I'd like to initiate a small change in our agendas; distinguishing between items that
require action and items that do not. A lot of items require action Wednesday night.
Ordinances 226-228 disconnect three parcels adjacent to Kings Crossing Road. The
parcels are part of 18 different land swaps that took place earlier this year between the
town of Winter Park, the Dimmitt Land Trust, Maryvale, and Fraser. The swaps did two
things: they allowed the straightening of Kings Crossing Road and they establish the
north edge of Kings Crossing Road as the new boundary between Fraser and Winter Park.
If you disconnect these parcels, it is Winter Park's intent to annex them into their
corporate limits on January 7th. Likewise, on November 19th, Winter Park disconnected
two parcels that will be considered for annexation into Fraser on January 8th, 1997. As
additional background information, the signed annexation/disconnection agreement
between Winter Park and Fraser is included.
Statutorily, the town needs to adopt its budget prior to December 15th. Because of this,
the enacting budget resolutions are in the "Action Items" section of the agenda. Because
the hard drive crash saved only the budget that Tim Day were using in a budget/audit
reconciliation, we used this budget to consider grants. This change in format may have
left people confused and as the "new" budget had some formula kinks and incorrect
numbers, I have enclosed two budgets for you to consider next week. One is presented in
the original fonnat and one is in the fonnat presented at the grant's discussion. All the
nwnbers reconcile with the audit and end with the same fund balance.
Attached to the budgets is a cover memo that identifiesline-by-line the differences from
what was originally given to you on October 14th and November 20th. It doesn't make
any difference which you adopt, except that your preference may change the enacting
resolution.. If you feel uncomfortable about the changing formats and numbers, we can
remove these from the Action Items and set a special meeting for December 11 th to
adopt the budget. In any case, lets start Wednesday at 6:00 p.m. with a workshop on the
budget and you can decide which direction you want to head.

The "discussion items" section of the. agenda includes two items that staff would like to
bring back as an action item on December 18th: the proposed air quality ordinance and
the three mile annexation plan. On December t 7th, the County Commissioners will be
considering the Young Life Special Use Permit, you need to decide if you want to
comment to the Commissioners on the proposal.
Under staffs choice, I'd like additional direction on the planned Maryvale workshop as
we have no free Wednesdays in December. Maryvale's Metro District is going to require
us to put together a team to evaluate the District. (legal, financial, etc.) I have someone
I'd like us to use (Lorraine Hayes) to evaluate the financial components of the District
and if we're keeping this option on the table, we need to initiate this evaluation as soon
as possible. Ifwe don't move forward on the Metro District consideration I'd still like to
engage Ms. Hayes to provide us some counter-options to consider presenting to MLLC.

WHEREAS, the Town of Winter Park, Colorado, as owner of one hundred percent (100%)
of the property described and depicted on Exhibit A hereto (the "Property"), has submitted
an Application for Discotmection of said property; and
WHEREAS, the Board of Trustees at its regular meeting on , 1996,
reviewed the Application for Discotmection; and
WHEREAS, the Board of Trustees has examined the record in this case; considered the
request, the Comprehensive Plan, and the recotrunendations of the staff; and based upon the
record which has been made conceming the request, has arrived at its decision; and
WHEREAS, the Board of Trustees has found and detennined that the applicant has complied
with all of the procedural requirements as provided in Title 31, Article 12, Part 5, C.R.S. in
connection with the request for disconnection; and

Colorado, shall be complete and effective on the effective date of this Ordinance.
PART 4: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this

PART 1: The Application for DiscOlmection for the property described therein, is hereby
accepted and found to be in substantial compliance with the requirements of Title 31,
Article 12, c.R.S.
PART 2: The above-described property is hereby disconnected from the Town of Fraser,
Colorado.
PART 3: The disconnection of the above-described property from the Town of Fraser,
Colorado, is complete and effective on the effective date of this Ordinance.
PART 4: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this
Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this Ordinance. The Town
of Fraser hereby declares that it would have adopted this Ordinance, and each section,

