Approval was given of Level 3 Architectural /Site Plan Review for the gazebo, stairway enclosure, driveway surface change, dock, deck, Florida room, and wall that is reduced to 5 feet based on the plans and documents submitted with the following conditions: 1) lighting for the deck shall be wall - mounted provided, however,that security lighting independent of the deck may be used along the west side of the house; and 2) the wall not only be 5 foot or less in height but also comply with all other design requirements of the Design Manual. If a building permit incorporating the aforementioned improvements is not obtained and construction commenced by July 19, 1997 the special exception and site plan approval shall expire. Nicholl - 544 Banyan Road Site Development Regulations IV -10 , 3 b ` Additions to structures with existing non - conforming setbacks The extension of the existing west stoop to a patio area has no adverse effect to the site plan, it is in line with the existing west wall of the house and added to an existing rear stoop area which already has a door out to it. The additional deck area can not be viewed from the street and is protected from the west by planting and hedge material. The deck addition does not change the architectural elements of the house. The applicant, Ronald H. Miller, architect, as agent for Ramon Nicholl, is seeking approval to construct two small additions, a gazebo, a deck, a dock, a privacy wall and to change the driveway surface on a parcel of property described as Lot 6 of the Polo Cove subdivision. The nature of the request requires a Board recommendation to the Town Commission for a Special Exception and a Level 3 Architectural /Site Plan Review. No other Board actions are required. Project Description The proposed additions include the enclosure of the existing stairway leading to the second floor area over the garage and the replacement of most of the existing screen enclosure on the rear with an enclosed Florida room. Further, a portion of the existing covered entry will be enclosed, and all of the existing awning windows are to be replaced with new casement windows or multi - paned, fixed windows. The existing home has 2,761 square feet of living area, and a total floor area under roof of 4,299 square feet. The proposed improvements include removing 344 square feet of screen enclosure and adding 863 square feet of living area. The net result will be 3,624 square feet of living area and 4,583 square feet of floor area under roof. The property has an Effective Lot Area of 16,000 square feet. Under the Sliding Scale FAR, the maximum permissible floor area is 5,280 square feet, or 697 square feet more than what is proposed. The proposed architectural style of the home is best described as Gulf Stream - Bermuda. According to the applicant, the wall will provide a focal point to the pool area and provide additional screening from the east. Proposed bougainvillea plantings on the east side of the wall, in addition to the existing property line hedging, are intended to screen views of the wall from the neighbor to the east. The proposed deck will be located on the west side of the house where it will replace and extend an existing concrete stoop. The existing west wall of the house does not meet the current minimum side setback requirements. Because the applicant wishes line up the deck with the existing west wall line, approval of a Special Exception is required. The site plan provided by the applicant shows some of the existing and proposed landscaping. In addition, the applicant has provided several pictures of the existing landscaping in the area of the proposed improvements. These pictures are available for inspection in the Town Clerk's office and will be presented at the hearing. Special Exception There are two sets of standards that apply to the requested Special Exception setback. The first set of standards is contained in Article IV, Section 1.3. of the Design Manual (pg. IV-10). These standards are specific to the requested setback. The second set of standards is contained in Chapter 66, Article V.3., section 66 -164 of the Zoning Code. These eg neral standards apply to all Special Exceptions. As discussed, the applicant wishes to construct a small, wooden deck that would match the existing west wall line. The existing wall extends approximately 4.67 feet into the required 15 foot minimum side setback, thus requiring approval of a Special Exception to match this wall line. Architectural Review and Planning Board ARPB File #96 -07 June 12, 1996 Page 3 According to the applicant, the location for the deck was selected as there is an existing door in this location leading to a small concrete stoop. The applicant wishes to enlarge the doorway and provide a small sitting area on the deck. Although the applicant could reduce the width of the deck to comply with the required setback, he contends that matching the existing wall line results in a more functional and attractive design. Further, the applicant states that any impacts associated with the deck will be mitigated by the extensive, existing landscaping along the west property line. Specific Standards The applicant has attached an additional sheet to the application form which addresses each of the specific standards found in the Design Manual. Based on the information submitted by the applicant, staff finds the deck to be consistent with all of these standards, with the condition that all lighting provided for the deck shall be wall- mounted. However, security lighting independent of the deck may be used along the west side of the house. General Standards The applicant also has addressed all of the Special Exception standards found in the Zoning Code in his responses to Part IVF. of the application form. Based on the information submitted by the applicant, staff finds the project to be consistent with all of these standards with the same condition. Level 3 Architectural /Site Plan Review Chapter 66, Article V.1. of the Zoning Code enumerates the 12 standards applicable to applications for a Level 3 Architectural /Site Plan Review. These standards include consistency with all applicable sections of the Gulf Stream Design Manual. Please note that the standards found in Article VII, Predominate Styles, of the Design Manual also are applicable as the applicant's home has a Gulf Stream - Bermuda design. Based on the materials submitted by the applicant, staff finds the gazebo, deck, stair enclosure and driveway surface change, with the condition described above, to be consistent with all applicable standards. This finding includes all applicable portions of the Gulf Stream Design Manual as well. Regarding the proposed Florida room addition, staff finds the proposed design to be minimally consistent with the applicable review requirements. While staff finds the proposed roof design to be an excellent match to the existing home, the proposed glass doors, side lights and transoms diverge from what is otherwise a classic Gulf Stream - Bermuda design. Although some light dividers are proposed in these glass areas, they create much larger panes of glass than those typically associated with the Gulf Stream- Architectural Review and Planning Board ARPB File #96 -07 June 12, 1996 Page 4 Bermuda style. Staff suggests the applicant and Board consider additional light dividers /muntins for these glass areas. The proposed wall cannot be approved as drawn. The Design Manual prohibits walls higher than 5 feet from extending into the 20 foot minimum minor accessory setback along waterways. With the trellis, the proposed wall reaches a total height of nearly 8 feet and is less than 10 feet from the waterway. Staff did not discover this conflict until this report was nearly complete. Staff will notify the applicant and ask that an amended design be brought to the hearing. In the event the applicant does not wish to change the wall, he would have to apply for a Variance and the matter continued to another hearing. Recommendation Motion to recommend approval of a Special Exception for the deck to match an existing non - conforming wall line and thereby reduce the minimum west side setback of the deck by 4.67 feet from 15 to 10.33 feet, based on a finding that the building and site plans submitted by the applicant meet all applicable specific and general Special Exception review standards, with the condition that all lighting for the deck shall be wall- mounted provided, however, that security lighting independent of the deck may be used along the west side of the house. 2. A. Motion to recommend approval of a Level 3 Architectural /Site Plan Review for the gazebo, stair enclosure, dock and driveway surface change based on a finding that the building and site plans submitted by the applicant, as proposed, meet all applicable review standards. B. Motion to recommend approval of a Level 3 Architectural /Site Plan Review for the deck based on a finding that the building and site plans submitted by the applicant meet all applicable review standards, with the condition that all lighting for the deck shall be wall- mounted provided, however, that motion - sensitive security lighting independent of the deck may be used along the west side of the house. C. Motion to recommend approval of a Level 3 Architectural /Site Plan Review for the Florida room addition based on a finding that the building and site plans submitted by the applicant are minimally consistent with all applicable review standards; however, staff recommends the applicant and Board consider the inclusion of additional light dividers /muntins in the proposed glass doors, side lights and transoms at the rear of the home. D.
