4 ORDINANCE NO. 47-1982
AN ORDINANCE VACATING A CERTAIN PUBLIC WAY WITHIN THE CITY
OF RICHMOND, INDIANA, BEING THAT PORTION OF NORTH 17TH
STREET LOCATED BETWEEN NEW PARIS PIKE AND THE SOUTHERN END
OF THE NORTH 17TH STREET BRIDGE.
WHEREAS, the Richmond Board of Public Works and Safety has
petitioned the Common Council requesting vacation
of that portion of North 17th Street located between
New Paris Pike and the southern end of the North 17th
Street Bridge; and,
ITIEREAS, the Common Council, pursuant to the provisions of
I.C. 36-7-3-12, conducted a public hearing on said
vacation petition on ,�,�1982;
and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission the 3 ; day of �
1982, at which time remonstrances were hear rom al
parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the Richmond City Plan Commission was
to (: in favor of/in eppcw-i_tion-to recommending
passage of Ordinance No. 47, 1982.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of Richmond, Indiana, as follows:
SECTION 1. That subject to the preservation of all easements
for existing utilities, all public ways within the
territory described below are hereby vacated:
Beginning at a point in the east line of North 17th
Street, at the intersection of a perpendicular line
running from the northeast corner (outside) of the
southeast wingwall of the North 17th Street Bridge
with said east line of said street as described in
Deed Record 230 Page 9 in the office of the Mayne
County Recorder, Richmond, Indiana; thence north on
said east line of said street to its intersection
with a line parallel with the southerly line of
Tracts Nos. 448 and 449 of the Official Map of said
City and eighty (80) feet at right angles therefrom,
to a line parallel with the New Paris Pike and running
west from the southwest corner of Lot No. 225 of
Morton Lake Addition; thence east to the southwest
corner of said Lot No. 225; thence north along with
west line of said Lot No. 225 to the New Paris Pike;
thence west along the New Paris Pike, to the east
line of said Tract No. 449; thence south and south -
westwardly along the northwesterly boundary of Tract
No. 450 of the Official Map of said City to the west
line of North Seventeenth Street, extended north;
thence south along the west line of North Seventeenth
Street, extended, to a point perpendicular to the
beginning point of this description; thence eastward
on said line to the place of beginning.
Subject to any easements of record and all existing
utilities.
SECTION 2. This Ordinance shall be in full force and effect
from and after the passage and approval as by law re-
quired.
