AGENDA PLANNING BOARD i; November 1, 1990 6:30 PM Town Barn ITEM #1: Approval of the minutes of the October 4, 1990 meeting. ITEM #2: Comments from the Chair. ITEM #3: Recommendations to the Town Board on Public Hearing items: ITEM #3a: To amend the Hillsborough Thoroughfare Plan (Map) by deleting the Davis Road extensions and improvements; (a'ttachments) ITEM #3b: Rezoning Request to rezone approx. 25 acres of land at the northeast and the northwest corners of Eliz. Brady Rd. and Hwy 70A from OI (Office -Institutional) to GI (General Industrial). part of 4.37.C.11 (attachments); ITEM #3c: To amend the Zoning Ordinance by replacing pages 100 and 101 to provide more detailed specifications for tree and shrub planting; (attachments) ITEM #3d: To amend the Zoning Ordinance by adding t,o the definition of setback the allowing of eaves and gutters not to exceed 24" to project into the setback. (attachment) ITEM #4: For information only: the Rezoning Request of Dr. Joseph Gatewood to rezone approx. 16.4 acres of land on the north side of Hwy 70 from R-40 (residential) to MF (multi -family). Evans seconded. Unanimous. ITEM X62: Crowther commended the citizens in the Davis Rd. area for their good conduct, input, attendance and perservance. ITEM #3a: The public hearing item to amend Davis Rd. and its extensions and improvements from the Hillsborough Thoroughfare Plan was presented by Rigsbee who went over the new material in the agenda. Evans said she stayed at Davis Rd. and she agrees it is beautiful and she can understand why the residents would not want a thoroughfare there. Crowther said he felt the elimination of Davis Rd. was essential but at this time it may be the proper channel to amend the map. The 1987 Thoroughfare Plan (TP) is Hillsborough's only adopted plan except for the old 1977 Land Use Plan. If we start chopping away it would be less significant. The TP was used in the planning work for the 20 year transition line and the TP is interrelated in our planning work. It seems that the TP should be reviewed in its entirety within the next two years starting as soon as now. Chavious thought it is better to remove Davis Rd. now than later. Crowther said if we start a precedent of removing sections from the TP other neighborhoods may come forth. Simpson arrives. Deetjen said we should realize it cost time and money on our and the state's part to prepare the TP. He was in favor of dropping it from the list of priorities and reducing the width to 60' from 100' and then no one's land is encroached upon. Olson said what bothered her was Davis Rd. is so far outside of Hillsborough's jurisdiction. Although the state has the right to include it what right does. Hillsborough have - wouldn't it be better for the County to deal with it. Crowther said we are not in sync with the County's TP and that's another reason to review the entire TP. Chavious said he can't support a plan that takes people's land when there are other routes that can be taken. Page 2 PB 11/1/90 Olson said the TP affects not just individuals but a community and research shows when you widen a road it loosens the ties in the community because the road becomes a barrier. Tilley said he agreed with Chavious and in addition he sees no need for a road on our thoroughfare that far out - put another lane on I-40 if needed. Chavious said a more extensive interchange in Efland would help cross-town traffic. Crowther said if Davis Rd. was removed from the TP improvements could still be requested by the County on the T.I.P. Jones agreed Davis Rd. was too far out to be on our TP. Simpson said he was pleased to see the people speak. Deetjen said one of the top priority issues from 2010 is people want Hillsborough to keep that small town feeling. Olson said we have natural limits - not enough water and Davis Rd. is in the watershed so development would probably not be dense. Chavious moved to recommend to the Town Board to -amend --the Thoughfare Plan as written in the agenda. Evans seconded. Crowther said he would also like to see a recommendation to the Town Board that they begin a review of the Hillsborough Thoroughfare Plan to stabilize the deletion of Davis Rd. from the plan and to coordinate with Orange County. Chavious agreed to amend his motion to include the above. Evans seconded. Rigsbee read the motion in full - To delete the Davis Rd. improvements and new connectors from the Hillsborough Thoroughfare Plan. This includes all of Davis Rd., the proposed connector from Hwy 86 to Old Chapel Hill -Hillsborough Rd, Ode Turner Rd. improvements and the proposed connector to Crossroads Cemetery Church Rd. and to further recommend to the Town Board that they begin a review of the Hillsborough Thoroughfare Plan to stabilize the deletion of Davis Rd. from the plan and to coordinate the Thoroughfare Plan with Orange County. VOTE: Unanimous. ITEM #3b: The rezoning request to rezone approx. 