Delete 100 percent and add 30 percent in line 3.
2. Delete (1) Two years from the month of death if death
occurred in the line of duty, or (2) One year from the
month of death if the death was by natural causes; and,
3. Add: One year from the month of death; and,
Section 4.
1. Add "while on duty" after disabled in line 8.
2. Add to end of Section 4 "participation is limited to
age 65 or eligibility for medicare; and,
Section 5.
1. Add "for coverage without furnishing evidence of insurability"
in lines 6 and 7.
Section 6.
Add new Section 6 reading: That any retiree or surviving
spouse who is on or qualified for other Group Health Insurance
coverage can not participate in this fund; and,
Section 7.
Add new Section 7 reading: That this Ordinance be subject
to acceptance by claims administrator, specific deductible
excess carrier and/or aggregate stop loss carrier.
AMENDMENTS TO ORDINANCE NO. 73-1983
1. Amend the Title by striking the word "account" and adding the
word "fund", and by striking the words "widow or widower" and
adding the words "surviving spouse". The title will read:
"AN ORDINANCE TO ESTABLISH A HEALTH INSURANCE FUND AND PROVIDE
FOR A SURVIVING SPOUSE OR RETIREE TO PARTICIPATE IN THE INSUR-
ANCE PROGRAM.
2. Section 1 - Strike the word "account" and use the word "fund",
and strike the words "within the Payroll Fund".
3. Section 2 - Strike the word "account" and substitute the word
"fund".
4. Section 3 - Change the words "widow or widower" to "surviving
spouse"; change the words "if electing" to "may elect"; add
the word "to" before "be (placed)", and strike the words
"account (not to exceed") and substitute the words "fund for
a period". Section 3 will now read: "That a surviving spouse
of an employee of the City of Richmond may elect to continue
the health insurance at 100 percent payment of premium to be
placed in this fund for a period not to exceed: 1) Two years
from the month of death if death occurred in the line of duty,
or 2) One year from the month of death if the death was by
natural causes; and,
Section 4 - Strike the word "account" and substitute the word
"fund"; change the "eight" years of service to "ten" years
of service; change the minimum age of "50" to minimum age of
"55" years and add the following additional sentence to the
Section: "A surviving spouse may participate on the same basis
as a retiree after the expiration of the time limits set forth
in Section 3." Section 4 will now read: "That a retiree's
electing to continue the health insurance without lapse in
coverage, maypay into this fund 100 percent of the premium
plus a 30 percent surcharge. A retiree under this Ordinance
is an individual who has retired from City employment with
a minimum of ten years service, and be a minimum age of 55
years, except the City's Police and Fire Department employees,
who must have served twenty (20) years, regardless of age,
or become disabled, both being certified by the Pension Board.
A surviving spouse may participate on the same basis as a retiree
after the expiration of the time limits set forth in Section
3; and,
Section 5 - Substitute the words "surviving spouse" for the
words "widow or widower" throughout this section and add the
sentence, "No additional dependents may be added for coverage
under Sections 3 and 4, above, except those unborn children
who were conceived on or prior to the date of death or retire-
ment of the City employee."
