AN ORDINANCE ESTABLISHING A NEW SCHEDULE OF
RATES FOR ELECTRIC SERVICE RENDERED BY RICHMOND
POWER & LIGHT, THE MUNICIPAL ELECTRIC UTILITY
SYSTEM OF THE CITY OF RICHMOND, INDIANA AND
MATTERS RELATED THERETO.
WHEREAS, the City of Richmond is the owner of and engaged in
operating an electric utility system supplying said City and the in-
habitants thereof with electricity for public, domestic and industrial
uses under the style of Richmond Power and Light (R P & L)r and
WHEREAS, it has come to the attention of the Common Council of
the City of Richmond that R P & L is not currently earning sufficient
revenues to comply with the laws of the State of Indiana and the rate
of return heretofore established for R P & L by this Council; that
R P & L has been unable through operating economies and attempts to
increase its revenues to keep pace with the impact of inflation with
the result that R P & L's earnings are deficient; and
WHEREAS, Council has been advised by the Manager and staff of
R P & L that R P & L requires an increase in its rates; that said
rates should be redesigned to comply with the requirements of the
Public Utility Regulatory Policies Act and the requirements of the
Public Service Commission; and that consultants employed by R P & L
have recommended an increase in the electric service rates of R P & L
in an amount to increase the operating revenues i1.187with the electric
service rates being redesigned to comply with PURPA so that the orders
of the Public Service Commission of Indiana and the applicable statute,
IC 8-1-2-96 are complied with.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of Richmond as follows:
SECTION 1. That there shall be and there is hereby established
for the use and for the service rendered by the electric utility system
of the City of Richmond, Indiana known as Richmond Power & Light a new
schedule of rates and charges which have been redesigned to comply with
the requirements of the Public Service Commission of Indiana and the
Public Utility Regulatory Policies Act so as to yield additional reve-
nues to the utility of approximately i1.18%and that said schedule of
rates and charges is set forth in Exhibit "A", attached hereto and
made a part hereof. That the rates approved herein are hereby deter-
mined to be reasonable, just and nondiscriminatory and are established
for the use and for the electric service rendered by R P & L.
SECTION 2. That to the extent that such rates and charges are
sufficient to compensate the City of Richmond for taxes due the City
which would be paid on the electric utility property of R P & L were
it privately owned, same are hereby approved.
SECTION 3. That to the extent that said electric rates pro-
vide a reasonable return on the electric utility plant of R P & L,
same are hereby approved.
SECTION 4. That the General Manager of R P & L, its employees
and agents, are hereby authorized to secure the approval of said rates
by the Public Service Commission and to take any and all action that
is necessary to put said rates in effect for R P & L.
SECTION 5. That all ordinances and parts of ordinances in
conflict herewith are hereby repealed; provided however, that the ex-
isting schedule of electric rates shall remain in full force and ef-
fect until the schedule of rates fixed by this ordinance shall be
approved by the Public Service Commission of Indiana and further until
such time as the orders of said Commission approving said new rates
shall direct.
SECTION 6. This ordinance shall be in full force and effect
from and after its passage.

RATE R - RESIDENTIAL ELECTRIC SERVICE
AVAILABILITY
Available to residential customers including rural
customers for all domestic uses, in individual private
residences or dwellings and their appurtenances, when
all service is taken through one meter.
CHARACTER OF SERVICE
Alternating current, sixty Hertz, single phase at a
voltage of approximately 120 volts two -wire, 120/240
volts three -wire, or 120/208 volts three -wire in the
downtown network area.

MONTHLY MINIMUM CHARGE
The minimum charge shall be the Customer Charge.
SPECIAL TERMS AND CONDITIONS
1. Customers shall not have the privilege of taking
service for two or more separate residences through
a single meter under this rate, except that in the
case of an apartment house with a number of indiv-
idual apartments the landlord is given the option
of providing separate wiring for each apartment,
so that the Utility may supply and meter each apart-
ment separately under this rate schedule, or
instead of providing separate wiring for each
apartment, of taking the combined service under
this rate schedule with the minimum charge and the
quantity of kilowatt-hours in each block multi-
plied by the number of apartments in the building.
2. Service to equipment having highly fluctuating
characteristics which cause objectionable voltage
fluctuations will not be permitted under this rate.
Customers having such equipment can secure service
for this equipment under applicable power rates.