25 acres of land at the northeast and the northwest corners of Eliz. Brady Rd. and Hwy 70A from OI (Office -Institutional) to GI (General Industrial) was presented by Rigsbee who read her Planning Director's Analysis from the agenda. Olson said she looked at the USGS topo maps and she would like to raise a flag on this lot as the upper part and along Cates Creek are in the flood plain. Also, there is a 12% slope on the east and it may be highly erodible. She said town ordinances do not protect the creek and slope on the east as it is not a perennial stream. Simpson said we have rules on the books and it will take care of itself. Deetjen asked if GI or OI zoning would affect the land differently and he said he feels this is an excellent location for GI because of its location and its relationship to other future development. Page 3 PB 11/1/90 Olson agreed the location was good. Chavious said he felt we needed more GI zoned land. Tilley moved to recommend to the Town Board that this area be rezoned to GI. Deetjen seconded. Unanimous with Simpson not voting. ITEM #3c: The Zoning Ordinance Text Amendment to replace pages 100 and 101 and use new planting tree and shrub details was presented by Rigsbee who read her comments from the agenda. Deetjen said this is definetely an improvement and it will benefit the developer and the architect. Olson said it wasn't really necessary to specify 12 gauge wire it could say "or similar" but 12 gauge is the industry's standard size. Rigsbee said the 12 gauge section of the ordinance would probably not be closely administered - it was used for guidance and enforcement only when flagrantly unsuitable. Deetjen moved to recommend to the Town Board that we revise the planting details as presented. Evans seconded. Unanimous with Simpson not voting. ITEM #3d: The Zoning Ordinance Text Amendment to amend the definition of setback by allow eaves and gutters to project into the setback by 24" maximum was presented by Rigsbee who read her comments from the agenda. Evans said the gentleman at the public hearing just wants to protect his home from water damage and that is often necessary on mobile homes. Deetjen said a mobile home would be more attractive with a roof, eaves, and gutters rather than have a water damaged home. Olson moved to recommend to the Town Board that the definition of setback be revised to allow for eaves and gutters to project into the setback by a maximum of 24 inches. Chavious seconded. Unanimous. ITEM #4: The rezoning request of Dr. Joseph Gatewood to rezone approx. 16.4 acres of land on the north side of Hwy 70 from R-40 to MF (Multi -Family) was presented by 'Coe who said this will not come to public hearing until January 22, 1991. Gatewood said he envisions 67 units there constructed over a 10 year period. He envisions a private, secure community of single family detached cottages, single level apartments and townhouses and he will maintain a maximum amount of greenery. Olson said in favor of the project is that it is located close to schools and stores and wondered if a pathway could be developed to the schools. She said against this development was it would put more traffic on Churton ST. and questioned water availability. Page 4 11/1/90 PB Gatewood said they have 3 perc sites but hope to hook up to town sewer. Deetjen said w have excess sewer treatment capacity. Gatewood said he anticipates a small office building there to service the units with recreation facilities, tennis court, and guest rooms. Olson said she realized it would be built over a 10 year period but she is still concerned with water supply. There was discussion and the board requested additional information regarding the Durham pipeline and how it will affect growth from the planning department. Chavious said he feels water is not an issue and hopes the Town keeps up with the water supply over the next 10 years. Deetjen said this location merits multi -family housing. Evans said we need more multi -family housing in Hillsborough. The. board asked to see this request again in January for information. Deetjen moved to adjourn at 7:30 pm. Tilley seconded. Unanimous.
