AN ORDINANCE AMENDING SPECIAL USE ORDINANCES NO. 3001-1975 AND NO. 3087-
1976 WHICH AUTHORIZED A COMMERCIAL DEVELOPMENT UNIT PROJECT AT 2023 CHESTER
BOULEVARD, BY AMENDING THE APPROVED SITE DEVELOPMENT PLAN TO PERMIT THE RE-
CONSTRUCTION AND CONNECTION OF TWO (2) EXISTING STRUCTURES AND TO PERMIT
THE USE OF SAID STRUCTURE CONSISTENT 14ITH THE C-2 ZONING DISTRICT.
WHEREAS, it is the intent and purpose of this Ordinance to amend Special
Use Ordinances No. 3001-1975 and No. 3087-1976 to permit the re-
construction and connection of two (2) existing structures and to
permit the use of said structure consistent with the C-2 Zoning
District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan
Commission the 23rd day of November, 1982, at which time remon-
strances were heard from all parties interested in or affected
by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to
zero (0) in favor of recommending the passage of Ordinance No.
48-1982.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana as follows:
SECTION I. That the site plan accompanying the petition requesting the
Special Use amendment shall be marked Exhibit "A" and made a
part of this Ordinance.
Section 2. That Special Ordinances No. 3001-1975 and 3087-1976 are hereby
amended to authorize the reconstruction and connection of the
two (2) existing structures as shown on the site plan, Exhibit
"A" of this Ordinance, and that the use of said structures be
permitted consistent with the regulations of the C-2 Zoning
District.
SECTION 3. As a condition of the aforesaid Special Use amendment being
granted, the following requirements shall hereafter and at all
times be met by the owner.
a. The owner shall design and install a site drainage plan,
subject to the approval of the City Engineer.
b. The site plan shall be amended to incorporate a signage
package that is in compliance with Article 43 of the Zon-
ing Ordinance.

SECTION 4. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.

c. That the intersection of the access drive to the east of the
proposed buildinq and connecting with the north lane of Uni-
versity Boulevard be improved so that site distance to the east
from the access drive be adequate to insure traffic safety.

Dear Mr. Mills, Members of Common Council & Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on
Tuesday, November 23, 1982, on the petition of Paul W. Lingle,
requesting to amend Special Use Ordinances No. 3001-1975 and No.
3087-1976 which authorized a Commercial Development Unit Project
at 2023 Chester Boulevard. The requested amendment seeks authoriza-
tion to modify the approved site development plan to allow the
reconstruction and connection of two (2) existing structures
which would provide for a larger complex structure making space
available for at least four (4) separate offices. The petition
also requests authorization to permit the use of this space con-
sistent with the regulations of the C-2 Zoning District.
During the public hearing, no one spoke in opposition to the re-
quest.
The Plan Commission determined the proposed amendment is consis-
tent with current and past development of the area and that the
Police Traffic Division and the City Engineer's office concurs with
the location of entrance and exit drives off of Chester Boulevard.
Therefore, the Plan Commission voted seven (7) to zero (0) to
recommend the passage of Ordinance No.43 -1982.