AVAILABILITY
RATE CL - COMMERCIAL LIGHTING SERVICE
Available to commercial customers for lighting, includ-
ing appliances, and for incidental power to motors not
to exceed 5 H.P. individual, or 15 H.P. aggregate capac-
ity, when such combined service is furnished through a
single metering installation.

CATV distribution line power supply equipment.

RATE GP - GENERAL POWER SERVICE
AVAILABILITY
Available to any Customer for general power purposes when
the Customer's largest individual power load exceeds
5 H.P. and/or the aggregate power load exceeds 15 H.P.
and/or the Customer has any three-phase power load served
from the overhead distribution system. Power load is
defined as electricity used for any purpose other than
lighting.
Incidental lighting is permitted provided Customer fur-
nishes insulating transformers, regulators and other
equipment necessary to take lighting from the power ser-
vice.

RATE*
Alternating current, sixty Hertz, at the standard distri-
bution voltage supplied by Utility in the locality for
which service is requested, and can be either single phase
or three phase dependent upon the facilities which are
available.

Service hereunder will normally be metered at a secondary
voltage, which is designated as a standard voltage of
approximately 480 volts or lower. At the option of
Utility, service hereunder may be metered at a primary
voltage, which is designated as a standard voltage of
approximately 2400 volts or higher, in which event, be-
fore computing the charges, the actual measurement of
energy shall be decreased by two and one-half percent
(220) to convert to the equivalent of service metered
at a secondary voltage.

MONTHLY MINIMUM CHARGE
The Monthly Minimum Charge shall be calculated at the
rate of $2.06 per horsepower or fraction thereof, for
the first 10 horsepower of connected power load, and at
the rate of $1.03 per horsepower or fraction thereof, for
all connected power load in excess of 10 horsepower, but
in no event, shall such Monthly Minimum Charge be less than
$10 . 30.
"Power Load" is defined as electricity used for any pur-
pose other than lighting.
Such connected power load, as used in the determination
of the Monthly Minimum Charge, shall be the sum of:
1. The horsepower rating of all connected motors, and
2. The rated input capacity of all power equipment
other than motors, each kilovolt -ampere of such
input rating being considered as one horsepower of
connected power load.
FLUCTUATING LOAD
Where the Customer's installation contains equipment
having intermittent or violently fluctuating character-
istics, such as welders, X-ray machines, fire pumps, ele-
vators, cranes, hoists, etc., the Customer shall, at his
own expense, install, operate and maintain such elec-
trical and/or mechanical devices that are necessary to
limit all fluctuation of voltage at the point of delivery,
not to exceed two percent (20) above or below the impressed
voltage at that point.
In the event the Customer desires and requests Utility
to increase transformer capacity, or to install separate
transformers, to render service to such equipment,
Utility may, at its own option, install transformation
of sufficient capacity to prevent undue voltage variation.
Such service will be metered and billed separately and
the monthly minimum charge for such service will be $.75
per KVA of required transformer capacity, but in no
event less than $7.50 per month.

TERMS AND CONDITION'S FOR RENDERING SERVICE
1. All service hereunder shall be furnished through
one meter.
2. Incidental lighting will be permitted provided
Customer furnishes necessary equipment to take such
lighting from the power service.
3. Utility will furnish and maintain at a single lo-
cation the complete substation that is necessary
to make one transformation to a standard voltage
from the voltage of such available transmission or
distribution line as the Utility deems adequate and
suitable to serve the requirements of Customer.
Not more than one such transformation will be in-
stalled at Utility's expense for any one Customer.
4. Should Customer require a non-standard voltage,
Customer shall, at his own expense, furnish and
maintain all transformers and protective equipment
therefor necessary in order to obtain such non-
standard voltage.
5. All wiring, pole lines, wires and other electrical
equipment and apparatus located beyond point of
connection of Customer's service lines with the
lines of Utility are considered the distribution
system of Customer and shall be furnished, owned,
and maintained by Customer, except in the case of
metering equipment and other equipment incidental
to the rendering of service, if any, that is furnished,
owned and maintained by Utility, and installed by-
yond point of connection.
6. In case a fire or other casualty shall render the
plant or premises of Customer wholly unfit for the
purposes of Customer's business, the minimum charge
specified shall be suspended until such time as the
premises shall have been reconstructed and reoccupied
by Customer. In case a strike or lockout causes
the temporary suspension of the operation or busi-
ness of Customer, the minimum charge specified will

