PRESENT: Chairman James West, Member Ray Hart, Member Jason Cooper, Member Bill Koester, Member Clint Reading, and Assistant Clerk Rylea Farrens. ABSENT: None VISITORS: None Chairman West asked Member Hart to lead with the Pledge of Allegiance, and welcomed everyone. Approval of Minutes: Chairman West entertained a motion. Member Koester moved to approve the minutes from December 14th, 2022. Member Cooper seconded the motion. All were in favor, so the motion carried. Items of Business: Variance Application- Christine Harris 5442 E. Hansen Avenue; a variance pertaining to the restriction of domestic farm animals on lots less than one (1) acre as specified by Iona PIN City Code § 11-4-2 (B) Member Hart inquired about the number of horses currently on the property. Member Koester stated that he drove by the property earlier and could only see two horses. Chairman West stated that the earliest ordinance pertaining to animals and the size of the lot that City Clerk Keri West could find was in 2005. The Harris Family claimed that they were told they would be allowed to keep their animals as long as they lived there. They believe they should be grandfathered into the current code. Member Hart asked if there was anyone who complained. Chairman West stated that no one is complaining about the horses,but they were cited from the goats they had because there were complaints about the goats. They removed the goats because of the complaints. Chairman West stated that he believes it would be fine to have them continue to have the horses as long as it is only for the life of the current animals that they own. If they allow it, it shouldn't be in perpetuity. He suggested that once the animal passes they shouldn't be allowed to replace the animal. Member Koester stated that sometimes those large animals do better if there's more than one for company. He speculated that if one dies it might become an issue to Iona because it could wander without its friend. If they only have one it might cause trouble. He thinks it would be better to put it in writing that it is for her and her only, not for her kids. The variance shouldn't be for the property, it would be only until she no longer owns the property. Member Cooper noted that he agrees that they should grant the variance but limit it only to Christine Harris. Member Reading stated that there's been horses there for a while according to the satellite 940 image. Chairman West stated that according to Christine Harris, she was under the assumption because of what her realtor told her that she already had an acre lot. Member Koester asked if they should say that she may have two large animals as long as she resides there. Member Hart stated that we should ask for clarification on the number of animals she has. Member Koester clarified that we could allow a number of animals instead of just allowing the two that she currently has. Chairman West states that if they give them the variance it would be to allow them to be in accordance with the one acre rules. Member Reading noted that it would cover if they want to get goats as well, the code wouldn't allow it. Member Cooper moved that we recommend to the City Council grant the variance to Miss Harris that this variance is only for her and ends when she sells the property and that it complies with the one acre rule found in Iona Code § 11-4-2B. Member Reading seconds the motion, all are in favor, so the motion carries. They briefly discussed the area of impact agreement, R-1 Housing in Berkeley Park, and the new highway infrastructure on 49th. fiN Member Hart motioned to adjourn.
