I5-136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ADOPTING THE ANNUAL APPROPRIATIONS LIMIT FOR FISCAL YEAR 2015116 WHEREAS, in November 1979, the voters of California adopted Proposition d ("Gann, Amendment"), which added Article XIII B to the California Constitution; and WHEREAS, Section 7900 of the Govermnent Code provides for the effect and efficient implementation of Article XIII B of the California Constitution. and WHEREAS, pursuant to Section 7910 of the Government Code, each local government must establish its appropriations limit each gear pursuant to Article XIII B of the California Constitution ("Gann Limits"); and WHEREAS, in 1990, California voters adopted Proposition 111, which amended Article XIII B of the California Constitution; and WHEREAS, Proposition I 1 I requires the City of Carson to select annually, by a recorded vote of the City Council of the City of Carson the growth factors to use in calculating the annual appropriations limit; and WHEREAS, Article XIII B of the California Constitution provides that the appropriations limit for FY 2015116 be calculated by adjusting the appropriations limit for FY 2014/15 by change in the increase in California Per Capital Income (PCI) and the change in population; and WHEREAS, the appropriations limit for FY 2015/16 has been calculated by the Finance Department of the City of Carson; and WHEREAS, the City of Carson has complied with all the provisions of Article XIII B in determining the appropriations limit for FY 2015/16. NOW, THEREFORE, the City Council of the City of Carson. California, does hereby find, determine, order and resolve as follows: Section 1. The appropriations limit for FY 2015116, as is hereby set at $192,087,129.00 in accordance with the provisions in Article XIII B of the California Constitution. attached hereto and made a part thereof. Section 2. The City Clerk shall certify to the adoption of this resolution and shall maintain said resolution with Attachment 1, attached hereto and made a part thereof, in the City Clerk's office for public inspection. SUMMARY Each year the City is required by Article XIII B of the California Constitution, known as the Gann Limit that sets the maximum amount of appropriations tax receipts. Taxes exceeding this limit must be retuned o'rs dent that may be pentfwi with the approval of a majority vote. The City's Annual Appropriations Limit for Fiscal Year 2015/16 is $192,087,129.00. If. RECOMMENDATION WAIVE further reading and ADOPT Resolution No. 15-136, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, ADOPTING THE ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2015/16." III. ALTERNATIVES None, California law requires that cities adopt an annual appropriations limit. IV. BACKGROUND Pursuant to Article XIII B of the California Constitution ("Gann Limit""), the City is required to compute an Annual Appropriations Limit. The appropriations limit, originally imposed by Proposition 4, creates a restriction on the amount of revenue that can be appropriated in any fiscal year. Percentage change in population in the County of Los Angeles, and 2. Percentage change in Per Capita Income (PCI). Vasquez and Company LLP, the City's auditor has reviewed and approved the annual appropriations limit for FY 2015/16 as part of their Agreed Upon Procedures. The calculation will be submitted to the auditor for an opinion and will become part of the FY 2015/16 audit process. The FY 2015/16 Annual Appropriations Limit is $192,087,129. The City's estimated revenue for FY 2015/16 is well below the Annual Appropriations Limit. The Annual Appropriations Limit is available to the public at the City Clerk's office and has been posted on the City's website.