ACCESS AND ANNEXATION AGREEMENT
This Access and Annexation Agreement dated as of the '0"'-11 day of AV&t.ls-r

1996, is between the Town of Winter Park, the Town of Fraser and Maryvale LLC, a Colorado Limited
Liability Company, and applies to that portion of Kings Crossing Road within the W1h SWV4, Sec 28,
TIS, R75W.
Whereas, Maryvale has agreed to transfer by Warranty Deed four (4) parcels of land to the
Town of Winter Park;
Whereas, Maryvale has agreed to transfer by Warranty Deed one (1) parcel of land to the
Clifford G. Dimmitt Revocable Trust;
Whereas, the Town of Winter Park has agreed to transfer by Warranty Deed one (1) parcel of
land to Maryvale;
Whereas, the Clifford G. Dimmitt Revocable Trust has agreed to transfer by Warranty Deed
two (2) parcels of land to Maryvale;
Whereas, the Town of Fraser has agreed to transfer by Warranty Deed one (1) parcel of land
to the Clifford G. Dimmitt Revocable Trust;
Whereas, the Town of Fraser has agreed to transfer by Warranty Deed two (2) parcels of land
to Maryvale;
Whereas, the Clifford G. Dimmitt Revocable Trust has agreed to transfer by Warranty I>.e.ed
four (4) parcels ofland to the Town of Winter Park;
Whereas; the Town of Winter Park has agreed to transfer by Warranty Deed three (3) parcels
of land to the Clifford G. Dimmitt Revocable Trust; and
Whereas, the above real estate transactions are for. the purpose of developing the new right-of-
way for Kings Crossing Road as shown on the "Land Survey Plat, Kings Crossing Road, Map of Right-
of-Way and Trade Parcels," Rocky Mountain Engineers, Job No. 8169, Rev. 7/8/96, and consolidating
land ownership to allow relocating the Fraser-Winter Park Town Boundary along this portion of Kings
Crossing Road to the north side of the revised right-of-way.
Now Therefore, the three parties agree to the following conditions:
A. The Town of Winter Park, at its expense, will engage the services of Rocky Mountain
Engineers to survey the northern right-of-way line of Kings Crossing Road after the 18 deeds
listed above' arc recorded with the Grand County Clerk. This right-of-way line shall deOne tlu~
boundary between the two municipalities as well as Maryvale's southern boundary. The three
parties to this agreement agree to sign all necessary disconnection and/or annexation
documents and maps in order that the boundary between the two municipalities follows the
northern right-of-way of Kings Crossing Road. The disconnection and annexation work will be
paid for by Winter Park and the three parties agree that this work task will be completed no
later than December 31, 1996. After the disconnection and annexation process; Kings
Crossing Road will be exclusively within the corporate boundaries of Winter Park.

B. Winter Park will realign and improve the section of lOngs Crossing Road at Winter Park's sole
expense.
C. Winter Park agrees to maintain Kings Crossing Road until such time this Agreement is
amended in writing by the three parties.
D. The following conditions shall apply to access from the Maryvale property onto lOngs Crossing
Road, for all Maryvale property lying adjacent to said Town of Winter Park street within the
W'h SWIf4, Sec 28, TIS, R75W:
I. The Fraser Valley Parkway (FVP) shall be the only public street intersecting
Kings Crossing Road. The location and alignment shall match Lions Gate
Drive intersecting the south side of lOngs Crossing Road, as constntcted by
Winter Park.
2. A maximum of three private access points onto Kings Crossing Road west of
the FVP and east of the railroad tracks serving residential and/or commercial
development projects will be allowed subject to the following conditions:
a. Spacing between entrances and/or between entrances and the FVP shall be a
minimum of 250 ft.
b. Sight distances at each access point shall conform to Town of Winter Park
standards in effect at the time of application for each individual access
approval.
c. Approach grades and alignment of each access road. shall conform to Town
of Winter Park standards in effect at the time of application.
d. Each access may serve residential or commercial developments that will
generate estimated cumulative maximum intersection traffic for all three access
points per paragraph (2) above plus the single access point per paragraph _(3.)
below of less than 2,500 Average Daily Trips (ADT).
e. The traffic generation shall be calculated using Average Weekday Trip
Generation factors published in "Trip Generation," 5th Edition, Institute of
Transportation Engineers.
f. If any access serves a development project which is estimated to generate
more traffic than the limits specified in paragraph (d.) above, the development
shall he provided with an alternative access onto other streets within the
Mai-yvale property sllch that the estimated share of the development project
traffic onto King's Crossing Road is restricted to the limits specified in
paragraph (d.) above. If this occurs, the internal private road system of the
development project shall be arranged to prevent or discourage traffic passing
from Kings Crossing Road, through the project, to the other street within the
Maryvale property serving the project. \, ! . ~!.' r I ';
3. A single private access point onto IGngs Crossing Road east of the FVP serving
residential and/or commercial development will be allowed subject to the
following conditions:

