It is essential to have a quorum. l December 1990 Hillsborough 2010 Comprehensive Plan Goals and Objectives MISSION STATEMENT: The mission of the 2010 Comprehensive Plan is to maintain, protect and improve the elements of Hillsborough, its historic built and natural environment, and the diversity of its people, and the small town qualities that are unique and precious to Hillsborough; and to create within those elements an economic vitality dedicated to and consistent with those elements. A. Maintain and improve the appearance of Hillsborough. Contributory elements to the Town's appearance include the historic built small town qualities'of well maintained older buildings and yards, narrow tree lined streets, human scale and natural open space. 1. Appoint an Appearance Commission charged with the responsibility to study appearance related issues, formulate solutions and make recommendations to the Town Board. Responsibility: Town Board to appoint and Appearance Commission to carry out the work 2. Continue to support the Historic District of Hillsborough. a. Strengthen the effectiveness of the District by developing Design Guidelines for alterations and additions to existing structures, site development, and new construction. b. Study the issue of infill development, develop srategies to allow infill while protecting the integrity of the Historic District. c. Study the potential to expand the Historic District to include West End and other parts of town. Responsibility: Historic Commisssion and Town Board 3. Continue to implement the landscape and buffer regulations in the Zoning Ordinance. Strengthen these regulations to require the addition of landscaping to existing business sites. Responsibility: Planning Board and Town Board 4. Continue to implement the sign regulations in the Zoning Ordinance with periodic review to update and improve these regulations. Responsibility: Planning Board and Town Board 5. Develop policies and regulations to encourage the preservation of conservation lands and public park lands. Study the the feasibility of using zoning regulations, subdivision regulations, offering tax breaks for donation and public purchase as means to achieve this goal. Responsibility: Town Board and Planning Board 6. Improve the appearance of entranceways into Hillsborough along South Churton Street, US 70, and NC 86. a. Continue to implement and strengthen signage and landscaping standards. b. Develop and implement a tree program along these entranceways. c.. Include landscaping in the recommendations for the TIP. d. Study the feasibility of creating an entranceway overlay zone to regulate the appearance of development along these entrances into Hillsboro. Responsibility: Town Board, Planning Board, Appearance Commission Tree Board 7. Develop policies and regulations to protect the small town scale of Hillsborough and to require that new development occur in similar complementary scale components to the Historic District. a. Develop zoning regulations to control building size, height, orientation, setbacks, parking and landscaping for new commercial and business development. b. Develop and implement a street tree program. c. Protect neighborhoods from encroachment by large scale commercial, industrial, or multi -family developments through the locations of zoning districts and buffer requirements in the zoning regulations. d. Develop and implement a neighborhood parks program for both new and existing,neighborhoods. e. Promote sidewalk and walkway development to connect feaures of the Town by pedestrian access. f. Study the concept of neighborhood commercial to deVielop regulations to allow limited commercial. development in residential areas which is in scale with the neighborhood. Responsibility: Planning Board, Appearance Commission, Town Board and Tree Board 8. Establish policies, regulations and enforcement to reduce litter and the dumping of trash including junk cars. Responsibility: Town Board 9. Establish, policies, ordinances and enforcement to require a minimum level of maintenance of private properties including mowing and the removal of abandoned and dilapidated structures. Responsibility: Town Board B. Improve and protect the economic vitality of Hillsborough. 1. Develop water resources in scale with a low growth and low debt obligations for Hillsborough. a. Proceed with the development of a reservoir as a top priority. b. Improve utility service in developed areas of Town as needed. c. Implement a water pricing schedule charging high water users more to discourage high water users. Responsibility: Town Board 2.Prepare for, encourage and control tourism. Suport the efforts of private groups including the Chamber of Commerce, Preservation Fund, Historical Society and others to study tourism issues and to develop a Tourism Plan for Hillsborough. a. Provide a tourist/ travelers service area with information, rest facilities, parking, food and lodging in a location convenient to the interstates and complementary to the Historic District. b. Continue to expand and improve tourist services (shuttles, rest facilities, guides, special events) c. Expand the variety of tourist attractions to include not only the Historic District, retail areas, historic buildings but also the river front, archaeological sites, parks, manufacturing heritage, etc. d. Continue to assist private enterprise in the processing of applications for outside funding which need the endorsement of the Town. Responsibility: Town Board with the assistance of the Chamber of Commerce. 