HomeMy Public PortalAbout077-1983 - Amending Chapter 154 - Zoning - 1712 Chester BlvdGENERAL ORDINANCE NO. 77-1983 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325- 1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1712 CHESTER BOULEVARD FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO R-2 SINGLE FAMILY RESIDENCE SPECIAL USE DISTRICT, AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A MEDICAL OFFICE. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District the property located at 1712 Chester Boulevard; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-2 Single Family Residence District to R-2 SU Single Family Residence Special Use District, and to authorize the Special Use of said property as a medical office; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Com- mission the 13th day of December, 1983, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was nine (9) to zero (0) in favor of recommending the passage of Ordinance No. 77-1983. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-2 SU Single Family Residence Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amend- ments thereto. There following described real estate situated in the City of Richmond, Indiana, to wit: A part of the northeast quarter of Section 29, Township 14, Range 1 West, bounded as follows, to -wit: Beginning at a point in the East line of said Northeast Quarter, said point being 68.64 rods North of the Southeast corner of said quarter; thence West 54.23 rods to a stake; thence North 8-2/3 rods to a stake; thence east 54.23 rods to the East line of said quarter section; thence South 8-2/3 rods to the place of beginning, containing 3 acres, more or less. ALSO, the right to ingress and egress over a certain right-of-way as now established being 60 feet in width and lying immediately south of and adjacent to the above des- cribed real estate being an easement granted by Ethel P. Reid widow to Fannie Co. Nicholson, her heirs and assigns forever, EXCEPTING THEREFROM the following described parcel of land: Beginning at a point 68.64 rods North of and 54.23 rods West of the Southeast corner of said quarter section; thence North 8-2/3 rods; thence East 18.79 rods; thence South 8-2/3 rods; thence West 18.79 rods to the place of beginning, con- taining in said exception 1.016 acres, more or less. ALSO EXCEPTING THEREFROM Being a part of the Northeast Quarter of Section 29, Township 14 North, Range 1 West in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at an iron pipe set on the north right-of-way line of Keyser Lane, said point being more particularly described as follows: Commencing at the Southeast corner of the Northeast Quarter of said Section 29, and running thence, north 0 degrees and 55 minutes east, along the said East line of the Northeast Quarter, 1132.50 feet; thence North 89 degrees and 04 minutes West, along the North right-of-way line of Keyser Lane, 308.39 feet to the beginning point of this description; and running thence, from said beginning point, continuing North 89 degrees and 04 minutes West, along the North right-of-way line of Keyser Lane, 275.58 feet to an iron pipe; thence North 0 degrees and 55 minutes East, parallel with the East line of the said Northeast Quarter 143.00 feet to an iron pipe; thence 89 degrees and 04 minutes East, parallel with the North line of Keyser Lane, 275.58 feet to an iron pipe; thence South 0 degrees and 55 minutes West, parallel with the East line of said Northeast Quarter 143 feet to the place of beginning, containing an area of 0.904 acres, SUBJECT to any easements of record. All bearing refer to the centerline of United States Highway Number 27 as running North 0 degrees and 55 minutes East. SECTION 2. That as provided in Articles 21 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described real estate is allowed as a Special Use as a medical office. SECTION 3. As a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. a. The owner shall seek the approval of the Richmond Board of Public Works and Safety regarding the location of street access to the proposed off-street parking area. b. The off-street parking area shall be paved and shall be developed according to the standards of Article 41 of the Zoning Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. December 14, 1983 Mr. Kenneth Mills, President Members of Common Council and Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 77-1983 Plan Commission Case PC-83-22 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, December 139 1983, on the petition of Clayton O. Maggard, et al, Owners; T.S. Milligan, Agent, requesting the rezoning of property located at 1712 Chester Boulevard from R-2 Single Family Residence District to R-2 SU Single Family Residence Special Use District, and also requesting authorization for the Special Use of said property as a medical office. Thirteen (13) notices of public hearing were sent to adjoining property owners with one (1) returned in favor of the request and three (3) returned in opposition to the request. During the public hearing no one spoke in opposition to the request. The Plan Commission determined that the petition meets the requirements and standards of the Zoning Ordinance and voted nine (9) to zero (0) to recommend that Ordinance No. 77-1983 be adopted with the two (2) conditions as stiuplated in Section three (3) of the Ordinance.
