Box 429 �y (919) 732-2104 D HILLSBOROUGH, NORTH CAROLINA -- JOINT PUBLIC HEARING July 24, 1990 Tuesday 7:00 PM Town Barn ITEM #1: Rezoning Request of DCA General Inc., Jim Anthony, to rezone approx. 2.6 acres of Cornerstone Park located on the west side of Hwy 86 from GC (General Commercial) to GI (General Industrial). 4.40.A.8 (attachments) ITEM #2: Text Amendment requested by the Planning Board to delete section 5.6 "Minimum Setbacks for Churches". (attachment) ITEM #3: Vision 2010 Comprehensive Plan - existing land use element and other comments. Agatha Johnson will call the -Town Board members and Janet Rigsbee'will call the Planning Board members to ensure there is a quorum. MINUTES JOINT PUBLIC HEARING July 24, 1990 TOWN BOARD Mayor Horace Johnson, Bob Rose, Remus Smith, Carol Lorenz, `.ESENT: Allen Lloyd, Bobby Riley PLANNING BD. Clyde Pristell, Emery Pristell, Steve Rice, 011ie DeVue, Cheryl Warren, Blake Dickinson, Evelyn Poole -Kober, Janet Rigsbee Mayor Johnson opened the Public Hearing and turned the gavel over to Chair Bill Crowther. ITEM #1: The rezoning request of DCA General Inc. to rezone approximately 2.6 acres of Cornerstone Park located on the west side of Hwy 86 from GC to GI was presented by Rigsbee who reviewed the items presented in the agenda. She showed the affected property on a display board and said the configuration of the area to be rezoned should perhaps show a 200' width at the front setback line because that is the minimum lot width in the GI zone. She said the lot was not yet subdivided but it is proposed to subdivide this lot out of the whole tract in the near future. DeVue asked if this lot would remain GI if rezoned when the new road was installed in -the future and Rigsbee said yes but it is proposed that Area "B" would revert back to DCA General. Steve Rice, engineer for the project, said Southern States decided to apply for the rezoning because a recent, past decision to continue with 100' setbacks for petroleum storage tanks led Southern States to the goal of adding more tanks to the lot. As petroleum storage tanks are non -conforming use in GC a rezoning is necessary. He requested that only area "A" be rezoned to GI because that is the only area in which there will be any development. Area "B" is to meet the lot width and public road frontage requirements only and lot "B" will revert to DCA General once the public road is in place which will serve the major subdivision. Rigsbee asked what access will the Southern States trucks use and Rice said they will continue to use the existing driveway which is not on their property until the new, public road is built. They intend to go through the major subdivision in the near future after traffic projections are finalized. The road would not be built until the lots are subdivided and sold. Rose said then the road in area "B" would not be built and Rice said that is correct. The Mayor said with the increased lot frontage it appears they will be meeting the letter of the law. Rice said that is true and they are not looking for variances or changes to the ordinance and would do what is needed to meet the law. Chavious asked if that was a private road and Rice said no it's a private driveway owned by DCA General. Page 2 JPH 7/24/90 ITEM #2: The text amendment proposed by the Planning Board at the request of Rev. Clyde Pristell to delete section 5:6 of the zoning ordinance, "Minimum Setbacks for Churches" was presented by Rigsbee. She said the current setbacks for churches in residential district are: 45', front and 50' sides and rear. She said when she spoke to Michael Brough that he thought it was not wise to have greater restrictions for churches than residences and she felt that was why the -Planning Board sponsored this amendment. Remus Smith asked where the location of Rev. Pristell's church is and Rigsbee said on Brownsville St. but it must be clear that by deleting this section it will affect all churches in town. Rev. Pristell he hoped the board would change this section of the ordinance because he would like his church to be allowed in the building he has found., He said he works with the youth and he is looking forward to helping Hillsborough. Evelyn Poole -Kober asked what the amendment would do and Rigsbee said it would delete Section 5.6 and would make the setbacks for churches the same as for residences. Al Mustian said it had been difficult to find an allowed use for this building and he is excited to see a church interested in going in there. He said very few of the older churches could meet the setbacks.as'they exist. Ida Evans said she thinks it's great - we have juke joints and churches are so much more desirable. Remus Smith asked if the board could change the dimensions by granting a variance and Rigsbee said it was very difficult to get a variance because there are 5 findings of fact that must be found in the affirmative. Chavious.asked if this section is deleted is there a suggested setback and Rigsbee said it -would be the same as for residences in the zone.. ITEM #3: The Existing land use element for the Vision 2010 Comprehensive Plan was presented by Rigsbee who presented a map made by our consultant; Susan Suggs which showed existing land use. Rigsbee showed an overlay which will show Suggs corrections which should be made on the map. Rigsbee also showed an overlay which showed vacant commerical land = 343 acres, industrial land = 145 acres and office = 42 acres. She said this was an estimate and it did not take into account floodplain land. Bob Rose who is the Chair of the Vision 2010 said they need as much public input as possible and a plan can only be as good as the input that is gathered. He said members of the committee are willing to accept written, verbal, and telephone input. Rose said the public input sessions will be held on Sept. 11, 18, and 25 and the board memebers should encourage as many people as possible to attend. The Public Hearing adjourned at 7:35pm. Janet V.