3. Develop infrastructure for and encourage a diversity of non- polluting and low water use industry that provide a full range of employment opportunity and protection from economic slumps. a. Develop and adopt zoning regulations to control polluting industry. b. Develop and adopt industrial zoning lot size regulations to encourage small to medium sized industries rather than large industries. c. Develop and implement pricing schedules for water and sewer to discourage large water users. Responsibility: Town Board and Planning Board 4. Develop -and implement an annexation policy which requires that the projected revenues received from a proposed area for annexation cover the projected expenses incurred by the Town as a result of the annexation based on a thorough annexation study. Responsibility: Town Board 5. Develop and implement policies that require new development to "pay its own way". a. These policies would direct the Town to conduct a detailed fiscal impact analysis to assess the monies the Town collects from the proposed development (fees, property taxes, sales tax, etc.) and the projected expenditures by the Town to serve the proposed development. b. Study the feasibility of implementing impact fees for new development. 3 c. Reassess fee schedules periodically and adjust fees as the Town's costs to provide the service change. Responsibility: Town Board 6. Promote small local business opportunity, thus providing jobs and income for local residents and also promoting -the small town ambience. a. Explore creation of a small business incubator, revolving low interest loan pool; small business support group and the creation of the neighborhood business zone which encourages small businesses, etc. b. Develop and adopt regulations to permit controlled home occupation activity for the production of arts and crafts in an accessory structure with standards to protect neighbors from adverse impacts. Responsibility: Town Board, Planning Board, and Chamber of Commerce 7. Promote and protect the historic business district. Responsibility: Town Board and Historic Commission C. Control Growth to Enhance and Complement Hillsborough. 1. Control. growth through infrastructure development (both location and timing) to provide an efficient service area, complementary balance of land uses with adequate public facilites (water, sewer, streets, parks, walkways, police protection, fire .protection, etc.). a. Utilize zoning regulations and coordination with NC DOT to control access to development along thoroughfares. b. Prepare for NC DOT roadway improvement projects prior to construction by having in place appropriate zoning regulations/districts to.control new development. Responsibility: Town Board and Planning Board 2. Coordinate with Orange County on land use policy, infrastructure development and development review in the Cooperative Planning Area Responsibility: Town Board and Planning Board 3. Protect the environment in both new and existing developments. a. Develop and adopt regulations restricting the development of sensitve lands (floodplains, steep slopes, perennial stream corridors) b. Develop industries. c. Develop and Federal d. Develop accordance and adopt zoning regulations to control polluting policies and procedures to coordinate with State Agencies on environmental review and regulation. and adopt watershed protection regulations in with State guidelines. 4 e. Promote transportation alternatives to the private passenger vehicle for bikeways, walkways, and public transit to RTP, Durham and Chapel Hill through policy, public education, TIP recommendations, zoning and subdivision regulations. g. Continue to implement and expand landscaping requirements. h. Develop and implement an urban forestry programa Responsibility: Town Board, Tree Board and Planning Board 4. Provide for a diversity of residential opportunity while protecting existing neighborhoods from encroachment by negative elements. a. Create a Housing/ Neighborhood Task Force to study these objectives and other housing issues and to . make recommendations to the Town Board. b. Develop and adopt zoning regulations to permit some infill in established neighborhoods and to protect the neighborhood qualities of open space, vegetation and intricate scale. New development in established neighborhoods should reflect the setbacks, spacing, building type, height, materials and scale of the neighborhood. c. Develop'policies and zoning regulations to encourage the dispersal of small scale pockets of multi family throughout the residential areas to provide a diversity of residential opportunity while maintaining the small town character and ambience of Hillsborough. d. Develop policies and zoning regulations to allow multiple residential units on the second floors of business buildings in the downtown area via a Special Use Permit Procedure. e. Control the location of multifamily zoning districts to discourage the creation of large areas of multifamily and to encourage multifamily in several parts of Hillsborough. Responsibility: Town Board, Planning Board and Housing/Neighborhood Task Force. 