a. The access shall be located as far to the east of the FVP as practicable, but
in no case less than 170 ft. from the FVP, measured from centerline of the
access to roadway edge of the FVP.
b. Sight distance and approach geometry shall be the same as for (2.) above.
c. The access may serve a development project which will generate estimated
intersection traffic of less than 500 ADT onto fGngs Crossing Road, or the
development project shall be provided with alternative access onto other streets within
the Maryvale property to limit traffic onto Kings Crossing Road to 500 ADT, with
conditions as set forth in paragraph (2.f.) above.
4. The construction of each access shall meet Town of Winter Park standards for
embankment. drainage. and surface construction which are in effect at the time
of application. All accesses shall be paved within the Kings Crossing right-of-
way limits.
5. Any access onto Kings Crossing Road shall be submitted to Winter Park and
Fraser for approval a minimum of 30 days prior to the construction of the
access. The application shall include, as a minimum, a plan and profile layout
of the intersection, calculations of sight distances, a sketch plan of the
proposed development project served by the access, and a traffic generation
estimate prepared by a licensed professional engineer. Approval of the access
will not be withheld provided application is complete and the proposal meets
the conditions set forth herein.

Subject: Two budgets: a line-by-line comparison
Due to the hard-drive crash you got a working copy of a differently formatted budget on the
night that you considered grant requests. Tim Day and I were working-on this budget in an
effort to reconcile the budget and the annual audit and as our conversation progressed, we began
to move accounting units around to better reflect an actual accountinglbudgeting document.
Unfortunately, when it was given to you the newly formatted budget had formula errors and
incorrect numbers in a few places. These have now been corrected.
As we have to adopt the budget prior to December 15th, you need to feel comfortable with the
proposed budget -- both in its substance and in its form. To this end, I have prepared two
budgets for you to consider: one in the original format that was handed-out on October 14th and
one that is in a new format, a working copy of which was handed-out on November 20th. I have
also prepared a memo that identifies any changes from what was originally handed-out to that
which I am proposing you adopt. Most of the changes relate to the budget's fonn -- or its
presentation but there have been a few changes in dollar amounts since the original budget was
distributed. The only new numbers in the latest versions that have not yet been talked about are
your 1997 grant allocations.
In no order, here are the substantial changes that are not mentioned in the line-by-Iine details:
. The new format identifies only four funds: general, water, conservation trust, and
developer trust. This was done as this is how the audit "sees" the town's finances.
. Because of this, the new fonnat rearranges accounting units.
. Also because of this, school fees and developer trust revenues are no longer
shown as general fund revenues or transfers.
. When one number in an accounting unit has been identified as different (from the
original distribution) I have not pointed-out that the corresponding subtotal, total, etc.
also changes.
. Many of the original 1995 actuals (from the budget distributed on 10/14) have been
changed to reconcile with the audit. These changes are not identified in this memo.
The line-by-Iine details are presented in the order you would come-to if you were looking at
both budgets simultaneously. Please call if you have questions.

