AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE CITY
COUNSELOR TO ACQUIRE CERTAIN PROPERTY BY PURCHASE OR CONDEMNATION.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Council does hereby find, determine, and declare it a public necessity to
acquire a permanent sanitary sewer easement for a sanitary sewer line together with all
appurtenances thereunto belonging along, over, under, upon, across and through certain
property owned by the GST Exempt Share FBO Jerry J. Peeper under Article V of the Selma C.
Peeper Revocable Trust No. 1, Dated December 31, 1992, and GST Exempt Share FBO
Christy A. Huntinger under Article V of the Selma C. Peeper Revocable Trust No. 1, Dated
December 31, 1992, described more particularly in Exhibit A, which is attached hereto and by
this reference incorporated herein as if more fully and completely set out. The purpose of
acquiring such easement is for the sanitary sewer upgrade project commonly known as the
Basin 12 Relief Sewer.
Section 2. The City Council does hereby authorize the City Counselor to acquire said
easement by purchase or condemnation, including the authorization to file a petition for
condemnation and to pursue such condemnation. The price to be paid in the event of purchase
is not to exceed the appraised value of the property by more than fifteen percent. In the event of
condemnation, the price to be paid shall be as set forth by the Court.
Section 3. This Ordinance shall be in full force and effect from and after the date of its
passage and approval. 2

SANITARY SEWER EASE!VIENT
A permanent easement across Grantor's Land as described in Book 525, page 82, Cole County Recorder's Office, said
permanent easement being all that part of said Grantor's Land that lies within a 30 foot wide strip ofland as it crosses
through the Northwest Quarter of Section 35, Township 45 North, Range 12 West and in the City of Jefferson, Cole
County, Missouri and said permanent easement shall lie equally each side of and adjacent to a centerline being more
particularly described as follows:
From northwest comer of Lot 39 of Belmont Estates, as per plat of record in Plat Book 6, page 95, Cole County
Recorder's Office; thence 833°49'30"\V, on a direct line 106.09 feet to sewer plan PI Sta. 66+96.81, at ·coordinates
Nl00883l.ll and El722053.57; thence S83°45'44"E, 139.21 feet to the POINT OF BEGINNING for this centerline
description at sewer plan PI Sta. 68+36.03 at coordinates Nl008815.98 and El722191.96; thence S41 °33'37"E, 7.17
feet to a point on the easterly boundary of Lot 38 of said Belmont Estates, being a point on the westerly boundary ofthe
aforesaid Grantor's Land as described in Book 525, page 82; thence continuing S41 °33'37"E, 225.31 feet to sewer plan
PI Sta. 70+68.51 at coordinates N1008642.03 and El722346.!9; thence Sll 0 21'43"E, 209.16 feet to sewer plan PI Sta.
72+77.67 at coordinates N1008436.97 and El722387.40; thence S48°03'40"E, 180.80 feet to a point on the southerly
boundary of said Grantor's Land, being the northwesterly boundary of Edgewood Addition as per plat of record in Plat
Book 5, page 86, Cole County Recorder's Office, said point being 48.23 feet northeasterly, along said Edgewood
Addition, from the most westerly comer of Lot 14 of Block One, ther~of; thence continuing S48°03'40"E, 162.56 feet
to the POINT OF TERMINATION for this centerline at sewer plan PI Sta. 76+21.03 at coor(iinates Nl 008207.48 and
El722642.81.
ALSO, a temporary construction easement, being an additional 20 feet in width, lying easterly of, along and adjacent to
the entire length of the above described permanent easement, beginning at the northerly boundary of the aforesaid Grantor's
Land as described in Book 525, page 82, Cole County Recorder's Office and running southeasterly with the easterly
boundary of said permanent easement to its tennination on Grantor's sOutheasterly boundary; being the northwesterly
boundary of said Edgewood Addition as per plat of record in Plat Book 5, page 86, Cole County Recorder's Office.
The aforesaid temporary construction easement is provided for the initial coristruction of a sanitary sewer line within the
boundaries of the above described permanent easement and said temporary ea.~ements shall cease and tenninate upon
completion of said initial construction.
Coordinate are based on Missouri State Plane System (Central Zone, NAD'83).
The sidelines of the above described easement(s) to be shortened and/or elongated to the property boundary
lines.
