This is to confirm that at the Public Hearing held by the Town Commission
on January 13, 2012, your application for a Variance and a Level 3
Architectural /Site Plan Review to permit the addition of outside
emergency stairs attached to the south end of the existing building
that will encroach three (3) feet into the required fifteen foot (15').
setback was considered.
Your application and request was denied in that it was determined
that Standards 1, 3, 4, 7 and 8 as defined in Section 66 -154 of
the Gulf Stream Code of Ordinances that must be met in order to
approve a variance were not met.
We are enclosing a copy of the legal that was published in connection
with your application along with a copy of the invoice from the
Palm Beach Post in the amount of $804.96, which has been paid by the
Town, and is reimbursable. We have not cashed your check #5151 in the
amount of $2,500.00 that you submitted at the time you made application
for the variance. If you want us to take the $804.96 out of this
$2,500.00 we will be happy to do that and send you a check for the
difference. Or, if you prefer, you may write another check for $804.96 and
we will return your check #5151 in the amount of $2,500.00 to you.

Staff Recommendation:
Variance
The determination to recommend approval of this variance is to be based upon whether all
eight (8) standards, as defined in Section 66 -154 of the Code, have been met.
Note: Standards 1, 3, 4, 7, 8 are not met.
Standard 1: Special conditions and circumstances exist which are peculiar to the land, structure, or
building involved and which are not applicable to other lands, structures, or buildings in the same zoning
district.
Standard 3: Granting the variance requested will not confer on the applicant any special privilege that is
denied by this Code to other lands, buildings, or structures in the same zoning district.
Standard 4: Literal interpretation of the provisions of this Code would deprive the applicant of rights
commonly enjoyed by other properties in the same zoning district under the terms of this Code and would
work unnecessary and undue hardship on the applicant.
Standard 7: Granting the variance is consistent with the goals, objectives and policies and future land
use map of the adopted comprehensive plan.
Standard 8: Granting the variance will be in harmony with the general intent and purpose of this Code
and that such variance will not be injurious to the area involved or otherwise detrimental to the public
welfare.

This is a safety issue. This unit was designed with one means of egress. The addition of the new stair case will remedy this
deficiency and will provide the owners with the second means of egress from the unit.
