HomeMy Public PortalAbout1983_10_12_R159The Town of Leesburg in Virginia PRESENTED October 12~ 1983 RESOLUTION NO. 83-159 ADOPTED October 12~ 1983 A RESOLUTION: INITIATING AMENDMENT OF THE LEESBURG ZONING ORDINANCE TO REVISE SECTION 1-3(b), ANNEXATIONS WHEREAS, Section 1-3(b) of the Leesburg Zoning Ordinance provides for adoption and application of the Zoning Ordinance of Loudoun County to property which may be annexed or otherwise added to the incorporated area of the Town; and WHEREAS, the Zoning Ordinance of Loudoun County was adopted by reference and became effective on the date Section 1-3(b) of the Leesburg Zoning Ordinance was adopted (February 10, 1982); and WHEREAS, certain amendments to the Zoning Ordinance of Loudoun County have been adopted since February 10, 1982 that are desired for its proper application to property within the proposed area of annexation: RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. An amendment of the Leesburg Zoning Ordinance is initiated to amend Section 1-3(b) to read as follows: The Zoning Ordinace of Loudoun County, as effective on (insert date of , is made a part of this ordinance by reference as if adoption) fully ~et out herein to provide temporary zoning regulations applicable only to property which may be annexed or otherwise added to the incorporated area of the town pending the orderly amendment of the Leesburg Zoning Ordinance following such annexation or addition. Ail property annexed or otherwise added to the incorporated area of the town shall be automatically classified in the same zoning district as the property was classified under the Zoning Ordinance of Loudoun County as adopted herein and shall be governed by the provisions of the Zoning Ordinance of Loudoun County in- cluding any existing proffered conditions. Whenever reference is made to a particular officer, department, board, commission or other agency in the Zoning Ordinance of Loudoun County adopted herein, such reference shall be construed as referring to the comparable officer, department, board, commission or other agency of the town. Fees to be charged for applications for zoning permits, variances, special exceptions and interpretations of the zoning district map, appeals to the Board of Zoning Appeals and petitions -2- INITIATING A ZONING ORDINANCE AMENDMENT for amendment of the zoning map pertaining to all property annexed or otherwise added to the incorporated area of the town shall be as set out in the Leesburg Zoning Ordinance. SECTION II. A public hearing at which persons affected by the Zoning Ordinance amendment proposed above may appear and present their views shall be held beginning at 7:30 p.m., or as soon thereafter as the matter may be reached, November 9, 1983 in the Council Chambers, 10 West Loudoun Street, Leesburg, Vir- ginia. In line with Section 15.1-431 of the Code of Virginia, this hearing shall be a joint public hearing of both Planning Commission and Council. The clerk shall give notice of this hearing on October 20, 1983 and October 27, 1983 and advise the Planning Commission of the purpose, date and time of the hearing. SECTION III. The Planning Commission shall report its recommendations to the Town Council on the proposed amendment within 30 days of the public hearing.
