HomeMy Public PortalAbout15-1566ORDINANCE NO. 15-1566 AN ORDINANCE OF THE CITY OF CARSON, CALIFORNIA, ADDING SECTION 8109 TO ARTICLE VIII, CHAPTER 1, OF THE CARSON MUNICIPAL CODE, ADOPTING BY REFERENCE CHAPTER 68 OF TITLE 26 OF THE LOS ANGELES COUNTY CODE AND AMENDMENTS THERETO, ESTABLISHING EXPEDITED PERMITTING FOR SMALL RESIDENTIAL ROOFTOP SOLAR ENERGY SYSTEMS WHEREAS, California Assembly Bill No. 2188, which amended Section 714 of the California Civil Code and Section 65850.5 of the California Government Code, requires local government agencies to amend their building codes to include expedited permitting procedures for small residential rooftop solar energy systems; and WHEREAS, the City of Carson has adopted by reference the County of Los Angeles Building Code; and WHEREAS, in 2013, the Board of Supervisors of the County of Los Angeles adopted by reference the 2013 California Building Code and incorporated said adoption into Title 26 of the Building Code of the Los Angeles County Code; and WHEREAS, on September 1, 2015, the Board of Supervisors of the County of Los Angeles amended Title 26 of the Building Code by adding Chapter 68, Expedited Permitting for Small Residential Rooftop Solar Energy Systems, in compliance with the requirements of California Assembly Bill 2188. NOW, THEREFORE, the CITY of CARSON, CALIFORNIA, does hereby ordain as follows: SECTION 1. The forgoing recitals are true and correct and incorporated herein by this reference. SECTION 2. Section 8109 is hereby added to adopt by reference the Building Code of the Los Angeles County Code, and amendments therein as follows: Section § 8109 "Notwithstanding the provisions of CMC 8 100, Chapter 68 (Expedited Permitting For Small Residential Rooftop Solar Energy Systems) of Title 26 of the Building Code of the Los Angeles County Code enacted on September 1, 2015 is hereby adopted in its entirety by reference and expressly incorporated herein. Title 26 of the Los Angeles County Code is hereby made a part of this Chapter I as if, for all intents and purposes, fully set forth in this Chapter. This adoption by reference shall include any subsequent amendments to Title 26 unless modified in this Chapter I." Erj� ORDINANCE NO. 15-1566 PAGE 2 OF 3 SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Carson hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions thereof may be declared invalid or unconstitutional. SECTION 4. This Ordinance shall be in full force and effect thirty (30) days after its second reading and adoption. SECTION 5. The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council of the city of Carson and shall cause a summary of this ordinance to be published in accordance with Government Code § 36933.
