The regular meeting of the City Council was called to order by Mayor Merritt at 7 :30 P. M., followed by invocation given by 2. Rev. Roger Hillis of the Westminster Presbyterian Church of 3. Temple City. Mayor Merritt then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford & City Manager `Woollett 5. APPROVAL OF MINUTES: a. Regular Meeting of August 24, 1964 b. Adjourned meeting of August 31, 1964 The Minutes of August 24, Section 20, Adjournment, was correct- ed to read "adjourned to an Executive Session at 7:30 P. M. on August 31, 1964, at the City Hall ". Councilman Harker moved to approve the minutes of the 24th of August as corrected, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to approve the minutes of the adjourned meeting of August 31, 1964, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. ORDINANCE NO. 64 -138: Urgency. City Attorney Shatford read in full Ordinance No. 64 -138 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE TO ADOPT THE NEW FIRE CODE OF THE COUNTY OF LOS ANGELES AS THE FIRE CODE OF THE CITY OF TEMPLE CITY. Councilman Dickason moved to adopt Ordinance No. 64 -138, Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 7. ORDINANCE NO. 64 -139: Urgency City Attorney Shatford read in full Ordinance No. 64 -139 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING THE HEALTH CODE OF THE COUNTY OF LOS ANGELES (ORDINANCE NO. 7853) AS THE PUBLIC HEALTH CODE OF THE CITY OF TEMPLE CITY. The City Manager asked the City Attorney about the County Ordinance raising the fees for Health services as many of the cities are protesting these additional fees. The City Attorney recommended this ordinance be adopted and that a study be made of the fees by the staff advising the ordinance can always be amended if desired. Coun- cilman Nunamaker moved to adopt Ordinance No. 64 -139, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 8. ORDINANCE NO. 64-140: Urgency City Attorney Shatford read in full Ordinance No. 64 -140 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY RE ADOPTING THE BUSINESS LICENSE ORDINANCE OF THE COUNTY OF LOS ANGELES TO INCLUDE ALL AMENDMENTS TO DATE. Councilman Tyrell moved to adopt Ordinance No. 64 -140, Councilman Dickason seconded, roll call vote to carry as follows: 653 Council Minutes. September 14, 1964, page 2 AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None RESOLUTION NO. 64 -403: Re- Gambling Legislation City Attorney Shatford read title to Resolution No. 64 -403 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY URGING THE STATE LEGISLATURE TO ADOPT LEGISLATION IN RESPECT TO GAMBLING OR IN THE ALTERNATIVE PERMIT LOCAL CONTROL OF GAMBLING NOT SPEC- IFICALLY CONTROLLED BY STATE LAW. Following discussion the Resolution was revised in Section 1 line 4, also same Section line 5, and Section 2 end of third line to add "organized" be- for gambling. Councilman Tyrell moved to adopt as corrected, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None • NEW BUSINESS: 10. BOARD OF SUPERVISORS: Recommend adoption of a Resolution oppos- ing lowering of age limit from 21 to 18 yrs. for purchase of alcoholic beverages. City Manager Woollett presented a letter from the Board of Super- visors together with a proposed resolution for cities to adopt vehemently opposing a proposal made on Aug. 4, 1964 before the Assembly Interim Committee on Alcoholism and Alcoholic Rehabili- tation to lower the limit from 21 yrs. to 18 yrs. He recommend- ed that the Council instruct the City Attorney to draw a Resolu- tion for this City strongly opposing the lowering of the age limit. Councilman Tyrell so moved, Councilman Nunamaker second- ed, and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 11. SET PUBLIC HEARINGS FOR CURB & GUTTER INSTALLATIONS: a. 'delland Dr. west side, Daines Dr. to Freer St. b. Loma Ave. east side 5300 block, between Olive & end. c. Loma Ave. west side, 5300 block between Olive and end. d. Key West south side, 10500 block between Halifax & Doreen. e. Pal Mal east side, 5000 block between Arrowood & Key West. f. Arrowood, south side between Pal Mal and cul de sac. Councilman Tyrell moved to set the above listed installations for Public Hearing on Sept. 28, 1964, at 7 :30 P. M., Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 12. TRAFFIC COMMISSION RECOMMENDATIONS: Item 6. Recommend establishment of long range lighting program for up grading lights in the City. Asst. City Manager Koski presented the above recommendation and Made the recommenda- tion for 9 locations which need attention, 7 of which are within the lighting district and the staff suggests the county lighting district be requested to up grade these seven as soon as possible and for the City to do the 2 remaining from the appropriation. Councilman Tyrell moved to approve, Councilman Nunamaker seconded, carried by the following calAed vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Item. 7. Recommend purchase of radar unit and installation of signs at approved locations. Councilman Nunamaker moved to approve the recommendation Councilman Dickason seconded. Councilman Tyrell felt a more de- finite outline of the operation should be approved before the purchase, as recommended, should be made. Following considerable discussion Councilman Nunamaker called for the question. Roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker NOES: Councilmen - Tyrell, Merritt ABSENT: Councilmen -None 654 Council Minutes, September 14, 1964, page 3 Item 9. Recommend parking stalls be painted on Cloverly with indicated red curb markings as per map. (north of Gidley Ave.) Asst. City Manager Koski advised this is just north of the in- dustrial zone south of Lower Azusa Ave. Councilman Tyrell moved to approve, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Item 10. Recommend "NO PARKING AT ANY TIME" sign in front of First Church of Scientist property a distance of 100 ft Mr. Koski advised they have considerable off street parking and have numerous meetings during the week as well as weekends. Following discussion City Manager Woollett recommended the City Council not act on this request and to instruct the staff to give you a better idea as to when they need this restricted park ing. Councilman Tyrell so moved, Councilman Nunamaker seconded, and carried. Item 11. Recommend installation of 4 way "STOP" signs with pave- ment markings at intersection of Olive & Cloverly. Asst. City Manager Koski presented this recommendation. Council man Nunamaker moved to approve, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Item 13. Recommend red curb markings be extended on west side of Reno north of Las Tunas to point 182 ft. north of said north curb return.. Mr. Koski advised this street is 30 ft. from curb to curb and with restaurant and Bank of America there is considerable traf- fic and with two way traffic it is impossible to park on both sides. Councilman Tyrell moved to approve, Mayor Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 13. SO. CALIF. RAPID TRANSIT AUTHORITY: Councilman Harker gave a report on the recent meeting of the appointees to the Selection Committee to select directors for the new So. Calif. Rapid Transit Authority and explained how the organization was being accomplished. The next meeting on Sept. 23 will elect the directors from the nominees to an eleven man board. Following this meeting he will report further to the Council. 14. AMERICAN FIELD SERVICE: EXCHANGE STUDENTS Councilman Harker at this time presented Christine Kearney of Australia and Garon Tollbach of Sweden, both of whom are ex- change students in Temple City for the coming year. Mayor Merritt welcomed them and introduced them to the Councilmen and extended them an invitation to appear before the Council at a future date. 15. SISTER CITY PROGRAM: Councilman Nunamaker reported very enthusiastically on the recent trip to Magdalena, Sonora, Mexico, which has been selected as the Sister City of Temple City. He introduced Mrs. Lou Clarkson, Chairman of the Sister City Committee, who turned over to the Council a plaque presented by that City to the City of Temple City and also elaborated on the previous report on Magdalena as well as Guadalajara where the Conference was held. 16. RESOLUTION NO. 64 -402: Warrants & Demands City Manager Woollett recommended the deletion of #5549 in the sum of $9.36, making the total sum $77,926.15. Councilman Tyrel moved to adopt Resolution No. 64 -402, warrants & Demands in the sum of $77,926.15, No. 5464 and No. 5493 through No. 5576, Coun- cilman Nunamaker seconded, carried by following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 655 Council Minutes, September 14, 1964, page 4 17. REQUEST TO PAINT HOUSE NUMBERS: Lester W. Dale The City Manager presented this request submitted on a chari- table solicitation request form, and as this is requested for his own benefit recommended this be denied and he be advised to apply for a license. Councilman Harker moved to deny, seconded and carried. 13. COMMUNICATIONS: a. L. A. County Boundary Commission: re annexation 1964 -2, City of San Gabriel. Councilman Tyrell moved to receive and file, Councilman Nuna- maker seconded and carried. 