Board present were Havens, Win;ing, Swatzell, Johnston and Olson. Also present Reid, Skelton and Winter. Minutes of the previous meeting were approved as written. Reid reviewed the hearing process for the annexation and zoning requested hy Maryvale LLC. The town will need to replace an employee in the street department. Reid has meetings scheduled with Maryvale and the TO\vn of Winter Park to discuss the roads etc. Finnegans on the Rivcr liquor Liccnse renewal with cxtcnded hours. Clerk repOt1ed that all fees paid and documents in order. The Sheritls comments have not been received yet. Havens made a motion to approve renewal of the liquor liccnse for Finnegans on the River pending a favorable rep0l1 from the SherifT.c; Dept., 2nd Swatzell, carried. Board discussed that parking of large vehicles on Highway 40 at the post office is causing a hazard. The gathering is scheduled for 7:00 p,m_ and pizza will be served. Some items of potential discussion: the Moffat Tunnel Commission, "takings" issues, and "smart growth." It should be an lnteresting discussion, As the ^{an~fesf reported, the Sheriffs Department did find the persons responsible for the bomb threat notes at the Visitors' Center. The Sheriff did not feel that this case needed to be turned over to the D.A.'s office due to the age of the kids -- 11 & 13 -- and after a brief conversation with their dad, I'm inclined to agree. Enclosed is a copy of a letter sent to the Sheriff regarding their response to this incident. It's not a fun letter, but I felt we needed to record our feelings. Enclosed are two new items to lnclude in your "Grants" requests in the 1996 budget: a request from the Cemetery Association with appropriate groveling and "kissing-up" from the author (a close personal friend of most of the Board in general and one in particular), and additional information from the Library Committee about their building cost, budget, and etc., along with information regarding other Town's contributions to their library, New Items I'd like to kick-ofT the workshop on Wednesday night with a discussion of the goals and objectives that were included in the packet for the October 18th meeting. lfyou can't find your copy, we'll have,one for you Wednesday. We'll also set a public hearing Wednesday to consider proposed changes to the sign code, Catherine has been working closely with the business community to come up with regulations that address temporary signage, I think the outcome is good and, most importantly, continues a very good relationship with the business community. Thanks to all of you that have been involved with the drafting of this language. We'll also be discussing some issues surrounding the Mustang. The State Petroleum Storage Tank Committee will hopefully (hmmm) determine the issue we've been waiting for next Friday and J need some clarification from the Board on some issues regarding the potential purchase and I'll share some thoughts on a couple of things we could do with the property. Have a grand weekend. / "- '" ýÿ . ~ e e TOWN OF FRASER - FINAL DRAFT OF SIGN CODE AMENDMENTS New Section 13-8-] Purpose: The citizens of the Town of Fraser have expressed a desire to control the signage within the town limits. Thus, it is the intention of this sign code to define the types of signs which are permitted in various zoning districts, outline the allowable dimensions, denote prohibited signage, and discuss the exemption of certain types of signs from this code, all in the best interest of public health, safety and welfare. It is also the intent of this code to recognize the value of commercial signs as a necessary means of useful communication to maximize economic well-being for the business sector. The Fraser Sign Code encourages the construction of signs which are aesthetically pleasing and compatible with adjacent properties, and which protect, preserve, and enhance the character, beauty and charm of the Town, The sign code will be reviewed tri-annually, and revised as needed. TEMPORARY/SEASONAL SIGNAGE: Section ] 3-8-3 (1 a II I d) Banners: Banners are considered a form of tempoI'm}' signage used to advertise a special event, sale, grand opening, new product &/or service or other similar temporary messages. It is the intent that the use of banners will serve as a means to enhance the attractiveness and economic well-being of the Town of Fraser as a place to live, vacation and conduct business. The display of banners is allowed if permitted by district. The permit fee is thirty (30) dollars and shall be valid for one calendar year. Any business with a banner permit shall be entitled to display one banner at a time for not more than one hundred and forty (140) days per calendar year, only after notifying Town starr. Any business that fails to notify the Town staff shall be ineligible to display banners for the remainder of the ~ rJ i calendar year, and shall he issned a cilalion 10 mnnicil.al conrl. In addilio ~ ~~~ business which displays a banner abo\'e and b ( ay period will be ineligible to display banners for the emam of the calendar year, and shall be issued a citation to municipai court. Any business proprietor shall have the option of purchasing a banner permit concurrently \\lith the renewal of his/her business license. Permits shall be issued for the use of banners in locations which will not cause unreasonable annoyance or inconvenience to adjoining property owners and/or the public. Banners must be placed in such a manner that they will not be blown down, in whole or in part, and must be secured Droperlv and neatlv. Banners must be attached flat against the side of a building or fence. Suspended or freestanding banners are not allowed. Banners are not permitted on a vehicle. Banners must be removed immediately if damaged or in disrepair. Banners can not exceed fifty (50) square feet in area and must be professionally manufactured. The Fraser Town Board reserves the right to call any business before the Board regarding any specific banners that violate community standards and/or violate the overall intent of the Fraser sign code. --- c t. e e Section 13-8-3 (I a III b) Sandwich Board Sign, (also known as an "A-frame" sign): Sandwich boards are also considered a form of femporm)' signage used to advertise a business. It is the intent that the use of sandwich boards will serve as a means to enhance the attractiveness and economic well-being of the Town of Fraser as a place to live, vacation and conduct business. The erection of sandwich boards is allowed if permitted