A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DETERMINING THAT THE VACATION OF THOSE PORTIONS OF
JOSEPHINE STREET AND LAVINIA AVENUE, BETWEEN ATLANTIC
AVENUE AND VIRGINIA AVENUE, AND THE VACATION OF A PORTION OF
THE FIRST ALLEY EAST OF ATLANTIC AVENUE, BETWEEN LAVINIA
AVENUE .AND A BOUNDARY LINE SOUTHERLY OF LAVINIA AVENUE AND
NORTHERLY OF CLARK STREET, ARE IN CONFORMANCE WITH THE
ADOPTED GENERAL PLAN OF THE CITY OF LYNWOOD AND ORDERING
THE VACATION OF THOSE PORTIONS OF JOSEPHINE STREET AND
LAVINIA AVENUE AND THAT PORTION OF THE FIRST ALLEY EAST OF
ATLANTIC AVENUE
WHEREAS, portions of Josephine Street and Lavinia Avenue, between
Atlantic Avenue to Virginia Avenue, and a portion of the first alley east of Atlantic
Avenue, .between Lavinia Avenue and a boundary line southerly of Lavinia
Avenue and northerly of Clark Street, need to be vacated for, the development of
the New John Ham Park; and
WHEREAS, on October 19, 2007, the City Council of the City of Lynwood
adopted a resolution declaring its intention to vacate the aforementioned portions
of streets and portion of alley; and
WHEREAS, notices of said vacation have been published and posted in
the time, form, and manner required by Section 8317 of the California Streets
and Highways Code; and
WHEREAS, public hearings concerning the vacation and abandonment of
the above-named streets and alley were held on November 20, 2007, December.
18, 2007 and January 2, 2007, as prescribed by Sections 8300 et seq. of the
California Streets and Highways Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lynwood as follows:
Section 1: That the City Council of the City of Lynwood determines that
the vacation of that portion of Josephine Street between Atlantic Avenue and
Virginia Avenue and more particularly described as:
"That portion of Josephine Street (formerly Santa Ana Avenue) right-of-way sixty (60)
feet wide bounded to the west by the easterly right-of--way of Atlantic Avenue and the
east by the westerly right-of-way of Virginia Avenue in the City of Lynwood, County of
Los Angeles, State of California, as shown on Tract No. 6577 being a subdivision of
a portion of Lot 6, Slausson Tract, recorded in Book 3, Page 348 of Miscellaneous
Records, and Tract No. 5686, being a subdivision of a portion of the Ranchos, San
Antonio, and Los Cerritos, in the Office of the County Recorder of Los Angeles
County",
Is in conformance with the adopted General Plan of the City of Lynwood
Section 2: That the City Council of the City of Lynwood determines that
the vacation of that portion of Lavinia Avenue between Atlantic Avenue and
Virginia Avenue and more particularly described as:
"That portion of Lavinia Avenue right-of-way fifty five (55) wide bounded to the west
by the easterly right-of-way of Atlantic Avenue and to the east by the westerly right-
of-way of Virginia Avenue, in the City of Lynwood, County of Los Angeles, State of
California, as shown in Tract No. 5686 being a subdivision of portions of the
Ranchos, San Antonio, and Los Cerritos, and Tract No. 12035 being a subdivision of
Block C of Tract No. 11554, Map Book 212 -Pages 19 & 20, and a portion of Bullis
Land MR3-399, in the Office of the County Recorder of Los Angeles County",
Is in conformance with the adopted General Plan of the City of Lynwood.
Section 3: That the City Council of the City of Lynwood determines that
the vacation of that portion of alley east of Atlantic Avenue between Lavinia
Avenue and a boundary line southerly of Lavinia Avenue and northerly of Clark
Street and more particularly described as:
"That portion of the first alley right-of-way twenty (20) feet wide located east of
Atlantic Avenue bounded to the north by the southerly right-of-way of Lavinia Avenue
and to the south by the prolongation of the southerly line of Lot 24 in the City of
Lynwood, County of Los Angeles, State of California, as shown Tract No. 12035
being a subdivision of Block C of Tract No. 11554, Map Book 212 -Pages 19 & 20,
and a portion of Bullis Land MR 3-399, in the Office of the County Recorder of Los
Angeles County",
Is in conformance with the adopted General Plan of the City of Lynwood.
Section 4: That the aforementioned described portions of streets known
as Josephine Street and Lavinia Avenue, between Atlantic Avenue and Virginia
Avenue,. and the aforementioned described portion of the alley, easf of Atlantic
Avenue, between Lavinia Avenue and a boundary line southerly of Lavinia
Avenue and northerly of Clark Street are unnecessary for present or prospective
public use and that the public interest, necessity, and convenience require the
vacation of those portions of said streets and portion of said alley.
Section 5: That the City Council of the City of Lynwood does hereby
order the vacation of the aforementioned described portions of streets known as
Josephine Street and Lavinia Avenue, between Atlantic Avenue and Virginia
Avenue, and the aforementioned described portion of the alley, east of Atlantic
Avenue, between Lavinia Avenue and a boundary line southerly of Lavinia
Avenue and northerly of Clark Street.
Section 6: That the City Council of the City of Lynwood does hereby
reserve and exempt from vacation the easements for ingress and egress to
privately and publicly owned facilities and for construction and maintenance of
utilities within the limits of the aforementioned described portions of streets
known as Josephine Street and Lavinia Avenue, between Atlantic Avenue and
Virginia Avenue, and the aforementioned described portion of the alley, east of
Atlantic Avenue, between Lavinia Avenue and a boundary line southerly of
Lavinia Avenue and northerly of Clark Street.
Section 7: That the City Clerk of the City of Lynwood shall cause a
certified copy of this resolution to be recorded in the, Office of the County
Recorder of Los Angeles County.
Section 8: That upon recordation of this resolution, the vacation is
complete.
PASSED, APPROVED and ADOPTED this 2nd day of January, 2008.