1 9 . TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK: No one came Forward at this time. 20. MATTERS FROM CITY OFFICIALS: Councilman Dickason stated he noticed Arcadia was making a stud of surrounding areas relative to annexing and thought Temple City should do likewise. City Manager Woollett advised this City was also doing so and that Arcadia was doing their study in conjunction with us. He advised El Monte is also cooperat- ing in this research with the aim to better develop city boun- daries. Councilman Nunamaker asked about the solicitor applications re- ceived recently and was advised by the City Manager that we are trying to devise a system whereby we will require addition- al information before the request comes to us, and felt these received should be held up for further information. Councilman Nunamaker called upon Mr. Kobett, Ch. of the Boys & Girls Committee for Kids Day, Sept. 25, 26, & 27 at Live Oak Park. Mr. Kobett explained the circus wanted to sell advertis- ing for under the big top with the Kiwanis Club to benefit also The City Attorney stated he was asked this last week and advis- ed the Council would have to amend the Ordinance which strictly prohibits advertising of any kind in any park. For this reason the request was denied. Mayor Merritt asked about some signing regarding over night parking to make newcomers and visitors aware that it is not permitted in the City. There followed discussion regarding this and it was recommended this be taken back to the Traffic Commission at their next meeting. Councilman Dickason advised the cross walk at La Rosa and Tempi( City Blvd. is still unguarded and a lot of school students gather there in the morning. Also due to the width of Temple City Blvd. and distance between signals there is fast moving traffic. He Felt it should be posted and notice given of pedestrian cross walk. The TraFFic Engineer advised the signs from Cloverly and Olive could be utilized and advance pedestria! crossing markings could be made. The City Manager advised of the receipt of a petition from re- sidents concerned with the operation of the Jack in the Box on Las Tunas Dr. The Council has been provided with information from the Food Maker Co., parent Company of the Jack in the Box. Additionally a comprehensive report from Capt. Pascoe. He ad- vised that without exception we have had better cooperation than with any other business firm of this type within our City. Mr. Dick Coleman of the Food Maker Co. spoke and advised of their desire to cooperate in any way possible, that they are now closing at 11 P. M. and have a private officer to patrol the area of their business to help keep order. There followed considerable discussion Following which Councilman Tyrell moved to put this on the calendar for the second week of October when the Council meets for review, Councilman Nunamaker second- ed and unanimously carried. The City Manager presented a request from the Lions Club to sell tickets for their annual breakfast to be held Oct. 13 at Memoli 656 1 1 1 Council Minutes, September 14, 1964, page 5 Hall. Councilman Tyrell moved to approve, Councilman Harker seconded, and carried. City Manager Woollett advised of the possibility of an Agreement between the County and City for maintenance at the Library. Councilman Tyrell moved to instruct the City Manager and City Attorney to enter into an Agreement on behalf of the City, Coun- cilman Harker seconded, carried by following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The City Manager presented a request for the Red Cross to string a banner across Las Tunas Dr. re the Bloodmobile 10 days prior to Sept. 21 and April 11, 1965. Councilman Nunamaker moved to approve subject to insurance requirements, Councilman Dicka- son seconded and carried. The City Manager requested Council approval for necessary sick leave taken off by Marjorie Woodruff for a broken ankle and surgery and for Eunice Eccles for surgery. Councilman Dickason moved to approve, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Dickason suggested possibly the Personnel Ordinance should be reviewed as it might need some revision and for the City Manager make recommendations to the Council. The Asst. City Manager advised of street widening and reconstruc tion of Encinita and improvement of the intersection at Encinita and La Rosa at an estimated cost of $4,000. He advised 186. tax money can be used which will revert back to the state if unused. City Manager ',r<<oollett advised the reason for the haste on this is something we will have to do when widening and improving Encinits. and when this Subdivision came along and in order to go in the way it should be we have to do this now. The reason for the haste is the subdivider is to a point where he is in a position to go ahead and we have to decide to go with him now or we have to go alone later. Councilman Nunamaker moved to spend the money for this improvement, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Mayor Merritt proclaimed the week of Sept. 17 to 23 as Consti- tion Week as requested by American Legion Post #279. Mayor Merritt at this time with the approval of the Council ap- pointed Al ','1. Millham as Traffic Commissioner to replace John Benedict, and also reappointed Richard Sale to the Traffic Com- mission. 21. ADJOURNMENT: Councilman Tyrell moved to adjourn, seconded and carried.