5. Encourage citizen participation and input in planning issues. a. Provide clear accurate information to the public, in a consistent format available in time to allow public response. b. Involve a diversity of citizens to participate on public boards and.. committees.(Housing Neighborhood Task 'Force, Planning Board, Historic Commission, Recreation Task Force, Parks Committee, Appearance Commission and Tree Board). c. Hold an annual public forum. Responsibility: Town Board 8. Review the 2010 Comprehensive Plan periodically and update to adapt to actual conditions. 5 D. Maintain and improve public services and public facilties. 1.Improve and diversify transportation systems. a. Coordinate and participate with NCDQT and Orange County on thoroughfare planning. Include bikeways and sidewalks in the Transportation Improvements Projects recommendations from the Town. Work with NC DOT on the design criteria of individual projects to provide features to meet the needs of Hillsborough (example: berms and landscaping on the proposed by-pass) b.. Support changing weight limits to prohibit truck traffic on Churton Street through the Historic District and the rerouting of truck traffic on alternate routes. c. Promote and provide for non -vehicular transport systems including sidewalk, walkway and bikeway facilites through Subdivision requirements, NC DOT TIP process, capital expenditures, Zoning Ordinance development standards, etc. d. Encourage, support and participate in regional transit studies and projects which link Hillsborough to RTP,'Durham, and Chapel Hill. e. Study the feasibility of an in -town shuttle providing access'to the downtown area for County office employees and tourists from parking areas convenient to both tourists and commuters. Responsibility: Town Board with the coordination and cooperation of Orange County and the Chamber of Commerce. 2. Reinstate the parks and recreation task force with a detailed agenda to study and prioritize recreational needs of Hillsborough citizens, establish a recreation master plan and coordinate with other bodies of government. Projects to be explored include the development of Occoneechee' Park, providing sports programs, establishment of a downtown riverfront park, creation of a public swimming pool, providing pedestrian linkage between Occoneechee Park and the downtown riverfront, creation of a multi -purpose 'town recreation center, acquisition of park lands, and the establishment of walkways and bikeways. Create subcommittees to concentrate on individual recreation priorities., a. Coordinate with Orange County on the mutual .need for a downtown'riverfront park and the development of a park as it relates to County office expansion downtown. b. Support and implement a tax increase to fund capital recreation improvements. Tie the tax increase to a bond referendum. c. Coordinate with NCDOT to obtain funds to use in bikeway construction. Recommend specific projects for the TIP funding. d. Encourage volunteers to'contribute time; materials, land and effort to support Town recreation. e..Coordinate with local schools (public and private) for use of facilities for Town sponsored recreation programs. f. Responsibility: Town Board n r 7 U ZONING DISTRICT DESCRIPTION 'ERMITTED.USES IN NEW DISTRICT NOT ALLOWED IN OLD DISTRICT: The only use allowed in MF (Multi -Family) not allowed in other residential zoning district is the Multi -Family Dwelling after a Site Plan Review. FUTURE REQUIREMENTS Site Plan Review is required according to Section 5.19 - some of those requirements are: paved driveways and parking, served by public water and sewer, a recreation area and open space of 5%. If townhomes or condominiums are built, Section 5.17 is also required, (- The allowable density is 6 units per acre. With 16.43 acres, a maximum of 98 dwelling units could be allowed. Townhomes require subdivision and its requirements. 4 SUBDIVISION TEXT AMENDMENT - TIME PERIOD FOR PRELIMINARY PLATS: The Planning Board has asked that this item go to Public Hearing on January 22, 1991. The Planning Board also asks for our Town Attorney's comments regarding the proposed amendment. THE PROBLEM: After a Preliminary Plat is approved, the developer must prepare and have approved engineering plans for: street construction, stormwater management, water and sewer. Besides financial arrangements and the approval of plans, the .developer must,also construct or bond the roads. It appears one year is not long enough to have this all completed thus two years is now being recommended. Also, there is no provision in our ordinance for extensions of the time period and this is provided for in the proposed amendment. Preliminary Plan 3.D.1 At least twenty (20) copies (separately folded) of a Preliminary Plan of a proposed subdivision shall be submitted to the Planning Department for action