AN ORDINANCE OF THE TOWN OF FRASER, CO~ORADO, REPEALING
ARTICLE 7-8 OF THE FRASER MUNICIPAL CODE AND SETTING FORTH
CERTAIN PROVISIONS TO CONTROL AIR POLLUTION WITHIN THE TOWN,
AND PROVIDING DETAILS WITH REGARD THERETO.
WHEREAS, the Board of Trustees of the Town of Fraser has found and
determined that air quality is an important component of the health, safety, and welfare
ofthe citizens and community of the Town of Fraser;
WHEREAS, the Board of Trustees of the Town of Fraser has found and
determined that the Board has a duty to protect and improve air quality and preserve the
scenic natural resources of the community by the control, prevention, and abatement of
air pollution in and around the Town of Fraser.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FRASER, COLORADO, THAT:
PART I: AMENDMENT TO TOWN CODE. The Code of the Town of
Fraser, Colorado is hereby amended by repealing Article 7-8, and subsequently adding a
new article to said Code entitled "Environmental Quality- Air Pollution Control," which
shall read as follows:
Purpose:
The Fraser Board of Trustees hereby finds and declares air quality to be an important
component of the health, safety, and welfare of the citizens and community of the Town
of Fraser and the Town Board has a duty to protect and improve air quality in and around
the Town, and to preserve the scenic natural resources of the community. It is further
declared that the control, prevention, and abatement of air pollution within the Town of
Fraser is a matter of significant local interest and concern. To this end, these regulations
are intended to achieve the following specific purposes:
A. To protect the air quality in the Town of Fraser.
B. To reverse the trend towards increased air degradation in the Town of
Fraser.
C. To provide heat sources that are efficient and have a reduced air polluting
effect.
Definitions:
Building: any structure built for the shelter or enclosure of any use or occupancy.
Building Official: the official or other designated authority charged with the
administration and enforcement of the Uniform Building Code and the Town's code.

Cert(fied nOll-solidfuel burning device: a device which burns a non-solid fuel, such
as natural gas, liquefied petroleum, or similar fuel in an appliance and/or device which
has been approved by Underwriter's Laboratory, American Gas Associates, or the
Building Official.
Certified solidfuel burning device: a solid fuel burning device which is certified by the
Air Pollution Control Division of the Colorado Department of Public Health and
Environment, to meet the emission standards set forth in Section IV of regulation #4 of
Volume I of the Standards of the State Air Quality Control Commission.
Dwelling Unit: one or more rooms in a dwelling designed for occupancy by one
family for living purposes and having not more than one kitchen.
Dwelling, Single Family: a detached building designed exclusively for occupancy by
one family.
Dwelling, Multi Family: a building designed for or occupied by two or more
families living independently of each other.
Family: one or more persons occupying a single dwelling unit and maintaining a
common household, but not including boarding or rooming houses, lodges, hotels,
motels, tourist courts, or similar uses.
Idle or Idling: the running of the engine of a motorized vehicle of any type whatsoever
while the vehicle is not being operated for its intended purpose, on either public or
private property within the Town of Fraser.
Slash burning: a method of clearing forested areas by cutting down and burning
vegetation.
Solid Fuel Burning Device: any fireplace, stove, firebox, or other device
intended and/or used for the purpose of burning wood, coal, pulp, paper, pellets, or other
non-liquid or non-gaseous fuel.
** Any word, term, or phase not herein defined or specified shall be defined in
accordance with the Town of Fraser Zoning Code. **

