The Common Council of the City of Richmond, Indiana met in regular session Monday, March 2, 2009 in
the Council Chambers in said City.
PLEDGE OF ALLEGIANCE

President Wissel presided and the following business was conducted:
ROLL CALL
Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
APPROVAL OF MINUTES
Councilor Welch moved to approve the minutes of the meeting of February 17, 2009, supported by
Councilor Parker. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
A. RESOLUTION 3 -2009 - A RESOLUTION ALLOWING A LATE FILED STATEMENT OF
BENEFITS FORM FOR A TAX ABATEMENT FOR INNATECH, LLC
Presented by Tony Foster, Director of Metropolitan Development, this Resolution will allow the
hearing of Ordinance Nos. 22 and 23 -2008.
Councilor Miller reported due diligence has been completed and on behalf of the Tax Abatement
Committee moved for approval, supported by Councilor Welch. Upon a vote viva voce, the
motion passed.
COMMUNICATION FROM THE MAYOR
■ Mayor Hutton will be presenting a proclamation to the Girl Scouts in honor of Girl Scout Week
and announced cookies are still available.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the February 12 & 19, 2009 meetings were accepted as presented.
REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES
and /or ORGANIZATIONS
■ Fire Chief Crawley presented a proposal for restructuring the Fire Department. The date for
implementation is March 16, 2009. (A copy of this proposal is on file in the City Clerk's and Fire
Chief's Office).
Police Chief Wolski announced the Information Desk in the Police Department will be closed
weekly, Friday, 11 pm through 7 am. This will allow for extra officers to be on patrol. The date
for implementation is March 20, 2009.

MISCELLANEOUS BUSINESS
Councilor Miller, liaison to the Park Board, read the following statement regarding Highland Lake Golf
Course:
Highland Lake Golf Course will remain open during the entire 2009 golfing season. The
Richmond Park Board is committed to public golf in Richmond. The Park Board publicly
committed to our community that Highland Lake Golf Course will remain open for the entire 2009
season.
The Park Board set benchmarks throughout the season to review the fiscal performance
of Highland Lake Golf Course. The use of these benchmarks by the Park Board has been
misinterpreted by some. It has been incorrectly rumored that Highland Lake Golf Course will be
shut down during the 2009 golf season upon failing to meet any such benchmark. This is simply
not true.
Richmond has a rich, colorful history with the game of golf. This community is passionate
about golf. The best way to guarantee continued public golf in Richmond is for the Richmond
golfing community to support Highland Lake Golf Course. Buy your season membership at
Highland Lake! Golf at Highland Lake! Your 2009 membership WILL be honored throughout the
entire 2009 season. Your support is vital.
On the other hand, if rumor trumps the truth, and if our golfing community does not
financially support Highland Lake Golf Course this season, then the future of public golf in
Richmond after 2009 is dim.
If you care about public golf in Richmond, then PLEASE buy your membership at
Highland Lake Golf Course for the 2009 golf season today.!
ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance No. 11 -2009 on first reading by title
only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 11 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE AREA 9 AGENCY
The Clerk read Ordinance No. 11 -2009 on first reading by title only.
Presented by Terri Quinter, Roseview Transit, this Ordinance would authorize the City of Richmond to
submit a grant application to the Area 9 Agency to fund transportation services from fiscal year 2009-
2010 in the amount of Forty Two Thousand Two Hundred Nineteen Dollars ($42,219) and to accept grant
funding. Matching funds from Roseview Transit Rider donations and the City of Richmond shall be
appropriated in the amount of Seven Thousand Four Hundred Fifty Dollars and Forty One Cents
($7,450.41)
Councilor Welch moved to advance Ordinance No. 8 -2009 to second reading and to suspend the rules
and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 8 -2009 on second reading by title only.
Council President Wissel declared Ordinance No. 11 -2009 on second reading and public hearing. There
being no comments for or against the Ordinance, Councilor Pappin moved for engrossment of Ordinance
No. 11 -2009 as amended, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion
passed.

Councilor Elstro moved to advance Ordinance No. 11 -2009 to third and final reading and suspend the
rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 11 -2009 on third reading by title only.
Ordinance No. 11 -2009 was adopted with a 9 -0 roll call vote.
ORDINANCES ON SECOND READING
ORDINANCE NO. 22 -2008 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6- 1.1- 12.1(lnnatech, LLC)
The Clerk read Ordinance No. 22 -2008 on second reading by title only.
This Ordinance is a request of Innatech, LLC for a 10 -year tax abatement for manufacturing equipment
valued at $12,780,500.
Ordinance No. 22 -2008 was held until March 16, 2009 to allow time for due diligence.
ORDINANCE NO. 23 -2008 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6- 1.1- 12.1(lnnatech, LLC)
The Clerk read Ordinance No. 23 -2008 on second reading by title only.
This Ordinance is a request of Innatech, LLC for a 10 -year tax abatement for real estate valued at
$2,513,574.
Ordinance No. 23 -2008 was held until March 16, 2009 to allow time for due diligence.
ORDINANCE NO. 9 -2009 - AN ORDINANCE AMENDING ORDINANCE NO. 46 -2004 (Sewer Utility
Rates)
The Clerk read Ordinance No. 9 -2009 on second reading by title only.
This Ordinance would establish increased fees for the treatment and disposal of sewage and other waste
discharged in the sewerage system
Councilor Welch moved to amend Ordinance No. 9 -2009 with the addition of Section 3:
The portion of the rates and charges that represents debt service on bonds issued to fund the
construction of sewer separation overflow projects and Stormwater collection and conveyances
systems and Stormwater improvements shall be repealed upon redemption or maturity of such
bonds. Upon redemption or maturity of such bonds, the Richmond Sanitary District Board shall
send written notice to Common Council and shall also give public service announcements to the
ratepayers of the redemption or maturity of such bonds.
Mr. Welch's motion was supported by Councilor Parker. The motion passed with a 6 -3 roll call vote.
Dissenting were Councilors Cruse - Nicholson, Quinn and Wissel.
Council President Wissel declared Ordinance No. 9 -2009 on second reading and public hearing. There
were no comments for the Ordinance. Speaking in opposition were Marvin Smith, Eugene Fannin, Kathy
Wise and Eric Short. Councilor Elstro moved for engrossment of Ordinance No. 9 -2009 as amended,
supported by Councilor Cruse - Nicholson. The motion failed with an 8 -1 vote vive voce. Dissenting was
Councilor Welch.

Ordinance No. 9 -2009 as amended will be heard on third and final reading on March 16, 2009. There will
be no public hearing.
ORDINANCE NO. 10 -2009 — AN ORDINANCE AMENDING SECTION 59 -07(B) AND (C) OF THE
RICHMOND CITY CODE SETTING FORTH STORM WATER RATES AND CHARGES
The Clerk read Ordinance No. 10 -2009 on second reading by title only.
This Ordinance would establish increase storm water rates and charges
Council President Wissel declared Ordinance No. 10 -2009 on second reading and public hearing. There
being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of
Ordinance No. 10 -2009, supported by Councilor Elstro. The motion failed with an 8 -1 vote vive voce.
Dissenting was Councilor Welch.
Ordinance No. 10 -2009 as amended will be heard on third and final reading on March 16, 2009. There
will be no public hearing.
