Request of Norman Walker to Rezone 11.01 acres south of King James Street from AR (Agricultural Residential) to R-10 (Residential)(Tax Map #4.38.A.2B). 3. To receive public input concerning the Comprehensive Housing Affordability Strategy for Orange County. Federal legislation requires local governments to prepare this plan to be eligible to receive Community Development Block Grant funding. 4. To receive public input concerning the NC Environmental Management Commission's Watershed Classification for .the Town of Hillsborough area. 5. Zoning Ordinance Text Amendments: a. To amend Section 8.8.4 regarding banners and banner permits. b. To amend the definition of Variance. 6. Close the Public Hearing Substantive changes in the proposed amendments may be made by the Town Board following Public Hearing. FOLLOWING THE PUBLIC HEARING, THE TOWN BOARD SHALL CONVENE INTO SPECIAL CONTINUED SESSION TO CONSIDER THE FOLLOWING: 7. Comments from the Chair. 8. Resolution evidencing the adjournment of the Regular meeting held October 14 continuation to October 22, 1991. 9. Resolution authorizing the Sale of Bond by the Town of Hillsborough. 10. Police Department a. Commissioner Smith proposes a Drug Prevention Program for Elementary School students. b. Amendment to Section 6 (Traffic) of Town Code to allow for 2 -Hour and 15 -Minute parking on certain town streets. 11. Smith, Wade Watkins, Nickey Riley, Morris Casper,.Mrs. Roscoe Riley, Manley Palmer ITEM #1: Mayor Johnson called the meeting to order at 7:10 PM, read the Public Charge, and turned the gavel over to Planning Board Chair Sam Jones who'welcomed everyone to the hearing. ITEM #2: The request of Norman Walker to re, -zone 11.01 acres south of King James Street from AR (Agricultural Residential) to R-10 Residential was presented by Coe. He -reviewed the location, ordinance requirements, permitted uses; site considerations, and the subdibision process. I Evelyn Hicks, -acting as spokesperson for those present who opposed the rezoning,addressed the Boards noting the same rezoning had been denied in 1981. She read from the minutes noting the request had been denied due to accessibility, lack of water and sewer, future water supply, railroad tracks, and safety factors. She also pointed out errors in the application including the fact that mention of slopes, drainage, and streams had been omitted. She also questioned the status of the railroad right-of-way and the access easement from King Charles Street. I Hicks pointed'out the staff review indicated there was a stream through the property that fed into the Eno River below the Ben Johnston Dam and said she felt the application had been misrepresented. She said they didn't want to see any development that would harm the water supply. Hicks said that previously signs had been erected and letters sent out 10 to 15 days before the hearing. She said she understood there had been some changes and that although the current ordinance requirements had been met, she felt better notification should have been given. She suggested the ordinance might be revised to allow for greater notifications, noting some who received letters were not able to come to the meeting. She asked if telephone'or written comment would still be considered and Coe said it would, noting a phone call from Hurley Dickey, Sr. in opposition to the rezoning. Hicks also pointed out that under the current zoning, residential development could still occur with the difference being that larger lots would be required. JOINT PUBLIC HEARING OCTOBER 22, 1991 PAGE 3 said he agreed with the points made by Hicks and pointed out that easements might be difficult and the additional development would result in increased traffic. He said that the land would be difficult to perk and said the loss of the rural character of the area was undesirable. Jones asked for a show of hands of those who were in favor of the rezoning and there were none, while 17 hands indicated opposition. Jones asked for further comment and there was none. ITEM #3: Coe reviewed the intent and purpose of the Comprehensive Housing Affordability!Strategy for Orange County. He noted that federal legislation required local governments to prepare this plan to be eligible to receive Community Development Block Grant funding and this public hearing was to receive any input concerning this requirement. iHe said a draft was available for public viewing. Smith -asked i� this type of housing was allowed would the owners have to pay taxes and water and sewer fees and Coe said yes, that the CHAS was not a regulation but just a needs assessment so that HUD could prioritize their fundingf: Olson asked if the money would be available to Habitat for Humabity and Rose pointed out anyone could apply including the town. Rose said an advantage of the CBDG program was to improved areas of town which would raise the tax valuation of the property. Coe said this was previously known as a Housing Assistance Plan and these were prepared by Orange County. Olson asked about specific data for Hillsborough and Coe said the section on town policies had already been submitted and that staff would be working to compile the rest of the required data. Mayor Johnson said there was still substandard housing in Hillsborough and that future funding would greatly benefit the town. Hicks asked if an individual could receive this money and Coe said it was not likely because they would be in competition with the governmental jurisdictions whose needs were probably greater. Jones asked if there was any further comment and there was none. Chavious asked in regard to Item # 2 how many different property owners were present and asked if the objection was to building at all or the R-10 and Hicks indicated the objection was to R-10. Coe indicated that in 1981 the request was for apartments and one petition showed 148 citizens against the project and another showed 37 citizens for it. ITEM #4: Coe reviewed work to date concerning the NC Environmental Management Commission's Watershed Classification for the Town of Hillsborough area. He said a previous resolution to the Commission had requested the area around the town remain unclassified and that this item was scheduled to receive public input concerning this issue. Coe said in this case the Board of Adjustment would first determine if this was a use variance, and if not, then the variance would be asking for relief from Section 9 of the Zoning Ordinance which states that if non -conforming uses cease for more than six months, they cannot be replaced. Coe read the required findings of fact required to grant a variance from the ordinance and noted that a variance required a public hearing and notifications similar to the rezoning process. There being no further public comment, Jones returned the gavel to Mayor Johnson who declared the public hearing closed at 8:22 PM. a Respectfully Submitted, Joff, Coe, Secretary V
