RESCINDING RESOLUTION 82-129 AND AUTHORIZING AN AGREEMENT, APPROVING
A PERFORMANCE GUARANTEE AND APPROVING WATER AND SEWER EXTENSIONS FOR
SOUTHGATE II DEVELOPMENT
WHEREAS, Resolution 82-129 authorized a contract for public improvements, ap-
proved performance bond and approved extension of municipal water and sewer facili-
ties for the Southgate II development, and
WHEREAS, the developer was not able to secure the specific performance bond
outlined in Resolution 82-129, and
WHEREAS, a new contract for public improvements and water and sewer extension
permits dated March 23, 1983 have been received by the town and a letter of credit,
which form has been approved by the town attorney, is being forwarded to the town to
guarantee installation of the public improvements for the development.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. Resolution 82-129 is hereby rescinded.
SECTION II. The manager shall execute the contract for
public improvements for the Southgate II development dated March 23, 1983, which con-
tract has been altered to require installation of the public improvements within a
one year period.
SECTION III. The First and Merchants National Bank irrevocable letter of credit
in the amount of $60,190.00 guaranteeing installation of public improvements in ac-
cordance with plans approved by the Director of Engineering for the Southgate II de-
velopment is approved.
SECTION IV. Extension of municipal water and sewer facilities is approved for
this development.

SECTION V. This resolution is in effect upon approval of the contract, letter
of credit and extension permits by the town attorney.
