APPROVING THE PERFORMANCE GUARANTEE FOR INSTALLATION OF PUBLIC
IMPROVEMENTS, APPROVING A WATER EXTENSION PERMIT AND AUTHORIZING
A WATERMAIN EASEMENT AND STORM WATERMAINTENANCE AGREEMENT FOR
THE LAFAYETTE DEVELOPMENT IN LEESBURG
RESOLVED by theCouncil of the Town of Leesburg in Virginia as follows:
SECTION I. The manager is authorized to execute, on behalf of the town,
an agreement (form PC-2) with Lafayette of Leesburg for installation of public
improvements shown on plans approved by the Planning Commission and Director of
Engineering.
SECTION II. The extension of municipal water for this facility is approved
in accordance with Section 19-18 of the Town Code.
SECTION III. A cash performance bond in the amount of $9,100 is approved
as security to guarantee installation of public improvements for the LaFayette
development.
SECTION IV. The manager is authorized to execute a watermain easement
agreement in a form approved by the town attorney.
SECTION V. The manager is authorized to execute a stormwater management
maintenance agreement between Lafayette and the town in a form approved by the
town attorney which assures that the developer will maintain the stormwater
management facilities.