Solid Fuel Burning Devices
A. No person, firm, or cooperative shall install, or replace a solid fuel
burning device, or gas appliance within the Town of Fraser without first obtaining a
bllilding permit in accordance with the Uniform Building Code as adopted by the Town
of Fraser.
B. No person, firm, or cooperative shall install or replace a solid fuel burning
device unless the solid fuel burning device is a certified solid fuel burning device.
C. Limitation on the number of devices:
l. Detached single family dwelling for which a building permit is
issued after effective date of this ordinance may have no more than one (1) approved
solid fuel burning device per dwelling.
2. Duplex units, or a building with two dwelling units, for which a
building permit is issued after effective date of this ordinance may have no more than
one (1) approved solid fuel burning device per dwelling.
3. No solid fuel burning device shall be allowed in apartments,
condominiums, townhouse, hotel/motel rooms, accessory buildings, accessory
apartments, restaurants, bars, commercial and industrial buildings other than one ( I)
approved solid fuel burning device per lobby or other main common area.
4. Any non-approved solid fuel burning device that requires
replacement, relocation, or significant modification, must be removed and/or replaced
with an approved solid fuel burning device, or approved non-solid fuel burning device.
D. To encourage the conversion of wood burning fireplaces and non-certified
solid fuel burning devices to certified solid fuel burning devices, gas log fireplaces, and
gas appliances, a rebate of $ 100.00 shall be paid to any building owner who converts to a
certified solid fuel burning device, gas log fireplace, or gas appliance.
E. Any solid fuel burning devices which are pre-existing before the effective
date of this Ordinance shall be exempt from the provisions set forth in this Ordinance.
However, if said solid fuel burning device is replaced, it must be replaced with a certified
solid fuel burning device, or a certified non-solid fuel burning device.
Slash Burning
A. Any property owner who is contemplating the clearing of forested areas is
strongly encouraged to mulch, separate for firewood, or use other methods which do not
involve burning to remove slash materials from subject property.
B. Any property owner who does use burning methods to dispose of slash
materials must contact the Colorado State Forest Service, and the East Grand Fire
Protection District to receive direction on optimum burning methods. The property
owner/applicant shall follow the direction of the East Grand Fire District, and the
Colorado State Forest Service.

C. The property owner/applicant must contact the Colorado State Forest
Service a minimum of ten (10) days before a burn is to occur, to request a day-of-burn
weather forecast which will be conducted on-site, allowing the Colorado State Forest
Service to forecast smoke dispersal at the location of the proposed burn. A fee will be
charged for each site visit. Smoke dispersal forecasts must meet a minimum standard
set by the Colorado Forest Service for a burn to occur on a chosen date.
Engine Idling (Repeal Article 7-8, Excessive Idling of Motorized Vehicles)
A. It shall be unlawful for any person to idle or permit the idling of the motor
of any stationary motor vehicle for a prolonged or unreasonable period of time
determined herein to be fifteen (15) minutes or more within anyone hour period.
B. This section shall not apply when an engine must be operated in the idle
mode for safety reasons, including, but not limited to, the operation of cranes and fork
lifts used in the construction industry.
Appeals
Appeals of orders, decision or determination made by the building official relative to the
application and interpretation of this ordinance shall be heard by the Fraser Board of
Trustees. The deci~ion by the Board of Trustees shall be final.
. Penalties and Enforcement
Any person convicted of a violation of any provision of this chapter shall be punished by
a fine not exceeding three hundred dollars ($300.00) or by imprisonment not exceeding
ninety (90) days, or both such fine and imprisonment. Each and every day a violation of
this chapter exis~s shall be deemed a separate offense.
PART 2: REPEAL. Any and all existing ordinances or parts of ~rdinances of
the Town of Fraser covering the same matters as embraced in this Ordinance are hereby
repealed and all ordinances or parts of ordinances inconsistent with the provisions of this
ordinance are hereby repealed; provided, however, that such repeal shall not affect or
prevent the prosecution or punishment of any person for any act done or committed in
violation of any ordinance hereby repealed prior to the taking effect of this Ordinance.
PART 3: SEVERABILITY. If any section, subsection, sentence, clause, or phase
of this ordinances, for any reason, held to be invalid or unconstitutional, such decision
shall not affect the validity or constitutionality of the remaining portions ofthis
Ordinance. The Town of Fraser hereby declares that it would have adopted this
Ordinance, and each section, subsection, clause or phase thereof, irrespective of the fact
that anyone or more sections, subsections, sentences, clauses and phases thereof be
declared invalid or unconstitutional.

