A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARSON. CALIFORNIA, DELINEATING CERTAIN LOCATIONS
FOR THE OPERATION OF PIPELINES OR OTHER FACILITIES,
AND AMENDING A NONPUBLIC UTILITY PIPELINE FRANCHISE
GRANTED TO CHEMOIL TERMINALS CORPORATION
The City Council of the City of Carson does hereby find and resolve as follows:
Section 1. Recitals.
A. On November 3, 2004, the City Council adopted Resolution No. 04-149, declaring
its intention to grant a nonpublic utility pipeline franchise to Chemoil Refining Corporation.
B. On December 8. 2004. the City Council adopted Resolution No. 04-121., delineating
certain locations for the installation and operation of pipelines or other facilities in connection
with a nonpublic utility pipeline franchise granted to Chemoil Refining Corporation.
C. On December 21, 2004, the City Council adopted Ordinance No. 04-1323) granting
to Chemoil Refining Corporation, a 25 -year franchise to construct, lay. operate, maintain, use,
renew, repair, replace, remove, change the size and number of, and remove or abandon in place a
system of pipelines and appurtenances for the purpose of conducting, transporting, conveying
and carrying gas, oil, petroleum, wet gas, hydrocarbon substances, water, wastewater, mud,
steam and other liquid substances not more hazardous than the aforementioned substances,
together with all manholes.. valves, appurtenances and service connections necessary or
convenient for the operation of such pipes or pipelines including conduits, cathodic protection
devices, wires, cables and other appurtenances necessary or convenient for the exercise of the

D. On April 5, 2005, the City Council adopted Resolution No. 05-037, consenting, to
the assiginnent of the Chemoil Refining Corporation nonpublic utility pipeline franchise to
Chemoil Terminals Corporation.
E. On December 4. 2012, the City Council adopted Resolution No. 12- 13 )3, amending
Ordinance No. 04-1323, adding 204 feet of 20 -inch pipeline to the franchise. This brought
Chemoil's total pipeline footage in Carson to 10,087.
F. Pursuant to Carson Municipal Code Section 6827, a franchisee may not install or

H. The City Council has considered the request to amend the franchise and has
determined that adding seven feet of 20 -inch pipeline to correct an error to Chemoil Terminals
Corporation franchise is in the public interest.

Section 2. Consent. The City Council consents to an amendment adding seven (7) feet
of 20 -inch pipeline and authorizing the abandonment of 72 feet of 20 -inch pipeline to the
franchise. Except for the aforementioned changes, the provisions of the Chemoil Terminals
Corporation franchise shall continue in full force and effect.
Section 3. Location of Pipelines. The City Council finds that the public interest
would be served by allowing the installation and operation of pipelines and appurtenant facilities
limited to those certain streets, highways, roads, alleys and other public places dedicated to
public use shown on the map attached hereto as Exhibit "'A" attached hereto. Exhibit "A" is
incorporated herein by reference.
Section 4. Footage of Pipelines. The City Council finds that the public interest would
be served by allowing the installation and operation of additional pipelines and appurtenant
facilities for the Chemoil franchise, as described in Exhibit "A".
Section 5. Approval of Installation and Operation. The installation and operation of
pipelines as nonpublic utility pipelines is approved within the limitations stated in Sections 3 and
4, above. The pipelines authorized herein are in addition to the pipelines and appurtenant
facilities authorized by Ordinance No. 04-1323.
Section 6. Pipeline Acquisitions; Previous Franchises Amended or Repealed. The
City Council previously adopted Resolution No. 04-121 delineating the locations of pipelines
and facilities to be installed and operated under the Chemoil Refining Corporation's franchise.
Section 3 entitled "Footage of Pipelines" of Resolution No. 04-121 is hereby amended to read, in
its entirety, as follows:
"Section 3. Footage of Pipelines. The City Council finds that the public
interest would be served by allowing the installation and operation of pipelines
and appurtenant facilities limited to the following sizes and lengths:

Furthermore, the franchisee shall be responsible for and pay any arrears in franchise fees owed
to the City by the acquisition of the pipelines from the date of acquisition to the present.

