HomeMy Public PortalAbout027-1982 - Amending Chapters 154 - Zoning - 1434 S. 9thGENERAL ORDINANCE NO. 27-1982 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, CCIMNLY KN(XJN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1434 SOUTH 9TH STREET FROM C-2 C9M MCIAL DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 desig- nates and describes as C-2 Commercial District the property located at 1434 South 9th Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classi- fication of said property from C-2 Commercial District to C-4 General Business District; and, WHEREAS, a study of this Ordinance was conducted by the Ricl mnd City Plan Commission the 22nd day of June, 1982, at which time remon- strances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was six (6) to zero (0) in favor of recommending the passage of Ordinance No. 27- 1982. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-4 General Business Dis- trict and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amend- ments thereto. The following described real estate situated in the City of Richmond, Wayne County, State of Indiana, to wit: Lots 30, 31 and 32 in the Beallview Addition SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. July 1, 1982 Mr. Kenneth Mills, President Members of Common Council. and Mrs. JoEllen Trimble, City Clerk Mmicipal Building Richmond Indiana 47374 Re: Ordinance No. 27-1982 Plan Commission Case PC-82-9 Dear Mr. Mills, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 22, 1982, on the petition of Thomas Edward Bond and David M. Muff, owners; Robert Burton, Agent, requesting to rezone property located at 1434 South 9th Street from C-2 Conmercial District to C-4 General Business District. Ten (10) notices of public hearing were sent to surrounding prop- erty owners with none returned. During the public hearing, no one spoke in favor of or in opposition to the request. The Plan Commission voted six (6) to zero (0) to recommend the adoption of Ordinance No. 27-1982 and pursuant to IC 36-7-4-607 made the following finding: 1. There are numerous C-4 uses in the surrounding area so that the requested C-4 zoning is compatible with the prevailing land use, thus the rezoning should not be harmful to the general public interest. 2. The proposed rezoning would not have a substantial affect on the use or value of adjacent property. 3. The present zoning classification of the property does not accurately reflect the existing land use. 4. The body shop use of the property is a use first permitted in a C-4 zoning district. The non- conforming use status of the body shop prevents the owner from expanding his business and thus creates a hardship.