THREE IVIILE ANNEXATION I)LAN
I. l'lIUrOSE:
The pmpose of this plan is to address the speci fic statutory requirements of C. RS. 31-12-
105, to evaluate land areas a<.Uacentto the existing Fraser town boundaries and within a
three mile distance to determinc which land t1reas are suitable for annexation and future
urbtlnization, and to provide direction concerning land use issues and infi'astructme needs
upon annexation of parcels adjacent to the commllllity. The TO\\in of Winter Park lies
within three miles or the Town or Fraser houndary, hut has been len out of the three mile
plan hOllndar)' hecause as an existing municipality, Winter Park is not eligible It)r
annexation. The identification of parcels in this plan does not guarantce that annexation
of these parcels will occm in the Itlture.
II. METIIOUOLOGY:
This three mile plan will be used in cOI~junction with the Fraser Community Plan Volume
I and II. The land areas specified in this three mile plan are currently included, and
referenced in, the Fraser Community Plan (Volume II) Update of 1986 as the "primary
annexation areas" and the "secondary growth areas," and are depicted on the Figure I
Future Land Use Map. For the purposes of this plan, it is assumed that the land
designated for annexation is necessary to lullill a number of community needs.

-are needed to provide open space throughout town;

In determining which lands should be included within the three mile plan, consideration
was given to the future needs of the community. Thc 1()lIowing critical issues were
incorporated into the discussions: the desire to plOvide areas Ii.)r additional residential
and commcrcial (including light industrial) dc,e1opment in suf'licicnt quantitics to satisly
the future nccds of the community and the desire to protect opcn space areas mound the
community in order to provide fl.,.. wildlife habitat. recreational opportunities, and
maintain a natural backdrop to the comnllmity.

The basic criteria and factors used to determine which land would be desirable for future
annexation, and to ((.)fIn the basis f(Jr the Town's annexation plan boundary \vere as
follows:
-include those areas that have been designated in the primary annexation areas
and secondary growth areas in the Fraser Community Plan and Update:
-include those mens that may be able to provide adequatc and usahle water rights:
-includc those areas which broadcn the Town's ability to provide fhr housing amI
commercial (including light industry) service needs or the community:
-include those meas that can he econol11icnlly and elficicntly served by the Town
with urban services, including water, sewer, streets, storm drainage, parks, bicycle and
pedestrian pathways, police, and lire protection, etc:
-include those areas that provide for the recreational and open space needs f()( the
comlllunity;
-include those areas that will offer a positive impact to the community.
III. IJOlJNDAIUES:
All areas that have been included within the Town's tlnee mile plan are shmvn on the
puture Land Use Map (Figure I) or the Fraser Community Plan (Volume II) Update. The
areas included in the three mile plan represent the TO\\,n's belieI' that additional land is
needed for future development. Inclusion within the three mile plan does not guarantee
these areas will ever be annexed.

l~a"d Descriptio,,: This area is located soutlnvest or the current Fraser town limits and
is bordered by County Road 72 and County Road 73. This parcel is approximately 165
acres in size. This land is characterized by a combination of nat, open, agricultural,
meadow lands, and forested slopes.

La1ld Use: The proposed land use fot' this area is to retain land uses and densities that
currently exist prior to annexation until the Coordinated Growth Management Plan is
adopted and implemented, and as may be amended, by Orand County and the to\vns of
Fraser and Winter Park pCI' the Memorandum of Undcrstanding dated November 20,
1995. Prior to the adoption of thc Coordinated (howth Managemcnt Plan, increases in
density may be negotiated if it broadcns the Town's ability to provide Illf housing and
commercial (including light industry) servicc nceds I(lf thc community, provides fllf
recreational and open space needs fin the community, and/or accomplishes beneficial

