HomeMy Public PortalAboutMIN-CC-2004-09-28MOAB CITY COUNCIL REGULAR MEETING September 28, 2004 The Moab City Council held their Regular Meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor David Sakrison called the Pre -Council Workshop to order at 6:30 PM. Mayor David Sakrison called the Regular City Council Meeting to order at 7:00 PM and Eagle Scout Troop 803 led in the Pledge of Allegiance. Also in attendance were Councilmembers Kyle Bailey, Keith Brewer, Rob Sweeten, Jeff Davis and Gregg Stucki; City Manager Donna Metzler, Deputy Recorder Danielle Guerrero, Planning & Community Development Director David Olsen, Police Chief Mike Navarre and City Planner Robert Hugie. Thirty one (31) members of the audience and media were present. Councilmember Sweeten moved to approve the Regular Council Meeting minutes of August 10, 2004, with corrections. Councilmember Brewer seconded the motion. The motion carried 5-0 aye. There were no Citizens to be heard. Under Planning Department Update, Planning & Community Development Director Olsen introduced Eagle Scout Troop 803 and had each Scout show pictures and describe projects that they have been working on in the community. Planning & Community Development Director Olsen also stated that October 4th — 8tn is walk or bike to school week. A Public Works Department Update was not given. A Police Department Update was not given. Mayor Sakrison presented the Student Citizenship of the Month Award for Helen M. Knight Intermediate School to Garrison Call. Mayor Sakrison proclaimed October as Domestic Violence Awareness Month in the City of Moab. Mayor Sakrison proclaimed October 16, 2004 as Feral Cat Day in the City of Moab. Councilmember Bailey moved to approve a Special Business Event License for the Moab Fat Tire Festival to conduct a Festival for Mountain Biking on October 28 to 31, 2004 at Various Locations within Moab City. Councilmember Brewer seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Class IV Special Event Beer License for Wesley Shannon, d.b.a. Moab Fat Tire Festival to conduct a Festival for Mountain Biking on October 28 to 31, 2004 located at the Ramada Inn Parkway. Councilmember Davis seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a request for a Local Consent of a Temporary Special Event Beer Permit for the Moab Fat Tire Festival. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to approve a Request for Use of City Right-of-way at 89 North Main Street to Conduct a Sidewalk Sale on October 16 and 17, 2004. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to approve a Request for a Waiver of a Sign Permit Fee by the Humane Society of Moab Valley in the amount or $15.00. Councilmember Bailey seconded the motion. The motion carried by roll -call -vote 5-0 aye. Councilmember Bailey moved to Approve a Carport Side Setback Conditional Use Permit for Vesta Clements, Trustee and John W. & Vesta Clements Trust Located at 243 West Center Street. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to Approve the Proposed Utah Desert Investments Inc./William D. Petty Subdivision. Councilmember Brewer seconded the motion. The motion carried 4-1 with Councilmember Davis voting nay. Councilmember Sweeten moved to Approve an Improvements Agreement by and between the City or Moab and Brian Ballard. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to Approve the Proposed Mill Creek Cove Subdivision. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Under Reading of Correspondence, Mayor Sakrison stated that he had a sent a letter to Mike Leavitt inviting him to Moab for the presentation of the first Green Power City award on November 6, 2004. Mayor Sarkrison also stated that General Electric will be sending a blade from a windmill for being the first Green Power City. Mayor Sakrison also stated that Sarah Wright is in town and is soliciting businesses to sign up for Wind Power. Councilmember Stucki stated that he had a complaint that the Street Sweeper blows gravel onto the sidewalk by the Senior Citizen Center. Councilmember Stucki stated that he had also had complaints of pot holes on 100 North 300 East. Under Administrative Reports, City Manager Metzler stated that the Draft of the Solid Waste Contract Franchise Agreement should be completed tomorrow and negotiations will then start, the Agreement should be on the next agenda. City Manager Metzler also stated that she had been negotiating with the State Institutional Trust Lands Administration (SITLA) and that SITLA would like an agreement in place. City Manager Metzler stated that she was working on an Agreement with the Chamber of Commerce and that she would be getting numbers from the Architect for the improvement costs. City Manager Metzler also stated that Construction on the new City Center would begin late November or early December 2004. City Manager Metzler stated that the Pre -Annexation agreement for Moab Springs Ranch and been approved. PETTY SUBDIVISION APROVAL OF AN IMPROVEMENTS AGREEMENT BETWEEN THE CITY AND BRIAN BALLARD APPROVAL OF A PROPOSED MILL CREEK COVE SUBDIVISION READING OF CORRESPONDENCE ADMINISTRATIVE REPORTS been working with the Architect and the Humane Society on a larger alternate site across from the Recycling Center, however the site is zoned R-2 and would need to be re -zoned for the Animal Shelter. Under Mayor and Council Reports, Mayor Sakrison stated that the Chamber of Commerce was on board with the new City Center. Mayor Sakrison also stated that he and Councilmember Bailey had seen a presentation and were interested in a program designed for municipalities to distribute a news letter from all departments. Mayor Sakrison stated that Dan Jones had given a speech at the Utah League of Cities and Town annual Convention on doing surveys, Mayor Sakrison stated that this may be a good idea in Moab. Councilmember Brewer moved to Approve the bills against the City of Moab in the amount of $280,945.93. Councilmember Sweeten seconded the motion. The motion carried by roll -call -vote 5-0 aye. MAYOR AND COUNCIL REPORTS APPROVAL OF BILLS Mayor Sakrison adjourned the Regular Council Meeting at 8:38 PM.
