ACCEPTING DEDICATION OF PROPERTY ON DRY MILL ROAD FOR PUBLIC
STREET AND UTILITY PURPOSES
WHEREAS, a parcel of property 6,462 square feet in size on Dry Mill Road as
shown on a plat of the E. Frank Myers, et al property prepared by DeLashmutt
Associates, dated November 1982, was dedicated for public use in July 1967 and
recorded in Plat Book 11, Page 209 in the Clerk's Office of Loudoun County, but
said plat was not an approved subdivision; and
WHEREAS, no formal acceptance has been made by the Town of Leesburg and no
public improvements have been installed on this parcel of property:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The 6,462 square foot parcel of property described and shown on
the plat prepared by DeLashmutt Associates, dated November 1982, showing the
property of E. Frank Myers, et al is accepted by the town for public use.
SECTION II. This acceptance is conditioned upon compliance by the owner of
record of adjacent property to the south, Woodrow W. Turner, Jr., Trustee, or his
assigns, with all requirements of the town's Subdivision and Land Development
Regulations with respect to installation of public improvements on this dedi-
cated area when the Turner property is properly developed.
SECTION III. A copy of this resolution shall be recorded in the land records
of Loudoun County under the names of Woodrow W. Turner, Jr., Trustee and the Town
of Leesburg.