Uti/it;e.'i: There are no utility services on site at this time. Town regulations require
that properties being annexed utilize the Town of Fraser municipal water systcm and the
Fraser Sanitation wastewatcr system. The dcvelopcr will incur the cost of extending the
necessary infrastructure to the site. It is preferable, and maybe necessary, that the land to
be annexed provide adequate and usable water rights. The Town may require the
developer to pay fees-in-lieu or water rights irthe \vater rights associated with the land
are inadequate.
l'ra1lsportat;o1l: This area is presently served by County Road 72 crossing only in
the lower southwest corner. The Circulation and Transportation Map (Figure 2) of the
Fraser Community Plan (Volume II) Update designates a collector road also approaching
this area at the southwest corner. Any development \vill be served by local streets 011' this
collector road and will he integrated with the Town's existing road system. Bike and
pedestrian pathways \vill be incorpnfnted and extended onto this site and nccess to
adjacent properties \vill he negotiated.
Comm"1Iity Sen';ces: This site is now located within the East Grand Fire
Protection District, East Grand School District and the Grand County Library District.
Commu/lity serviccs will be provided in the same manner as presently exist, and may hc
expanded in the future.

that preserves and provides open space, parks, and recreational opportunities based on
community needs.

The town of Winter Park is directly south of this parcel of land. The land adjacent to this
parcel on the east has a currentPDD land use zoning. This area is approximately 340
acres in size. Currently, the Denver Water Board owns this vacant land. This area is
characterized by slopes and forests.

necessary infrastructure to the site. It is prelerahle, and maybe necessary, that the land to
be annexed provide adequate and usable water rights. The Town may require the
developer to pay fees-in-lieu or water rights irthe water rights associated with the land
are inadequate.
l'ram,pmtutio,,: The Circulation and Transportation Map (Figme 2) of the Fraser
Community Plan (Volume II) Update designates two collector roads (one facilitated hy a
new railroad underpass) intersecting this property. This area is traversed with primitive
dirt roads accessing Denver Water Board lacilities. The southern tip of this parcel is
currently serviced by County Road 7, which is an extension of Vasquez Road in Winter
Park. Any development will be served hy local streets olT these collector roads and will
be integrated with the existing road system. Bike and pcdestrian pathways will be
incorporatcd and extcndcd onto this sitc and acccss to adjaccnt properties will be
negotiated. In coordination with the dcvelopment or the Winter Park Ski Arca Vasquez
expansion, a gondola link has been proposed to connect a vehicle staging area to the
proposed Vasquez base.

virtue of their high visual vulnerability and contribution to the exemplary environmental
quality oflhe Fraser Valley.
Area 4 Urban Tract
Lalld J)e,'icriptiml: This area is located to the east of the current Fraser town limits.
This parcel abuts the Arapaho National Forest on the east. The land adjacent to this
parcel on the south has a current PDD land use zoning. This area is approximately 150
acres in size. The parcel is characterized forested slopes.
Lalld Use: The proposed land use for this area is to retain land uses and densities that
currently exist prior to annexation until the Coordinated Growth Management Plan is
adopted and implemented, and as may be amended, by Grand County and the towns of
Fmscr and Winter Park per the Memorandum or Understanding dated November 20,
1995. Prior to the adoption of the Coordinated Growth rvlanagement Plan, increases in
density may be negotiated if it broadens the Town's ability to provide for housing and
commercial (including light industry) service needs for the community, provides f()r