be waived during the continuance of said strike or
lockout, but Customer shall be billed and be liable
for the payment, at the rates herein set out, for
all electric energy used during the period.

RATE LPS - LARGE POWER SERVICE
AVAILABILITY
Available to any Customer for large electric power
service for a specified capacity of not less than
60 kilovolt -amperes for service at one point of de-
livery.

MONTHLY BILLING DEMAND
The Monthly Billing Demand for any month shall be the
average number of kilowatts in the recorded 30-minute
interval for such month during which the energy metered
is greater than in any other 30-minute interval for
such month divided by the average power factor
(expressed as a decimal) calculated for the month.
The Monthly Billing Demand so determined shall be
corrected to the nearest kilovolt -ampere, but in no
month shall be less than 60 kilovolt -amperes.
Maximum demand shall be measured by suitable recording
instruments and energy shall be measured by suitable
integrating instruments, all provided by Utility.
MEASUREMENT OF MAXIMUM DEMAND AND ENERGY
Service hereunder will normally be metered at a second-
ary voltage, which is designated as a standard voltage
of approximately 480 volts or lower. At the option of
Utility, service hereunder may be metered at a primary

voltage, which is designated as a standard voltage
of approximately 2400 or higher, in which event, be-
fore computing the charges, the actual maximum demand
measurements shall be decreased by one percent (1%) and
the actual energy measurements shall be decreased by
two and one-half percent (220) to convert to the equiv-
alent of service metered at a secondary voltage.
MONTHLY MINIMUM CHARGE
The monthly minimum charge shall be the Demand Charge.
DEMAND CHARGE - CREDITS
A credit will be made tc the Demand Charge when
Customer takes service at the point of connection of
his service lines with Utility's primary transmission
or distribution lines having a voltage of 2400 volts
or higher and Customer furnishes, installs, and main-
tains, at his own expense, the complete substation
structure and equipment, including switches and pro-
tective equipment, transformers, and other apparatus,
any or all of which is necessary for Customer to
utilize service at said voltage and said point of con-
nection.
In such event, the credit for each month shall be
calculated by multiplying the kilovolt -amperes of
Billing Demand by the unit credit for the applicable
delivery voltage shown in the following table:

3. Utility will furnish and maintain at a single
location, except for those Customers electing
to furnish their own transformation, the complete
substation that is necessary to make one trans-
formation to a standard voltage from the voltage
of such available transmission or distribution
line as the Utility deems adequate and suitable
to serve the requirements of Customer.
Not more than one such transformation will be
installed at Utility's expense for any one
Customer.
4. Should Customer require a non-standard voltage,
Customer shall, at his own expense, furnish and
maintain all trnasformers and protective equipment
therefor necessary in order to obtain such non-
standard voltage.

RATE IS - INDUSTRIAL SERVICE
AVAILABILITY
Available to any Customer for industrial power service
at the line voltage of 13,800 volts. Customer shall con-
tract for a specified capacity of not less than 1000
kilovolt -amperes for service at one point of delivery.

Alternating current having a frequency of sixty Hertz
and furnished in accordance with the provisions set forth
hereunder.
DEMAND CHARGE (MONTHLY)
Each kva of Monthly Billing Demand $6.479 per kva

all necessary metering equipment.

RATE OL - OUTDOOR LIGHTING SERVICE
AVAILABILITY
Available, only for continuous year-round service, to
individual Customers for outdoor lighting on private
property.

