A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY, FINDING AND
DETERMINING THAT THE PUBLIC INTEREST,
CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN RIGHTS -OF -WAY
FOR PUBLIC STREET PURPOSES AND ALL USES
APPURTENANT THERETO (BALDWIN AVENUE
PROJECT).
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of
Temple City does hereby find, determine and declare that
the public interest, convenience and necessity require
the acquisition by said City of certain rights -of -way
over certain herein described real property for public
street purposes and all uses appurtenant thereto.
That the location of said rights -of -way have been
planned and located in a manner which will be most
compatible with the greatest public good and the least
private injury.
SECTION 2. That it is the intention of said City
Council to acquire in its name the rights -of -way in, over,
under, along and across said hereinafter described real
property, by a proceeding in condemnation, in accordance
with the provisions of the Code of Civil Procedure of the
State of California,
SECTION 3. That the said rights -of -way, as herein -
above referred to, the acquisition of which is required
by said public interest, convenience and necessity, for
the purpose as set forth in SECTION 1 hereof, are located
in the City of Temple City, County of Los Angeles, State
of California, and are more particularly described on that
certain document attached hereto, marked Exhibit "A ", and
incorporated herein by this reference.
SECTION 4. That the City Attorney of the City of
Temple City, and designated Special Counsel, are hereby
authorized and directed to prepare, institute and prosecute
in the name of said City such proceedings in the proper
Court having jurisdiction thereof as may be necessary for
the acquisition of said rights -of -way in, over, under,
along and across said real property as described in
SECTION 3 hereof, and to obtain the necessary Order of
Court granting to said City the right of immediate
occupancy and possession of said rights -of -way.
SECTION 5. That the City Clerk shall certify to
the adoption of this Resolution.