Area 5 "'inter I'ark ltanch/Meadowridge
[~a"d lJesa;pt;oll: This area consists of approximately 150 acres or un existing
plaUed subdivision called Winter Park Ranch. The parcel is located on the top of a ridge
with a majority of the property being relatively flat with extensive tree cover.
Lalld Use: This subdivision is currently located in unincorporated Grand County.
The area is zoncd residential and accolllmodations with allowed densities 01'0.5 to 20
units per acre. The land adjacent to this parcel on the south has a current PDD land use
zoning.
Vfifities: The Winter Park West Water and Sanitation District serves the Winter
Park Ranch subdivision. All other necessary utilities are currently available at this site.
Tra".'~portat;oll: This area is currently served by adequately planned and established
county roads. Consideration to extend this road system to adjacent properties should be
incorporated into future planning. Bike and pedestrian pathways have not becn
developed and should be planned to connect \vith sUllounding properties in a logical
manner. In addition, access to a(ljacent properties will be ncgotiated.
COIIIIII" ";f)' Sert'ices: This site is now located within the East Grand Fire
Protection District, East Grand SchoollJistrict, and the Urand County Library District.
COlllmunity services will be provided in the same manner as presently exist, and may be
expanded in the future.

town boundaries with U.S. Highway 40 intersecting the parcel.

currently exist prior to annexation until the Coordinated Growth Management Plan is
adopted and implemented, and as may be amended, by Grand County and the towns of
Fraser and Winter Park per the MemoHlIldum oflJnderstanding dated Novemher 20,

Utilities: The Fraser Sanitation wastewater facility is located on this property. Even
though this property is locatcd in a primc service located, no utilities havc been
developed. The high cost of extcnding service underneath the highway has prohibited the
FVMRD from connecting to the Fraser Sanitation District. Town regulations require
properties being annexed to utilize the Town of Fraser municipal water system and the
Fraser Sanitation wastewater systcm. The developer will incur the cost of extending the
necessary infrastructure to the site. It is preferable, and maybe necessary, that the land to
be annexed provide adequate and usable water rights. The Town may requirc the
developer to pay fees-in-lieu of water rights if the \vater rights associated with the land
are inadequate.
l'raluportatio1l: U.S. Highway 40 divides this parcel. County Roads 5, 50, and 520
give access to the southwest portion or the property, The FVMRD's sports complex is
accessed by a dirt road off County Road 5. This road continues through to the Denver
Water Board property west or U.S. Ilighway 40. An Intergovernmental Agreement (IGA)
with the towns of Fraser and Willter Park and Grand County envisions a collector road
called the Fraser Valley Parkway to connect County Road 5 to County Road 73. The
Fraser Valley Parkway will eventually traverse lands on the west side of U.S. 11ighway 40
and connect County Road 5 through to the Town of Winter Park. A collector road is
planned for the southeast section or this propcrty on the east side or U.S. I Iighway 40 to
loop into the Four Way Estates subdivision and County Road 8. Bike and pedestrian
pathways will be incorporated and extended onto this site and access to adjacent
properties will be negotiated.

IV. POLICIES ANI) (;OALS:
The following information is required by the Town of fraseI' as part of any annexation
petition submittal:
A. Statistical nata: Necessary facts including, but not limited to, acreage, number
of residential units, businesses, estimated population, street mileage-paved and unpaved,
and assessed valuation.
u. MailS: Showing present and proposed municipal boundaries, general land usc
patterns, existing and proposed zoning, present majortrunk watcr mains and proposed
extensions, present sewer interceptors, and proposed extensions, existing streets, and
existing public areas.
e Existing Public Services: Public services to the area's residents should be
,. surveyed and evaluated. The methods of providing such services should be described and
their costs determined. These services include, but arc not limited to: police, lire, water,
se\ver, refuse, library, street maintenance and lighting, storm sewers, animal control, land
use planning, building inspectional services, public health protection, recreation, and
emergency services.
I). Service Re(luirement Costs: The cost of extending or improving services should
be determined. Anticipated expenditures should be contrasted with anticipated revenues.
Consideration of service costs should include all of the services mentioned at item C
above. The difference between revenues and expenditures for each category should be
stated as a liability or an asset. The extent to which such services are already being
provided, if at all, will determine the degree to which additional services may be
required.
V. AMENDMENTS:
Colorado State Statues requires that each community adopt an annexation plan and that it
be updated at least once annually. The Town of Fraser will keep annexation plan up to
date and if circumstances change, amend it more oflen than once a year to keep it in
compliance with Town goals and policies.
