HomeMy Public PortalAbout020-1982 - Amending Chapter 154 - Zoning - Manufactured HomesORDINANCE NO. 20-1982 AN ORDINANCE AMENDING CHAPTER 154 OF THE 1,1UNICIPAL CODE, BEING ORDINANCE 140. 2325-1968, COMMOPLY IdVM AS THE ZONING ORDINANCE OF THE CITY OF RIC1VOND, INDIANA, PROVIDING FOR STANDARDS AND REQUIREMENTS RELATIVE TO M TUFACTURED HOBS PURSUANT TO I.C. 36-7-4-1106. WHEREAS, the General Assembly of the State of Indiana, by the Acts of 1981 added a new Section 1106 to Title 36, Article 7, Chapter 4, of the Indiana Statute being designated I.C. 36-7-4-1106 and thereby providing for standards and re- quiraments relative to the placement and installation of manufactured homes; and, WHEREAS, it is the intent and purpose hereof to amend the Zoning Ordinance of the City of Richmond, Indiana to comply with I.C. 36-7-4-1106; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 1st day of June, 1982 at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the City Plan Commission was 9 to o in favor of/in opposition to recommending the passages Ordinance No. 20-1982. NOW THEREFORE BE IT ORDAINED by the Comnon Council of the City of Richmond, Indiana as follows: SECTION 1. That Article 13 of Chapter 154 of the Municipal Code shall be amended as follows: 13.26 Dwelling: Any building or portion thereof designed or used exclusively as the residence or sleeping place of one or more persons, but not including a tent, boarding or lodging house, motel, hotel, tourist home., and except when located in an approved mobile home park, a mobile home. The length and width of any dwelling shall not be less than twenty-three (23) feet as measured at its least length and width; except when located in an approved mobile home park. 13.94 Manufactured Home: Means a dwelling, designed and built in a factory, which bears a seal certifying that it was built in compliance with the Federal Manufactured Housing Construction and Safety Stan- dards Law (1974 U.S.C. 5401 et seq.). Said manu- factured home shall have been constructed after January 1, 1981, shall exceed nine -hundred fifty (950) square feet of occupied space, and shall be installed on a permanent foundation. A manufactured home shall be sided with one or more of the following siding materials: 1. residential horizontal altm,irn m, lap siding; 2. residential horizontal vinyl lap siding; 3. residential horizontal steel lap siding; 4. cedar or other wood siding; 5. woodgrain, weather resistant, pressboard siding; 6. stucco siding; 7. brick or stone siding; and a manufactured home shall be roofed with one or more of the following roofing materials: ORDINANCE NO. 20-1982 Page 2 1. asphalt shingles; 2. fiberglass shingles; 3. shake shingles; 4. asbestos shingles; 5. the materials; 6. slate shingles. 13.95 Mobile Horne: Means a residential dwelling unit, larger than three hundred twenty (320) square feet of occupied space, designed and built in a factory, which bears a seal certifying that it was built in compliance with the Federal Manu- factured Housing Construction and Safety Standards Law (1974 U.S.C. 5401 et seq.). Said mobile home may be installed with or without a permanent foundation when connected to required utilities. 13.96 Occupied Space: Means the total area of earth horizontally covered by the structure, excluding accessory structures such as, but not limited to, garages, patios and porches. 13.97 Recreational Vehicle: Any portable vehicular structure not built to the Federal Manufactured Housing Construction and Safety Standards law (1974 U.S.C. 5401 et seq.), designed to provide temporary living quarters for recreational, camp- ing or travel use, including but not limited to travel trailers, collapsible trailers, truck campers, motor hones and multi -use vans. As such, they are intended for temporary residential uses and shall not be occupied outside an approved Recreational Vehicle Park. SECTION 2. That Article 15 of Chapter 154 of the Municipal Code shall be amended by adding the following: 15.19 Manufactured Homes Prohibited; Manufactured Homes shall be prohibited in historic districts entered on the National Register of Historic Places and/or in historic districts designated by the Richmond Commn Council. SECTION 3. That Article 20 of Chapter 154 of the Municipal Code shall be amended by adding the following: 20.025 Manufactured Home: One -Family manufactured home. SECTION 4. That Article 22 of Chapter 154 of the Municipal Code shall be amended by adding the following: 22.003 Manufactured Home: One -family manufactured home. SECTION 5. That Article 24 of Chapter 154 of the Municipal Code shall be amended by adding the following: 24.006 Manufactured Home: One -family manufactured home. SECTION 6. That Article 25 of Chapter 154 of the Municipal Code shall be amended by adding the following: 25.010 Manufactured Hone: One -family manufactured home. SECTION 7. That Article 32 of Chapter 154 of the Municipal Code shall be amended as follows: 32.001 General: Any use permitted and as regulated in the C-2 District with the following exception: one and two- family dwellings and one and two-family manufactured homes are not permitted. ATTEST �, / s' Clerk CITY PLAN COMMISSION RICHMOND, INDIANA June 3, 1982 Mr. Kenneth Mills, President Members of Common Council and Mrs. .JJoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 20-1982 Plan Commission Case PC-82-8 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 1, 1982, on its petition requesting to amend the Zoning Ordinance to provide for standards and requirements rela- tive to manufactured homes. The proposed amendment has previously been discussed with Common Council in a meeting of the Committee of the Whole. The major features of the proposed Ordinance amends the Zoning Ordinance definition of "dwelling", add a new Zoning Ordinance definition for manufactured homes, which is consistent with IC 36-7-4-1106, prohibiting the placement of a manufactured home in a historic district, require Special Use Authorization for the placement of a manufactured home in the R-1 and R-2 zoning districts, and allow the placement of a manufactured home in a R-3, R-4, C-1 and C-2 zoning district as a permitted use. During the public hearing, no one spoke in opposition to the pro- posed zoning ordinance amendment. The Plan Commission voted nine (9) to zero (0) to recommend Ordi- nance No. 20-1982 be adopted.
