GREEN STREET FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF SANITARY SEWERS A RESOLUTION OF INTENTION I WHEREAS, there has been filed with the City Council of the City of Temple City, a written petition for the improvement of Green Street and other rights of way by the construction of sanitary sewers and waiver of investigation proceedings required under Division 4 of Streets and Highways Code, signed by owners of more than 60 per cent of the area of the land proposed to be assessed for said improvement; and WHEREAS, following the above action, this Council has by resolution acknowledged the waiver of the investigation proceedings required under Division 4 of the Streets and Highways Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESOLVES: SECTION 1. That the public interest and convenience require and that it is the intention of the Council to order the acquisition of the necessary rights of way, and to order work to be done and improvement made, as follows, to -wit: First; The acquisition of rights of way for road purposes, Iby gift or purchase or eminent doma!n proceedings, consisting in gen- eral of the following: The southerly 25 feet of the northerly 359 feet of the easterly 720 feet of the westerly 940 feet and the southerly 25 feet of the northerly 384 feet of the easterly 900 feet of the westerly 1020 feet of Lot 45, E.J. Baldwins Addition No. 1 to Santa Anita Colony Tract, as shown on map recorded in Book 52, Page 60, of Mis- cellaneous Records. ances in Second: The construction of sanitary sewers and appurten- THE ABOVE DESCRIBED RIGHTS OF WAY TO BE KNOWN AS GREEN STREET; and in GREEN STREET between the easterly line of DEGAS AVENUE and the westerly terminus of said GREEN STREET as shown on map of Tract No. 29569, recorded in Book 737, Pages 72 and 73, of Maps. Third: The resurfacine of the trench in the streets and _ rights of way wherein the aforementioned sanitary sewers are con- structed. I AI1 of said work shall be performed in the streets and rights of way and between the limits hereinherfore designated except where the plans indicate that said work shall be omitted, THAT SUCH WORK OR iMPROVE.MCi T, 17 IS ESTIMATED, WILL COST THE TOTAL SUM OF EIGHTEEN) THOUSAND SIX HU;WRED FIFTY DOLLARS ($18,650), in which is included the estimated cost of acquisition and incidentals thereto in the amount of $2,565. SECT!ON 2. That all the work and improvements aforesaid shall be done and performed as shown on and in accordance with and to the grades 766 shown on the plans, profiles and specifications therefor, riled in the Office of the City Council of the City of Temple City. Reference is hereby made to said plans, profiles and specifications for a full and detailed description of said proposed work or improvement, and said plans, profiles and specifications shall govern for all details of the proposed work or improvement, and for the description of the grade to which this work is to be done. SECTION 3. I That the Council hereby makes the expense of the work or improvement chargeable upon a district, which district the Council hereby declares to be the district benefited by the work or improve- ment and to be assessed to pay the cost and expense thereof. A map of the district, indicating by a boundary line the extent of the territory included in the proposed district, approved by the Council and endorsed with the certificate of the City Clerk, is on file in the Office of the Council. Reference is hereby made to the map for a full and complete description of the assessment dis- trict and the map shall govern for all details as to the extent of the assessment district. SECTION 4. That serial bonds shall be issued in accordance with Divi- sion 7, Streets and Highways Code, to represent each assessment of fifty dollars ($50.00) or more remaining unpaid for thirty (30) days after the date specified in the statements mailed to the property owners, which date shall be not less than thirty (30) days from the date of mailing. The serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September lst following their dote, and shall bear interest at the rate of six (6) per cent per annum on all sums unpaid, until the I whole of the principal and interest is paid. The principal sum shall become due and payable to the Trea- surer in equal annual payments on each October 15th succeeding the September 1st following their date until fully paid. The first interest payment shall be payable to the Treasure. on the 7..pril 15th next succeeding the March 1st or the October 15t:: next succeeding the September lst, as the case may be, next followiny the date of the bonds. The following interest payments shall be for six months interest and shall be payable to the Treasurer on each fifteenth day of April and October, the last interest payment coming due the October 15th immediately preceding the last annual payment of the principal of the bonds issued to represent the unpaid assessment. SECTION 5. That the proceedings for the aforesaid work or improvement shall be under and in accordance with Division 7, Streets and High- ways Code. SECTION 6. That the streets hereinbefore referred to are public streets I located in the City of Temple City. SECTION 7. That it is the opinion of the Council that the public in- terest will not be served by allowing the property owners to take the contract for the work to be done under these proceedings. SECTION C. That Tuesday the 18th day of January, 1966, at the hour of 7:30 P.M. of said day, is the r'.ay and the hour and the Chambers of the City Council in the City Hall, 3938 Kauffman ,=.venueā€˛ Temple City, California, is the place fixed by the Council when and where any and -2- 767 all persons having any objections to the proposed work or improvement or to the extent of the district to be assessed, or to the proposed grades to which the work is to be done, or to any or all of the fore- going, may appear before the Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution. SECTION 9. I That the Street Superintendent shall cause to be conspicu- ously posted along the line of the contemplated work or improvement and along all open streets within the district liable to be assessed, notices of the adoption of this Resolution in the manner and in the form required by law. SECTION 10. That the Clerk of the Council shall certify to the adoption of this Resolution and shall cause the same to be published for two days in the Temple City Times, a newspaper published or circulated in the City of Temple City, which is hereby designated for that purpose by the Council. The Council does hereby direct the Clerk thereof to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed for the work herein de- scribed whose names and addresses appear on the last equalized assess- ment roll of the County of Los Angeles or as known to the Clerk, the contents of said notices to be as required by law. The foregoing resolution was, on the 7th day of December, 1966, adopted by the City Council of the City of Temple City, State of California. 1 ATTEST: City Clerk Mayor 768
