ITEM #3: Chair's comments. ITEM #4: Recommendation on the rezoning request of DCA General Inc. to rezone approx. 2.6 acres of Cornerstone Park located on the west side of Hwy 86 from GC (General Commercial) to GI (Genral Industrial). 4.40.A.8 (attachments) ITEM #5: Recommendation on text amendment to delete Section 5.6 of the Zoning Ordinance "Minimum Setbacks for Churches". MINUTES PLANNING BOARD AUGUST 2, 1990 MEMBERS Bill Crowther (Chair), Sam Jones (Vice -Chair), Wayne Tilley, Ken PRESENT: Chavious, Leif Deetjen, Stephen Jones, Margaret Moore, Richard Simpson, Wendy Olson (Alternate) MEMBERS Ida Louise Evans, Jim Culbreth (Alternate) ABSENT: OTHERS Steve Rice, Joff Coe PRESENT: Crowther called the meeting to order at 6:35 PM. ITEM #1: Chavious asked about the McAdams Road situation and Crowther said the Planning Board had made its recommendation and they were waiting for possible action by the Town Board. Olson asked if there should be further discussion of the proposed extra zoning classifications and the members agreed to postpone this item until a later meeting. ITEM #2: Deetjen moved to approve the minutes of the June 7, 1990 meeting and the July 24, 1990 Public Hearing as written. Stephen Jones seconded the motion. VOTE: Unanimous. ITEM #3: Crowther thanked Sam Jones for conducting the June 7, 1990 meeting in his absence. ITEM #4: Coe reviewed the rezoning request of DCA General, Inc. to rezone approximately 2.6 acres of Cornerstone Park located on the west side of Hwy 86 from GC (General Commercial) to GI (General Industrial). Crowther noted this item had been to Public Hearing and the Board must now make a recommendation. Deetjen said this was not a bad area for GI and asked if the other lots could be rezoned and Crowther said yes. Olson noted Area "C" was laid out only to meet the letter of the Ordinance. She said she had discussed this with the Planning Director and they had agreed it was best to reduce the outlets onto Hwy 86. Olson asked if there was any reason why the roads could not be dedicated to the Town now and Crowther noted there could be economic reasons. Olson said she was bothered by the accessibility to the the propane tank area in the event of emergency pointing out if the dead-end road were blocked, fire trucks could not reach the scene. Sam Jones noted a similar situation existed at the Kenan Oil facility on Hwy 70. Olson added she felt this was a good location for a propane storage facility but the lot lines should be extended 35' so the adjacent lots would not be affected by the required setback. She then moved to deny the request unless revisions were made to the road and the lot dimensions. Chavious seconded the motion and Crowther opened the floor for further discussion. PLANNING BOARD AUGUST 2, 1990 PAGE 2 Stephen Jones pointed out the Board should concentrate on the present application and not the future and Crowther agreed. Simpson asked for clarification of the setback and Crowther explained the adjacent property owners would have to meet an additional 35' distance from the tank in addition to the normal setback. Rice noted in this case the adjacent property owner and the applicant were one in the same. Chavious pointed out a buyer of the property might not know about this and Deetjen said real estate agent should make this fact known. Olson then retracted her motion and Chavious retracted his second. Olson moved to deny the request because the lot was not presently in compliance and to require an additional 35' added to the lot and to require approval by the fire marshall. Deetjen pointed out the Board could approve the application with conditions instead of denying it and Stephen Jones agreed saying questions about the road and the fire safety issue would be examined by the Board of Adjustment at the Conditional Use Permit stage. Deetjen and Crowther agreed and Olson's motion died for lack of a second. Deetjen moved to recommend approval of the request with the condition the developer extend the lot lines by 35' so adjacent land owners would not be penalized by the setback requirements from the propane storage tanks. Stephen Jones seconded the motion. VOTE: Unanimous. ITEM #5: Coe reviewed the text amendment to delete Section 5.6 of the Zoning Ordinance "Minimum Setbacks for Churches". Crowther asked if the proposed facility was really a church or a social club. Chavious asked if the Board should question the validity of a church and Deetjen noted there was a problem with the definition of "church". Coe added the term church was not defined in the Zoning Ordinance. Simpson said the Board should accept the application as written in that the applicant had defined the facility as a church. Olson said she had a problem with the size of the parking lots on church property. She noted one half of the setback could be used for parking, creating many churches with very large parking lots which were unsightly in residential areas and caused problems with congestion, runoff, dust and heat. She suggested approving the setback requirement but placing conditions of the amount of parking allowed in the setback. Chavious said he was concerned about creating unconformities with the new regulation and Simpson said we were about to regulate it (the town) right off the map. Simpson said the Board should not prolong people's progress and progress could not be held back. Crowther suggested examining the parking lot issue at a later meeting or Public Hearing. VOTE: PLANNING BOARD AUGUST 2, 1990 PAGE 3 Chavious asked if the deletion would be beneficial for churches and Olson said yes because in effect churches would now require a lesser setback and many churches in Town would now be conforming. Tilley then asked for clarification saying it was his understanding churches would now have to meet the same setbacks as other structures in the same zoning district and the members agreed. Tilley moved to recommend deletion of Section 5.6 of the Zoning Ordinance and to recommend churches comply with the setback requirements of the zoning district in which they are located. Simpson seconded the motion. Unanimous. Jones added that any place could be a church because it was just a place to congregate where religion could be exercised. Coe reminded members to update their Zoning Ordinances with the handouts distributed at the meeting. Olson said she was concerned with future church parking requirements and standards and suggested church parking lots have an increased vegetative buffer. Crowther adjourned the meeting at 8:00 PM.