by the Planning Board within eighty- five (85) days of receipt of said copies. Failure of the Planning Board to act in the eighty-five (85) days shall be deemed approval of the said plan, unless the subdivider should waive this requirement and consent to an extension of the said period of gime. A Preliminary Plan with Planning Board recommendations shall be sub - witted to the Town Co=.,,issioners for their action within fortyreight (48) days of the of the Planning Board meeting at which the Planning Depar,tment's report is submitted to the Planning Board. Failure of the Board to act within forty-eight (48) days shall be deemed approval, unless the subdivider should waive this requirement and consent to an extension of said period of time. One (1) copy of the Preliminary Plan, accompanied by a notification of the action of the Planning Board and the Town Commissioners shall be returned to the subdivider. Approval shall be valid for one (1) year. ;DROPOSEb Approval shall be valid for two (2) years. The Planning .Board may extend for a period up-to—six .six months from the date when a preliminary subdivision plan would otherwise expire it it concludes that: the preliTpinary plan has ' not yet expired, the property owner or agent has proceeded with due diligence and in good faith, and conditions have not changed so substantially as to warrant a new application. Successive extensions may be granted for periods up to six months upon the same findings. Thi-s.paragraph shall be applicable to all preliminary plans approved since Julv 20, 1988._ SUBDIVISION TEXT AMENDMENT - ADDITIONAL PLAT EXEMPTION: The Planning Board has asked that his item go to Public Hearing on January 22, 1991. This text amendment would allow the planning director to "sign off" on the old plat presented by Jerry Stone so he could record the plat in the Register of Deeds' office. AN ORDINANCE AMENDING THE TOWN OF HILLSBOROUGH SUBDIVISION REGULATIONS TO EXEMPT CERTAIN PLAT RECORDATIONS FROM THE TOWN'S SUBDIVISION REGULATIONS THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLSBOROUGH ORDAINS: ;Section 1. The Hillsborough Subdivision Regulations are hereby amended by adding a new subsection (6) to the definition of the word "Subdivision" found in Section 2 to read as follows: (6) The recordation of a plat depicting lots previously shown on an unrecorded plat, which lots and unrecorded plat are specifically referenced in a deed recorded prior to March 13, 1978. The intent of this sub -part is to exempt property conveyed prior to March 13, 1978 in reference to an unrecorded subdivision plat. Section 2. All ordinances in conflict with this ordinance are hereby repealed. Section 3. This ordinance shall become effective upon adoption. MINUTES HILLSBOROUGH TOWN BOARD PUBLIC HEARING JANUARY 22, 1991 The Hillsborough Town Board met jointly with the Hillsborough Planning Board on.Tuesday, January 22, 1991, 7:00 PM. The purpose of the meeting was to conduct a quarterly Public Hearing. Those present for the meeting were Mayor Johnson, Commissioners Rose,•Lorenz, Smith and Lloyd. Commissioner Rile) was absent. Planning Board members present were Chairman William Crowther, Members Margaret Moore, Ken Chaivous, Wayne Tilley, Stephen Jones, Richard Simpson., Leif Deetjen and Wendy Olson. Others present were Janet Rigsbee, Planning Director, Town Manager Phillip Whitaker, Betty June Hayes, Mr. and Mrs. William Byrd, Mr. & Mrd. W. F. Dodson, Mrs. Wayne Tilley, Manley Palmer, Marianne Wolf, William A. Shambley, Bobby Mangum, J. E. Latta, Coleen Shambley, Dr. Joseph Gatewood, Beverly and Katherine Webb, Tom Roberts, Jane Dallas, William Shannon, Francis Chandler, Phil Ray, William Price, Hervey McIver, Blak( Dickerson and Wesley Hyatt from the newspapersand Agatha Johnson, Town Clerk. The Mayor called the meeting to order and turned the meeting over to the Chairman of the Planning Board, William Crowther, who presided. Mr. Crowther reviewed procedures of conduct for the Public Hearing and then asked Janet Rigsbee to outline the items to be considered. Item 1: VISION 2010 - review of goals and objectives of the proposed comprehensive plan and questions regarding the plan. Ms. Rigsbee read the Mission Statement of the 2010 Comprehensive Plan. Goals and Objectives of the plan are: 1. Maintain and Improve the appearance of Hillsborough 2. Improve and protect the economic vitality of Hillsborough 3% Control growth to enhance and complement Hillsborough 4. Maintain and improve public services and public facilities Chairman Crowther asked if there were any comments regarding the Goals and objectives? William Shannon stated he had just moved to Hillsborough and hoped the low density in growth will remain. He likes the old fashion atmosphere with less extensive development than in Durham. Commissioner Rose, Chairman of the Vision 2010,stated a final report will be submitted to the Board in April, 1991. Minutes - Page two PUBLIC 14CETING January 22, 1991 Item 2: Rezoning Request of Dr. Joseph Gatewood to rezone 16.43 acres on the North Side of Hwy 70 from R-40 to MF (multi -family. The Planning Director stated that preliminary activity had not been fulfilled