Section 7. CEQA. The pipelines which are the subject of the Chemoil Terminals
Corporation franchise are owned and operated by franchisee and its predecessor under Ordinance
No. 04-1323. The franchisee will continue use of the pipelines as previously approved, and
therefore, this franchise amendment is exempt from the requirements of California
Environmental Quality Act (CEQA) as a Class I Categorical Exemption, Existing Facilities,
pursuant to Section 15' ) 0 1 of the CEQA Guidelines.

CONSIDERATION OF RESOLUTION NO. 15-046 AMENDING THE NONPUBLIC
UTILITY PIPELINE FRANCHISE WITH CHEMOIL TERMINALS CORPORATION
1. SUMMARY
On December 21, 2004, the Council adopted Ordinance No. 04-1323, granting to
Chemoil Terminals Corporation (formerly Chemoil Refining Corporation), a 25 -year
nonpublic utility pipeline franchise. In 2014, Chemoil removed 72 feet of 4 -inch
pipeline without the 'approval of the City Council, as required by the Carson
Municipal Code Secfion 6852. All permits were pulled, as required. A pipeline audit
conducted by Chemoil under estimated the length of 20 -inch pipeline by seven feet.
The Resolution before Council would authorize the abandonment of 72 -foot of 4 -
inch pipeline and adding seven foot of 20 -inch pipeline to the franchise to correct an
error.
11. RECOMMENDATION
WAIVE further reading and ADOPT Resolution No. 15-046, "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, DELINEATING
CERTAIN LOCATIONS FOR THE OPERATION OF PIPELINES OR OTHER
FACILITIES, AND AMENDING A NONPUBLIC UTILITY PIPELINE FRANCHISE
GRANTED TO CHEMOIL TERMINALS CORPORATION."

IV. BACKGROUND
On November 3, 2004, the Council adopted Resolution No. 04-120, declaring its

intention to grant a pipeline franchise to Chemoil Refining Corporation (Exhibit No.
2).
On December 8, 2004, the Council adopted Resolution No. 04-121, delineating
certain locations for the installation and operation of pipelines or other facilities in
connection with a nonpublic utility pipeline franchise granted to Chemoil Refining
Corporation (Exhibit No. 3).
On December 21, 2004, the Council adopted Ordinance No. 04-1323, granting to

connections necessary or convenient for the operation of such pipelines including
conduits, cathodic protection devices, wires, cables and, other appurtenances
necessary or convenient for the exercise of Franchisee's business, on, along, in,
under and across any and all designated streets, ways, alleys and places within the
City of'Carson (Exhibit No. 4).
On April 5, 2005, the Council adopted Resolution No. 05-037, consenting to the
assignment of the nonpublic utility pipeline franchise from Chemoil Refining
Corporation to Chemoil Terminals Corporation (Exhibit No. 5).
On December 4, 2012, the Council adopted Resolution No. 12-133, consenting to
an amendment to the franchise adding 204 feet of 20 -inch pipeline (Exhibit No. 6).
On April 9, 2015, Chemoil Terminals Corporation filed for an amendment to the
pipeline franchise requesting to abandon 72 feet of 4 -inch pipeline and add seven
feet of 20 -inch pipeline.
If adopted, the total pipeline footage authorized under this franchisee would be as
follows: 173 foot of 6 -inch line, 8,251 foot of 8 -inch line, 1,287 foot of 10 -inch line,
211 feet ' of 20 -inch line, 100 foot of 30 -inch line, and a reduction of 72 -foot of 4 -inch
line. The total footage of pipelines authorized would be 10,022.
V. FISCAL IMPACT
Chemoil paid the application fee to amend the franchise in the amount of $1,080.00.
The increase in franchise fees from the two minor changes would be less than
$25.00 annually.