For each lamp with luminaire and an upsweep arm not over
6 feet in length, controlled by a photoelectric relay,
when mounted on an existing Utility pole and service
supplied from existing secondary facilities.

When facilities not provided for in the above charges
are installed by the Utility to furnish the lighting
service, Customer will, in addition to the above monthly
charge, pay in advance the installation cost of such
facilities extending from the nearest, or most suitable
pole of the Utility, to the point designated by the
Customer for the installation of the lamp.
CONTRACTS
Contracts under this rate schedule shall be for not less
than one (1) year for residential or farm Customers,
not less than three (3) years for commercial or indus-
trial Customers, and not less than (5) years for
other Customers. The Utility reserves the right to
include in the contract such provisions as it may deem
necessary to ensure payment of bills throughout the
term of the contract.
HOURS OF LIGHTING
All lamps shall burn approximately one-half hour after
sunset until approximately one-half hour before sunrise,
each day in the year, approximately 4,000 hours per year

OWNERSHIP OF FACILITIES
All facilities necessary for service hereunder, including
fixtures, controls, poles, transformers, secondary lines,
lamps and other appurtenances shall be owned and main-
tained by Utility. All service and necessary maintenance
will be performed only during regular scheduled working
hours of Utility. Non -operative lamps will normally
be restored to service within 48 hours after notification
by Customer.
OTHER TYPES OF LIGHTING
When Customer requests the installation of lighting of a
type and kind other than that set forth in this rate
schedule, the monthly lamp charge shall be computed by
the same formula and in like manner as the rates so
designated.

RATE M - MUNICIPAL STREET LIGHTING SERVICE
AVAILABILITY
Available to the City of Richmond for the lighting
of any city street, alley, or park, within the corporate
limits. This rate schedule is applicable for service
when supplied through existing, new, or rebuilt street
lighting systems, including an extension of such street
lighting system to additional locations where service
is requested by the City, provided that the equipment

STREET LIGHTING FACILITIES
All facilities necessary for service hereunder includ-
ing fixtures, controls, poles, secondary lines, trans-
formers, lamps and other appurtenances shall be owned
and maintained by Utility.
HOURS OF LIGHTING
All lamps shall burn approximately one-half hour after
sunset until approximately one-half hour before sunrise
each day in the year, approximately 4000 hours per year.
OTHER TYPES OF LIGHTING
When City authorizes the installation of street lighting
of a type and kind other than that set forth in this

RATE K - RESIDENTIAL AND OFF-PEAK WATER HEATING SERVICE
This Schedule, K, is in the process of elimination and is
withdrawn except for customers served hereunder prior to
October 19, 1950, and will not be applicable to any future
customers. If service hereunder is at any time discontinued
at the Customer's option, this Schedule shall not again be
available.
AVAILABILITY
Available to residential customers for all domestic
uses including off-peak water heater service in indi-
vidual residences or dwellings and their appurtenances
when all such service is taken through one meter.
Customer must have installed and in regular use a stor-
age type water heater having a total minimum capacity
of not less than fifty (50) gallons and which otherwise
meets the Utility's requirements.
The Customer's entire service shall be measured through
one meter equipped with dual dial and time switch. The
"off-peak" period shall be from 10 o'clock P.M. to
6 o'clock A.M. and all energy used during this period
shall be registered on the so-called "night dial".
The "on -peak" period will be from 6 o'clock A.M. to
10 o'clock P.M. and all energy used during this period
shall be registered on the so-called "day dial", the
Utility reserving the right to change the time of the
"off-peak" period to conform to the "off-peak" condi-
tions of the Utility.
The Utility will furnish and install a time switch to
control either or both of the elements of the water
heater so that its use can be confined to the "off-peak"
period designated above on the request of the Customer.