as required by the Ordinance in that Mr. & Mrs. William Byrd did not get a notice of the meeting. Mr. Byrd is an adjoining property owner. According to the Ordinance, another public hearing must be called. Other property owners who were present at the meeting asked to be heard I since effort had been made to be at the meeting. Members of the Town Board agreed to hear those present, however, another public hearing will be called + for Monday, February 11, 1991. Item 2 will be heard following the review of other agenda items. Item 3: Subdivision Regulation Text Amendments a. Currently, only one major subdivision has expires (Hampton Point) and the pro- posed amendment is retroactive to include this subdivision. Manley Palmer asked is this amendment is for single family only? The reply was for all major subdivisions. Ms. Rigsbee stated the attorney has reviewed the amendment and is fine as written. Item3.b: Amendment to add an exemption..to the definition of subdivision to allow for recordation of certain old surveys. Ms. Rigsbee stated the amendment would allow the planning director to "sign off" on the old plat presented by Jerry Stone so he could record the plat in the Register of Deeds Office. The amendment states "the recordation of a plat depicting lots previously shown on an unrecorded plt, which lots and un- recorded plat are specifically referenced in a deed recorded prior to March 13, 1978. The intent of this sub -part is to exempt property conveyed prior to Marc' .13, 1978 in reference to an unrecorded subdivision plat." Betty June Hayes, Register of Deeds, stated from a records aspect, the !adoption of this amendment would have tremendous importance since many plats lwere not recorded in eary days. She encouraged the Board to adopt the amendmen Mr. Crowther asked if others wished to speak and hearing no comments de- clared the Joint Public Meeting. Item 2: Rezoning Request of Drz Joseph Gatewood to rezone 16.43 acres from R-40 (Residential) to MF (Multi -Family) Ms. Rigsbee stated density requirements would allow 98 multi -family units to be located on the property. A site plan review would be required, the area would be served by Town water and sewer or an approved septic system. The current use of the property is three residences with a pond and woods. The property is burr'.ounded on the north by woods, on south by cemetery, east by one residence and woods and on the west by Byrd's Shopping area and woods. A Site Plan Review would require paved driveways and parking, a recreation area and open space of 5 percent. Commissioner Smith asked if an entrance could come from Orange High Road Land the reply was no, the property does not extend that far. Margaret Moore asked if the Department of Transportation would approve the driveway access and the reply was yes since Hwy 70 is a State Highway. William Byrd asked if Dr. Gatewood could sell the property after.the re- I zoning and would the rezoning go with the property. The reply was yes he coulJ sell the property and the zoning goes with the property. Francis Chandler asked about the entrance into Highway 70 and if the Town had a plan. DOT then reviews the plan and makes recommendatii Dr. Joseph Gatewood expressed his appreciation to the Board for allowing the input;- He stated he was unprepared to defend the proposal, but stated his history follows him. He has no intention to rape the land. William Shannon asked what is the present zoning and density per acre? Ms. Rigsbee stated the land is zoned 40,000 per lot which would permit 16 to 18 lots. Beverly Webb asked how does the proposal dovetail with the 2010 Plan? Ms. Rigsbee stated the 2010 Plan addresses housing, the appearance of entranceways into Hillsborough along U. S. 70, develops policies and regulation to protect the small town scale of Hillsborough and requires that new develop- ment occur in similar complementary scale components to the Historic District; controls the location of multifamily zoning districts to discourage the creatio of large areas of multifamily and to encourage multifamily in several parts of Hillsborough. Commissioner Rose reminded those present that the 2010 Plan has not been adopted. William Shambley stated his concern with the number of people involved in the traffic on Highway 70. He stated the traffic situation was already hazardous. Betsy Tilley stated'she has lived in the Orange High area since 1965. Her surrounding area is all single family and she wants it to stay that way. Multi family would devalue her property. The curient'.tra£fic problem would only be made worst with the multifamily project. Bob Mangum, a resident of Orange High Road, stated he was against the project, that the traffic problem would be made worst. William Byrd stated he was opposed to the project for all the reasons given. He purchased his property years ago with the intent of spending his latter yea s in a good single-family neighborhood. Bill Wincoff stated he was opposed to the project and hoped it would stay single family. J. E. Latta stated he was not in favor of the multi -family zoning, addition1 traffic would create new hazards. He objected to the multi -family zoning.
