AN ORDINANCE AMENDING ORDINANCE NO. 46-2004
WHEREAS, the Sanitary District Board ('Board") of the Richmond Sanitary District
('District") established fees for the treatment and disposal of sewage and other waste discharged
into the sewerage system pursuant to IC 36-9-25-11 ("Act");
WHEREAS, the Board adopted Resolution No. 19-1994, as amended on June 8, 2004 by
Resolution No. 7-2004, setting forth sewer utility rates;
WHEREAS, the Common Council of the City of Richmond ("City") adopted Ordinance
No. 93-1995, approving sewer utility rates for the users in the District and adopted Ordinance
No. 46-2004 approving an amendment to the sewer utility rates (collectively, "Rate Ordinance");
WHEREAS, the Act authorizes the Board to increase the sewer utility rates, with the
approval of the sewer utility rates by ordinance of the Common Council of the City; and
WHEREAS the Board, at its regular meeting on February 10, 2009, adopted a resolution
to increase the sewer utility rates;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, THAT:
Section 1. The Common Council now approves the amendments proposed by the
Board and amends its Rate Ordinance to read as follows:

Section 2. All other provisions of and all other rates and charges established by
Ordinance No. 93-1995, as amended by Ordinance No. 46-2004, shall remain in full force and
effect.
Section 3. The portion of the rates and charges that represents debt service on bonds
issued to fund the construction of sewer separation overflow projects and Stormwater collection
and conveyances systems and Stormwater improvements shall be repealed upon redemption or
maturity of such bonds. Upon redemption or maturity of such bonds, the Richmond Sanitary
District Board shall send written notice to Common Council and shall also give public service
announcements to the ratepayers of the redemption or maturity of such bonds.
Section 4. This ordinance shall be in full force and effect from and after its passage and
approval by the Mayor.