SPECIAL TERMS AND CONDITIONS
1. The rate included in this schedule is available
only for residential service to an individual
residence or dwelling designed and arranged to pro-
vide living quarters for one family. Customers shall
not have the privilege of taking service for two
or more separate residences through a single meter
under this rate schedule, except that in the case of an
apartment house with a number of individual apart-
ments the landlord is given the option of providing
separate wiring for each apartment, so that the
Utility may supply each apartment separately under

RATE CWH - CONTROLLED WATER HEATING SERVICE
This Schedule, CWH, is in the process of elimination and is

AVAILABILITY
Available to residential and commercial customers for
separately metered controlled service to storage type
water heaters during the off-peak hours between 10:00
P.M. and 6:00 A.M. or such other hours as are established
by Utility, but totaling not less than eight (8) hours
each day, when the water heater has a storage tank of
50 gallons or more capacity and which otherwise meets
Utility's requirements. During hours when use under
this schedule is not permitted, energy may be taken
through the upper element of a 2-element heater, but it
will be metered and billed with service at the applicable
residential or commercial rate schedule. Customer must
be a user of Utility's service under some other rate

AVAILABILITY
Available only for continuous year-round service
requirements to apartment buildings, where there is
installed and in regular use an approved type of elec-
tric heating equipment as the primary means of space
heating, either by a central electric heating system
for the entire building, or individual electric space
heating systems in each apartment unit and service
areas. Also installed and in regular use as the princi-
pal source of supply, a standard approved type central
electric water heating system, or individual electric
water heaters in each apartment unit and service area.
This rate will not be available for the supply of elec-
trical service to those areas of the building which
are used for commercial purposes, such as retail stores,
business offices, a rental office, or for the mainte-
nance of facilities other than found in the individual
apartments.

SPECIAL TERMS AND CONDITIONS
1. Service under this schedule shall be supplied
at one voltage through one meter to each apart-
ment unit, or service area. Should the land-
lord so desire, service will be supplied at one
voltage through one meter at one location for the
entire building in which case the minimum charge
and the quantity of kilowatt-hours in each block
of the above schedule, for billing purposes,
shall be multiplied by the number of apartments
and service areas within the building.
2. This schedule will apply to apartment buildings

2. No other electrical equipment will be permitted to

Fuel Cost Charge
Applicable to All Metered Rate Schedules
A. The energy charges set forth in all metered rate schedules
and those energy charges that are either included in the
capacity or demand charges of such rate schedules or in
the minimum billings under such rate schedules shall
be increased or decreased, to the nearest 0.001 mill
($.000001) per KWH, in accordance with the following
factor:

1. "F" is the estimated expense of fuel based on a
three month average cost beginning with the month
immediately following either the current calendar
month or the current billing cycle month and con-
sisting of the following costs:
(a) the average cost of fossil fuel consumed in
the Utility's own plants, including only those
items listed in Account 151 of the Federal
Energy Regulatory Commission's Uniform System
of Accounts for Class A and B Public Utilities
and Licensees;
(b) the actual identifiable fossil and nuclear fuel
costs associated with energy purchased for
reasons other than identified in (c) below;
(c) the net energy cost, exclusive of capacity or
demand charges, of energy purchased on an
economic dispatch basis, and energy purchased
as a result of a scheduled outage, when the
costs thereof are less than the Utility's fuel
cost of replacement net generation from its
own system at that time; less
(d) the cost of fossil fuel recovered through
inter -system sales including fuel costs re-
lated to economy energy sales and other energy
sold on an economic dispatch basis.
2. "S" is the estimated kilowatt-hour sales for the
same estimated period set forth in "F", consisting

B. The factor as computed above shall be further modified

Wholesale Power Adjustment
Applicable to All Metered Rate Schedules
The energy charges set forth in'all metered rate schedules
and those energy charges that are either included in the
capacity or demand charges of such rate schedules or
in the minimum billings under such rate schedules shall
be increased or decreased, to the nearest 0.01 mill
($.00001) per KWH based on a Purchased Power Cost Adjust-
ment Tracking Factor occasioned solely by changes in the
cost of purchased power, in accordance with the Order of
the Public Service Commission of Indiana, approved
December 17, 1976, in Cause No. 34614.
Effective for all bills rendered beginning with and subse-
quent to the 1982 billing cycle, the wholesale
power adjustment charge shall be $0. per kilowatt-hour.
