HomeMy Public PortalAbout15-1552ORDINANCE NO. 15-1552 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ADDING SECTION 4212 TO ARTICLE IV, CHAPTER 2 OF THE CARSON MUNICIPAL CODE TO ALLOW LIMITED ALCOHOLIC BEVERAGE USE AT CITY EVENTS IN CITY PARKS. WHEREAS, Carson Municipal Code Article IV, Chapter 2 regulates the consumption of alcohol in and around public spaces such as public sidewalks, public streets, public parks and public buildings; and WHEREAS, under Sections 4200.5 and 4209, no person shall drink any alcoholic beverage upon any public street, alleyway, sidewalk, parkway, public building, lavatories, auto park, lobby or any public park, parking lot of public park or building of any public park; and WHEREAS the City Council desires to allow limited alcoholic beverage use at City events taking place in City parks under certain conditions; and WHEREAS to accomplish the aforementioned action, the City Council must amend Article IV, Chapter 2 of the Carson Municipal Code to add Section 4212. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The foregoing Recitals are declared as true and correct and adopted into the terms of this Ordinance by this reference. Section 2. Section 4212 is hereby added to Article 11, Chapter 7 of the Carson Municipal Code section as follows: "4212 Limited Alcoholic Beverage Use On Public Property—Special Permit Notwithstanding the other prohibitions of this chapter, the Council may grant special permits for the sale or consumption of wine or beer at special functions or activities in public parks in the City of Carson and only at City of Carson functions or activities. Any such permit with the sale of beer or wine shall be given to City -authorized vendors and such vendors shall be subject to the license requirements of the Alcoholic Beverage Control Act of the State. 01007.0001/243706.101007/0001/226739.1 Section 3. The City Council hereby finds that it can be seen with certainty that there is no possibility the adoption and implementation of this Ordinance may have a significant effect on the environment. The Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act pursuant to Section 1506 1 (b) (3) of Title 14 of the California Code of Regulations. Section 4. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this section, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this section, or its application to any other person or circumstance. The City Council declares that it would have adopted each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable. Section 5. The City Clerk shall cause this ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage, in accordance with Section 36933 of the Government Code, and shall certify to the adoption of this ordinance. Section 6. This Ordinance shall be in full force and effect thirty (30) days after its second reading and adoption.
