HomeMy Public PortalAbout02-17-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, TUESDAY, FEBRUARY 17, 2009 The Common Council of the City of Richmond, Indiana met in regular session Tuesday, February 17, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WELCH President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker and Diana Pappin. Absent were Councilors Kelley Cruse - Nicholson, Bob Goodwin and Phil Quinn. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the meeting of February 2, 2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ Mr. Tim Rogers, Director of the Wayne County Economic Development Corporation, was introduced to Council. COMMUNICATION FROM THE MAYOR ■ Bob Witherspoon, Garden City — collecting money for repairs to the Park (i.e., wells) REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the January 29 and February 5, 2009 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS CITY CONTROLLER, TAMMY GLENN: Distributed year end financial statements and reviewed the property tax funds. Ms. Glenn attended a presentation by Umbaugh and Associates, CPA's regarding the proposed effects to Wayne County of HB 1001. Wayne County, County School Corporations and the City of Richmond will be hiring Umbaugh to prepare a detailed report specific to participating entities. MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 6, 7, 8 & 9 -2009 on first reading by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Common Council Minutes February 17, 2009 Page 2 of 4 ORDINANCE NO. 6 -2009 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM M -1, TO M -1 SPECIAL USE (168 Ft. Wayne Avenue) The Clerk read Ordinance No. 6 -2009 on first reading by title only. Presented by the Director of Metropolitan Development, Tony Foster, this Ordinance is a petition to rezone the property at 168 Fort Wayne Avenue from M -1 Light Industrial District to M -1 Light Industrial Special Use District in order to allow the owner to establish a restaurant in the building. Ordinance No. 6 -2009 was referred to the Plan Commission for public hearing at its meeting on February 26, 2009. ORDINANCE NO. 7 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 76, SCHEDULE IV OF RICHMOND CODE REGARDING STREETS AND AREAS WHERE PARKING IS PROHIBITED AT ALL TIMES The Clerk read Ordinance No. 7 -2009 on first reading by title only Presented by Richmond Police Department Traffic Division Captain Terry Hopkins, this Ordinance would amend Chapter 76 of the Richmond Code to reflect no parking on Manor Drive from Catalpa Drive to Mendelson Drive. Councilor Welch moved to amend this Ordinance by prohibiting parking on both sides of Manor Drive and the south side of Catalpa from U.S. 27 west 250 feet, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 7 -2009 as amended to second reading and to suspend the rules and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 7 -2009 as amended on second reading by title only. Council President Wissel declared Ordinance No. 7 -2009 as amended on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 7 -2009, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 7 -2009 as amended to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 7 -2009 as amended on third reading by title only. Ordinance No. 7 -2009 as amended was adopted with a 6 -0 roll call vote. ORDINANCE NO. 8 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA HOUSING AND COMMUNITY DEVELOPMENT AUTHORITY The Clerk read Ordinance No. 8 -2009 on first reading by title only. Presented by Tony Foster, this Ordinance would authorize the Mayor to prepare and submit an application for Neighborhood Stabilization Program funds up to Three Million Dollars ($3,000,000) to acquire and rehabilitate foreclosed properties. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 8 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 8 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 8 -2009 as amended, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 8 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 8 -2009 on third reading by title only. Ordinance No. 8 -2009 was adopted with a 6 -0 roll call vote. ORDINANCE NO. 9 -2009 - AN ORDINANCE AMENDING ORDINANCE NO. 46 -2004 (Sewer Utility Rates) The Clerk read Ordinance No. 9 -2009 on first reading by title only. Presented by Sanitary District Superintendent Sam Lahanis, this Ordinance would establish increased fees for the treatment and disposal of sewage and other waste discharged in the sewerage system. Ordinance No. 9 -2009 will be heard on second reading and public hearing at the March 2, 2009 meeting. ORDINANCE NO. 10 -2009 — AN ORDINANCE AMENDING SECTION 59 -07(B) AND (C) OF THE RICHMOND CITY CODE SETTING FORTH STORM WATER RATES AND CHARGES The Clerk read Ordinance No. 10 -2009 on first reading by title only. Presented by Sanitary District Superintendent Sam Lahanis, this Ordinance would establish increase storm water rates and charges. Ordinance No. 10 -2009 will be heard on second reading and public hearing at the March 2, 2009 meeting. ORDINANCES ON SECOND READING ORDINANCE NO. 75 -2008 — AN ORDINANCE AUTHORIZING THE RECOVERY OF COSTS FOR EMERGENCY MEDICAL SERVICES PROVIDED BY THE RICHMOND FIRE DEPARTMENT; ESTABLISHING FEE SCHEDULES; AND APPROVING APPROPRIATIONS OF FEE PAYMENTS The Clerk read Ordinance No. 75 -2008 on second reading by title only. This Ordinance would authorize the City of Richmond to recoup the costs of services provided and the cost of supplies expended during an emergency medical response by the Richmond Fire Department. Ordinance No. 75 -2008 will be held on second reading at the March 16, 2009 meeting. ORDINANCE NO. 1 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 74 OF RICHMOND CODE REGARDING PARKING FACILITIES The Board of Public Works and Safety approved the elimination of certain charges associated with certain parking facilities. This Ordinance would amend Chapter 74.47 of the Richmond Code to reflect the changes. Common Council Minutes February 17, 2009 Page 4 of 4 Ordinance No. 1 -2009 was tabled until the March 2, 2009 meeting of Common Council. Ordinance No. 1 -2009 will be held on second reading at the March 16, 2009 meeting. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
