HomeMy Public PortalAbout15-1548ORDINANCE NO. 15-1548 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, REPEALING CARSON MUNICIPAL CODE ARTICLE 11, CHAPTER 1, SECTION 2110 RELATED TO CITY ADMINISTRATIVE ORDERS AND DIRECTIVES TO STAFF WHEREAS, the City Council of the City of Carson finds that open communication between members of the City Council and employees of the City is necessary to the orderly running of the City and in staff s ability to implement the policies set by the Council; and WHEREAS, the City Council finds that open communications with staff is necessary to an open and transparent government; and WHEREAS, the Carson Municipal Code governs the administrative organization of the City of Carson; and WHEREAS, Article 11, Chapter 1, Section 2110 of the Carson Municipal Code provides that: "The City Council and its members shall deal with the administrative services of the City only through the City Manager, except for the purpose of inquiry, and neither the City Council nor any members thereof shall give orders to any subordinates of the City Manager"; and WHEREAS the City Council desires to repeal Carson Municipal Code Article 11, Chapter 1, Section 2110. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The foregoing Recitals are declared as true and correct and adopted into the terms of this Ordinance by this reference. Section 2. Article 11, Chapter 1, Section 2110 of the Carson Municipal Code, which provides that "The City Council and its members shall deal with the administrative services of the City only through the City Manager, except for the purpose of inquiry, and neither the City Council nor any members thereof shall give orders to any subordinates of the City Manager" is hereby repealed in its entirety. Section 3. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this section, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or [MORE] ORDINANCE NO. 15-1548 PAGE 2 OF 3 enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this section, or its application to any other person or circumstance. The City Council declares that it would have adopted each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable. Section 4. The City Clerk shall cause this ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage, in accordance with Section 36933 of the Government Code, and shall certify to the adoption of this ordinance. Section 5. This Ordinance shall be in full force and effect thirty (30) days after its second reading and adoption.
