A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DETERMINING THAT THE VACATION OF A PORTION OF VIRGINIA
AVENUE BETWEEN THE I-105 FREEWAY AND JOSEPHINE STREET IS IN
CONFORMANCE WITH THE ADOPTED GENERAL PLAN OF THE CITY OF
LYNWOOD AND ORDERING THE VACATION OF THAT PORTION OF
VIRGINIA AVENUE
WHEREAS, a portion of Virginia Avenue between the I-105 Freeway and
Josephine Street needs to be vacated for the development of the New John Ham
Park; and
WHEREAS, on November 20, 2007, the City Council of the City of
Lynwood adopted a resolution declaring its intention to vacate that portion of
Virginia Avenue; and
WHEREAS, notices of said vacation have been published and posted in
the time, form, and manner required by Section 8317 of the California Streets
and Highways Code; and
WHEREAS, a pubic hearing concerning the vacation of that portion of
Virginia Avenue was held on December 18, 2007 and January 2, 2008, as
prescribed by Sections 8300 et seq: of the California Streets and Highways
Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lynwood as follows:
Section 1: .That City Council of the City of Lynwood determines that the
vacation of that portion of Virginia Avenue between the I-105, Freeway and
Josephine Street and more particularly described as:
"The right-of-way of Virginia Avenue, fifty (50) feet wide, bounded to the north by the
southerly right-of-way of the Century Route 105 Freeway; to the west by the easterly
line of Lot 19 and a portion of Lot 18; to the east by the westerly line of Lot 27 and a
portion of Lot 26; and to the south by the prolongation of the southerly line of Lots 19
and 27, which is also the northerly right-of-way of Josephine Street (formerly Santa
Ana Avenue) as shown in Tract Map No. 6577 in the City of Lynwood, County of Los
Angeles, State of California, being a subdivision of a portion of Lot 6, Slausson Tract,
recorded in Book 3, Page 348 of Miscellaneous Records in the Office of the County
Recorder of Los Angeles County",
is in conformance with the adopted General Plan of the City of Lynwood.
Section 2: -That the aforementioned described portion of street known
as Virginia Avenue between the I-105 Freeway and Josephine Street is
unnecessary for present or prospective public use and that the public interest,
necessity, and convenience require the vacation of that portion of said street.
Section 3: That the City Council of the City of Lynwood does hereby
~ order the vacation of the aforementioned described portion of street known as
~ Virginia Avenue between the I-105 Freeway and Josephine Street.
Section 4: That the City Council of the City of Lynwood does hereby
reserve and exempt from vacation the easements for ingress and egress to
privately and publicly owned facilities and for construction and maintenance of
utilities within the limits of the aforementioned described portion of street known
as Virginia Avenue between the I-105 Freeway and Josephine Street.
Section 5: That the City Clerk of the City of Lynwood shall cause a
certified copy of this resolution to be recorded in the Office of the County
Recorder of Los Angeles County.
.Section 6: That .upon recordation of this resolution, the vacation is
complete.
PASSED, APPROVED and ADOPTED this 2nd day of January, 2008.
