HomeMy Public PortalAboutMIN-CC-2004-05-11MOAB CITY COUNCIL REGULAR MEETING May 11, 2004 The Moab City Council held their Regular Meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and Councilmember Gregg Stucki led in the Pledge of Allegiance. Also in attendance were Councilmembers Keith Brewer, Kyle Bailey, Rob Sweeten and Jeff Davis; City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison, Public Works Director Brent Williams, City Attorney Chris McAnany, Police Chief Mike Navarre and City Planner Robert Hugie. Sixteen (16) members of the audience and media were present. There were no minutes to be approved. There were no Citizens to be Heard. Under Planning Update, City Planner Hugie stated that he had submitted a memo on the re -zone request and that there would be a meeting at the District with the United States Geological Survey to discuss the valley aquifer at 2:00 PM and at 4:00 PM with the Grand County Council. Under Public Works Department, Public Works Director Williams stated that the Walker Canyon Dam Project had been started and asked that the public stay away from the trenches. A Police Department Update was not given. Mayor Sakrison Proclaimed May 2004 as Mental Health Month. Mayor Sakrison Presented the Mayor's Student Citizenship of the Month Award for Helen M. Knight Intermediate School to Patrick Andrews. Councilmember Sweeten moved to move the agenda to a Request to Send Proposed Resolution #11-2004 — A Resolution Adopting the Fiscal Year 2004-2005 Budget to Public Hearing. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. The motion carried 5-0 aye. Councilmember Sweeten moved to Send the Moab Transportation Plan to Public Hearing. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to Award of the Skakel Pump Station Bid to Hills Construction in the amount of $294,665.00. Councilmember Brewer seconded the motion. The motion carried 5-0 by a roll -call -vote. Councilmember Sweeten moved to approve the Standard City Construction Contract. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to approve Use of Swanny City Park by Dick Pacheco to Conduct a Public Concert on July 24, 2004. Councilmember Davis seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a Permanent Class II Beer License for Martin Rangel, d.b.a. Fiesta Mexicana #10 Located at 202 South Main Street. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. There was no Correspondence to be read. Under Administrative Reports, City Manager Metzler stated that the City Center Project interviews would take place this Friday, that she would be preparing the budget press release soon and would have the carryover adjustments for the public hearing. Under Goal Update, Councilmember Sweeten stated that he had attended the Council on Aging meeting and that there was nothing new. Councilmember Sweeten also stated that there was a potential to use the Ballard fruit trees at the MAPS project location. Under Report on City/County Cooperation, Mayor Sakrison stated that there would be a joint lunch with the Grand County Council on Wednesday, May 12, 2004. Under Mayor and Council Reports, Mayor Sakrison stated that he had a letter Sam Sturnman form Utah State University, that Dr. Kip Solomon would be at the Grand County Council Workshop on Wednesday at 4:00 PM and that Will Walker of the National Guard thanked everyone for their support of the troops. Councilmember Brewer asked for an Animal Shelter update and requested that the project be pushed as much as possible. City Manager Metzler responded that she recommended starting the project after the $150,000 had been raised. Mayor Sakrison opened a public hearing on a Zone Change Request Located at Approximately 1339 East Powerhouse Lane by Dave Barry at 7:30 PM. City Planner Hugie stated that the Moab City Planning Commission had voted against the re -zone request on March 25, 2004. Dave Barry read a letter of rebuttal regarding the Moab City Planning Commission's denial of the zone change request. Mr. Barry then distributed the letter. Mr. Barry then read a chronology of the rezone process to date. Katherine Corson stated that she lives in the Powerhouse Lane trailer park and that she had attended the Moab City Planning Commission meeting when the re -zone request had been requested. Ms. Corson stated that the rules for governing the process are for the general welfare of the public and that Mr. Barry thinks that the rules don't apply. Andrew Riley asked if this was a public hearing on a rezone request, but as he understands it Mr. Barry does not want a rezone. City Planner Hugie stated that the rezone application was filed by the applicant under protest. Mayor Sakrison closed the Public Hearing at 7:42 PM. Councilmember Brewer moved to pay the bills against the City of Moab in the amount of $392,895.13. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Sweeten moved to Enter an Executive Session for the purpose of a Strategy Session to Discuss Pending or Reasonably Imminent Litigation. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. An Executive Session was entered at 7:45 PM. Councilmember Bailey moved to close the Executive Session. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. The Executive Session was closed at 9:07 PM. Mayor Sakrison adjourned the Regular Council Meeting at 9:07 PM. APPROVED: ATTEST: David L.