by the district. The permit fee is thirty (30) dollars and shall be valid for one calendar year. Any business with a sandwich board permit shall be entitled to erect one sandwich board at a time for not more than one hundred and forty (140) days per calendar year, only after notifying Town staff. Any business that fails to notify the Town staff shall be ineligible to erect a sandwich board for the remainder of the calendar year, and shall be issued a citation to municipal court. In addition, any business that erects a sandwich board above and beyond the 140 day perio shall be issued a citation to municilJal court. Any business proprietor shall have t ption of purchasing a sandwich board permit concurrently with ,~the renewal of . ler business license. A sketch of the proposed sandwich board shall . \;,1 accom the permit application and shall be reviewed for compatibility with the ~ Ifll rail intent of the Fraser sign code. Permits shall be issued for the use of sandwich ~\\\ boards in locations which will not cause unreasonable annoyance or inconvenience to · f adjoining property owners and/or the public. During the winter months, the location of · each sandwich board must not interfere with snow removal. All businesses shall remove the erected sandwich board at the end of each business day, Sandwich boards must be removed immediately if damaged or in disrepair. Sandwich boards can not exceed sixteen (16) square feet in area per side. The Fraser Town Board reserves the right to call any business before the Board regarding any specific sandwich board that violates community standards and/or violates the overall intent of the Fraser sign code New Section 13-8-3 (I a IV ) New Businesses: In an effort to promote new business ventures in the Town of Fraser, the Town Board may grant variances to the sign code regarding temporary signage for a two year period, This two year period will commence on the opening day of business. Anyone interested in obtaining a sign code variance shall make a written request to the Board of Trustees. The request must be submitted seven days prior to the next regularly scheduled Board meeting. The Board shall review the variance and make a decision to either grant or deny the request. The decision by the Board of Trustees shall be final. ~ .. e e Section 13-8-.10 NonConforming Signs: (I) Any sign located within the boundaries of the Town of Fraser on the date of adoption of this ordinance, or located in an area annexed to the Town thereafter, which does not conform with the provisions of this Article 13-8 but which was in compliance with applicable law on the date of adoption of this ordinance or the date of annexation, whichever is applicable, shall qualify as a "legal nonconforming sign." Except as otherwise provided in Section 13-8-8 with respect to ofT premise signs, legal noncomfonning signs may be continued to be maintained, provided that such signs are kept in good repair and so long as such signs are not relocated, replaced, or structurally altered. Changing light bulbs, ballasts, or replacing/repainting the sign faces or repainting the sign frame that represents no change in the use of the facilitv OR overall size of the sign, shall not be considered "replaced or structurally altered," but shall be considered as "maintenance" as required to be performed by this Section 13-8-10 (1). If ownership of the property on which Stich legal nonconforming sign is located is transferred and results in a change in the business name OR use, the sign must be removed within thirty (30) days after the change of ownership. If any such legal nonconforming sign is relocated, replaced, or structurally altered, such sign must be made to comply with all provisions of the Article 13-8. ýÿ ----- . ; .,. e e ... Box 48 Hot Sulphur Springs, CO 80451 Dear Rod: I wanted to take a few moments and share some feelings and thoughts that I have about last week's incident in Fraser. As I stressed throughout the incident, I really believed that Fraser had to posture ourselves from the standpoint that the bomb threat was legitimate -- there are simply too many deranged people in Fraser, Grand County, and the world to take bomb threats lightly. Recent incidents in Oklahoma City, Hayden, Arizona, Nye County, Nevada, and Teller County, Colorado further caused me to consider this threat viable and act accordingly, I appreciate the time that Sergeant Piechocki, you and Officer Young took to scour the Visitors' Center on Wednesday, October 18th, and I greatly appreciate the additional time that Sergeant Piechocki took to analyze the registration forms and find the responsible parties. However, I do not believe that these steps would ever had been taken had I not pushed the issue with you and your Office. The original response from the SheriIT's Department did not meet Fraser's expectations-for good solid police work for the reasons identified below. . [ am disappointed that Officer Young did not take the time to investigate the Visitors' Center after the first note was found. . The time delay that occurred between finding the first note, and transmitting it to Investigations was inappropriate. / . During the Fraser Court session on Wednesday, October 18th, Officer Young made an omland and sarcastic comment about the "Fraser bomb threat" upon hearing from your office about transmitting the note to Hot Sulphur Springs as soon as possible: a comment that should not have been made during a public court session, nor made at all. -------- ýÿ . ' ,... ,e 'e .. Page Two Sheriff Rod Johnson . It is my belief that if your department does not have the technological know-how to deal with this type of incident, agencies such as CBI, ATF, and other Sheriffs Departments and Police Departments in the State are more than willing to provide technological and psychological profile assistance -- and that as a community, Fraser should not have any qualms about calling outside agencies for this assistance as soon as needed, and not simply at the urging of officials in Fraser, which is how I interpreted your call to ^ TF_ Rod, I am thankful that the notes were a hoax. And again, I appreciate the efforts you and Sergeant Piechocki took to further investigate the incident. I hope that we never need to deal \vith this type of situation again, but if we do and if Fraser faces more "serious" crime issues in the future, the Town will be looking to your department to respond in a more professional manner and with more sensitivity to truly serving and protecting the community.
