GENERAL ORDINANCE NO. 50-1982
AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE
NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN
THE 3800 BLOCK OF SOUTH "A" STREET FROM R-4 MULTI -FAMILY RESIDENCE DISTRICT
TO R-4 SU MULTI -FAMILY RESIDENCE SPECIAL DISTRICT AND AUTHORIZING THE
SPECIAL USE OF SAID PROPERTY AS A RESIDENTIAL DEVELOPMENT UNIT PROJECT.
WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 designates
and describes as R-4 Multi -Family Residence District the property
located in the 3800 Block of South "A" Street; and,
WHEREAS, it is the intent and purpose hereof to change the zoning classi-
fication of said property from R-4 Multi -Family Residence District
to R-4 SU Multi -Family Residence Special Use District and to
authorize the Special Use of said property as a residential
development unit project; and,
WHEREAS, pursuant to Articles 45 and 48 of Chapter 154 of the Municipal
Code, the Richmond City Plan Commission has conducted a public
hearing on the preliminary plan of the subject Residential Develop-
ment Unit Project; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the 14th day of December, 1982, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to
one (1) in favor of recommending the passage of Ordinance No. 50-
1982.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana as follows:
SECTION 1. That the zoning classification of the property described below,
and the same is hereby changed to R-4 SU Multi -Family Residence
Special Use District, and that said property be regulated in
accordance with the Zoning Ordinance of the City of Richmond,
Indiana and all amendments thereto.
The following described real estate situated in the City of Rich-
mond, Indiana, to wit:
Located in the northwest quarter of Section 2, Township 13 North,
Range 1 West, City of Richmond, Wayne County, Indiana, being part
of the land conveyed to Walter E. Lakoff and the Midwest Invest-
ment and Development Company by deed recorded in Deed Book 373,
page 323 of the Wayne County Deed Records, and being more parti-
cularly described as follows:
Beginning at an iron pin in the south right-of-way line of South
A Street, said point of beginning being located the following six
courses from the northeast corner of the said northwest quarter:
North 89 degrees 33 minutes 00 seconds East for 85.80 feet, South
0 degrees 52 minutes 00 seconds West for 276.32 feet, South 89
degrees 33 minutes 00 seconds West for 60.00 feet, South 89 degrees
33 minutes 28 seconds West for 833.37 feet, North 89 degrees
28 minutes 00 seconds West for 1046.11 feet, and South 0 degrees
21 minutes 30 seconds West for 543.30 feet; thence from the said
point of beginning and with the south right-of-way line of South
A Street, South 89 degrees 28 munutes 00 seconds East for 350.42
feet to an iron pin; thence South 0 degrees 21 minutes 30 seconds
West for 558.52 feet to an iron pin; thence North 89 degrees
45 minutes 00 seconds West for 350.42 feet to an iron pin; thence
North 0 degrees 21 minutes 30 seconds East for 560.25 feet to the
point of beginning; containing 4.500 acres, subject to all restric-
tions of record.

SECTION 2. That as provided in Articles 23, 45 and 48 of Chapter 154 of
the Municipal Code, the following described use of the above
described real estate is allowed as a Special Use as a residen-
tial development unit project.
SECTION 3. As a condition of being granted the Special Use and as an
additional restriction on said use, the following requirements
shall hereafter and at all times be met by the owner of said
real estate:
a. The Site Dimension Plan and Site Grading Plan accompanying
the petition shall be marked Exhibit "A" and made a part
of this Ordinance.
b. The Record Plan depicting the project boundary and necessary
easements shall be marked Exhibit "B" and made a part of
this Ordinance.
c. The following conditions shall be met prior to the time an
Improvement Location Permit is issued:
(1) Construction plans for the private and public sanitary
sewers within the project shall be approved by the Rich-
mond Sanitary District.
(2) The owner shall execute and record all necessary public
utility easements.
(3) Final storm drainage plans relative to the surface
water entering the A.F. Scott Regulated Drain shall
be approved by the Wayne County Surveyor.
SECTION 4. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.

Dear Mr. Mills, Members of Common Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on Tuesday,
December 14, 1982, on the petition of Midwest Investment and Development
Company and Walter E. Lakoff, 801 North "A" Street, requesting a rezoning
from the R-4 Multi -Family Residence District to the R-4 SU Multi -Family
Residence Special Use District and requesting that a Special Use be
granted for a Residential Development Unit Project on property located
in the 3800 Block of South "A" Street.
The proposed project is a multi -family development consisting of 59
dwelling units in 9 structures and is located north of the Backmeyer
Trace Subdivision, east of the A.F. Scott Ditch, south of South "A"
Street and west of Cedar Cliff Road.
During the public hearing, no one spoke in opposition to or in favor of
the request.
The Plan Commission determined the proposed project meets or exceeds
all requirements of the Zoning Ordinance and, therefore, voted seven
(7) to one (1) to recommend that Ordinance No. 50-1982 be forwarded
to Common Council with the conditions as written in Section 3 of the
Ordinance, and with a recommendation for approval.
