HomeMy Public PortalAbout2008.006 (01-02-08)RESOLUTION NO. 2008.006 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REAFFIRMING THE CITY'S PROTOCOL FOR PERSONNEL RELATED MATTERS WHEREAS, the City of Lynwood is a general law city of the State of California and operates under aCouncil-Manager form of government; and WHEREAS, the role. of the City Council is to establish policy and the City Manager is the administrative head of the city government and shall be responsible for the efficient administration of the affairs of the city; and WHEREAS, the City of Lynwood is authorized by Government Code section 45001 to adopt an ordinance establishing a personnel system for the selection, employment, classification, advancement, suspension, discharge, and retirement of appointive officers and employees; and WHEREAS, the duties of the City Manager in this regard are delineated in Section 2-2.5 and 2-2.6 of the Lynwood Municipal Code; and WHEREAS, personnel records and files are strictly confidential and are not typically available to the City Council, but rather come within the primary responsibility of the City Manager, and his/or her designee; and WHEREAS, the City Council recognizes that it is in the City's best interest to encourage and support-employees and former employees to bring, personnel related matters to the attention of the City Manager's Office for prompt and consistent handling, and exercise restraint in intervening in employee matters where the City has established procedures and protocols for handling the same; and WHEREAS, issues of employee personnel matters unrelated to labor negotiations should be directed first to the City Manager arid/or his designee for proper handling, review and action as may be appropriate; and WHEREAS, the City Council desires to establish a policy which reinforces that employee personnel matters should be handled in the customary and ordinary business manner through the City Manager's Office, and/or his/her designee, and that members of the City Council should refrain from engaging in direct conversations with employees regarding purely employee personnel matters in order to maintain the confidential nature of employee records and files. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF LYNWOOD, STATE OF CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City Council hereby resolves that it shall be the City Council's policy to encourage employees to direct all communications that relate to employee personnel related matters to the attention of the City Manager and/or his or her j designee; and that the City Council, desires to promote consistent employee practices -' and procedures by encouraging current and former employees to pursue any issue of a personnel related matter to the proper channels established by the City's employment practices and procedures (i.e. Personnel Rules and Regulations, Memorandums of Understanding), including communicating those issues to the City Manager as appropriate.
