The regular meeting of the City Council was called to order by Mayor Merritt at 7:30 P. M., followed by invocation given by 2. Elder Calkins of the 7th Day Adventist Church, 9664 Broadway, Temple City. Mayor Merritt then led the Pledge or Allegiance 3. to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford, City Manager Woollett, & Asst. City Manager Koski 5. APPROVAL OF MINUTES: Councilman Nunamaker moved to approve the minutes of the regular meeting of October 12, 1964, as mailed, Councilman Harker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. AWARD FROM STATE COMPENSATION INSURANCE FUND: Asst. City Manager Koski introduced Mr. Smith of the State Com- pensation Insurance Fund. Mr. Smith presented a certificate in recognition of the employees of Temple City in recognition of no lost time, and that Temple City placed 10th in a list of 36 cities. Mayor Merritt accepted the certificate on behalf of the employees of the City of Temple City. 7. ORDINANCE NO. 64 -141: 2nd read. City Attorney Shatford read title to Ordinance No. 64 -141. AN ORDINANCE OF THE CITY OF TEMPLE. CITY ADDING SUBSECTION 3 AND AMENDING SUBSECTION 2 OF SECTION 9000.603 OF THE TEMPLE CITY MUNICIPAL CODE. Councilman Tyrell moved to waive further reading of Ordinance No. 64 -141, Council -' man Harker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 64 -141, Council- man Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 8. REPORT ON PETITIONS FOR PROPOSED PARKING DISTRICTS #3 AND #4. City Manager Woollett reported on Parking District #3 that 61.13 are good signatures and recommended the Council instruct the Cit Attorney to draw a Resolution of Intention. Councilman Tyrell so moved, Councilman Nunamaker seconded, carried by the followir roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker-, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The City Manager reported on Parking District #4 that 51.97% of the signatures are good ones. He advised that an individual purchased four pieces of property but they are in various stages of escrow and until completed and the deeds recorded that he can not legally sign the petitions. One escrow Will close in Novem- ber and one in December and we would have 69.73% if these go over. The Committee can secure additional signatures or hold up further action until these escrows are completed. Councilman Nunamaker requested these petitions be brought back to the Commie tee meeting on Wednesday for further action. City Manager Woollett also advised the assessment public hearing on Parking District No. 2 is set for December 14, and recommend- Council Minutes, October 26, 1964, page 2 ed that it be set for a date other than the regular meeting night Following discussion the assessment public hearing was scheduled for December 17, 1964, at 7:30 P. M. in the Council Chambers. PUBLIC HEARING: CURB & GUTTER: 7 :30 P. M. a. south side Olive, Alessandro to Buttons. Councilman Nunamaker moved to open the public hearing, Councilman Dickason seconded and carried. Asst. City Manager Koski advised the petition represented 63% of the lineal footage in the block. The Mayor asked if anyone wished to speak for or against this installation and no one came forward. Councilman Dickason moved to close the public hearing, Councilman Nunamaker seconded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Harker moved to find the project to be in public in- terest and to instruct the Supt. of Streets to cause the work to be done, Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None b. north side of Wedgewood, Rosemead to Eaton Wash Councilman Dickason moved to open the public hearing, Councilman Harker seconded, and carried. Asst. City Manager Koski reported the petition represented 76% of the lineal footage of the area. Mayor Merritt asked if anyone wished to speak for or against the installation. Mrs. Robt. Duff, 5549 N. Rosemead on the corner of Wedgewood was concerned if street was widened it would effect their buildings and was advised the proposed improvements will be in the existing right of way, and proposed design would have to take into consideration existing structures, and where their buildings are installation would be approximately where the road pavement is now which is about 3 ft. from the buildings. Archie A. Miller, 8850 Wedgewood, asked about the parking lot next to the buildings and was advised breaks in the curb can be provided to allow ingress and egress. This also answered the questions posed by Mrs. Duff who is on the opposite corner from Mrs. Robt. Duff. Councilman Nunamaker moved to close the public hearing, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Mr. Koski presented a petition for the south side of Wedgewood signed by 77.4% of the lineal footage. Councilman Nunamaker moved to open the public hearing, Councilman Harker seconded and carried. No one further came forward to speak and Councilman Nunamaker moved to close the public hearing, Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Nunamaker moved to find both projects to be in public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 9. STATUS REPORT ON JACK IN BOX: Asst. City Manager Koski reported the Sheriffs Dapt. indicates no particular disturbances for the past two months and the re- commendation is to close at 10 P. M. Monday through Thursday and Sunday nights, and to close at midnight on Friday and Saturday nights, which is in accordance with the wishes of the owners and Manager. Jack Goodall of the Foodmaker Co. stated at present they are closing at 11 P. M. but were in accordance with the re- commendation. The plans were in accordance with the Council and Councilman Nunamaker moved to receive and file the report, Coun- 668 Council Minutes, October 26, 1964, page 3 cilman Dickason seconded and carried. PUBLIC HEARING: 7 :30 P. M. RECOMMENDED RE- ZONING OF AREAS: Councilman Dickason moved to open the public hearing, Councilman Nunamaker seconded, and carried, Planning Director Cushman pre- sented the recommendations of the Planning Commission explaining them in detail. Under Area A: property with Lower Azusa Front- age beginning at the rear of lots fronting on Camellia to the east property line siding and backing to the lot belonging to City of El Monte: 1. beginning south of Kauffman and extending to Golden Jest the recommendation would be R -1 with potential R -4 and C -2 if whole area developed at one time but noted this decision covers two blocks, but is actually two separate poten- tial areas. 2. east side of Golden West to Agnes would carry R -1 with potential R -4 or C -2, this extends to Agnes behind the apartment house which is in El Monte. Also the northwest corner of Agnes and Lower Azusa is recommended R -4. 3. from Agnes to; Willmonte i t is recommended R -4. From Willmonte to Baldwin commercial zone already exists (c -2) with no change recommended. 4. northeast corner is C -2 and balance of block to Ryland re- commended es R -4 with only service station on the corner recom- mended as C -2. 5. Ryland to Birchland recommended R -4. 6. Birch - land to Glickman: two lots fronting on Birchland and three on Lower Azusa Rd. recommended R -4. 7. Glickman to Arden Dr: 3 lots east of Glickman fronting on Lower Azusa recommended C -2 to conform with C -2 adjoining from Arden west to these lots. 8. easterly boundary City of El Monte property to Hallowell recom- mended C -2 one lot deep fronting on Lower Azusa. 9. Hallowell to Halifax: recommended C -2 one lot deep fronting on Lower Azusa Rd. 10, Doreen to east city limits: all lots facing Lower Azusa Rd. one lot deep recommended C -2. 11. SE corner of Lower Azusa Rd. and Temple City Blvd.: recommend C -M in accordance with owners request. Pat Mclntee, 4840 Camellia, wanted to know why he was not noti- fied, which was not required as he is not a property owner ef- fected in the area. Dewey McQueen and Mrs. McQueen, 10047 Lower Azusa, spoke against recommended R -4 for his property and requested C -M. Bill Hall, 4847 Kauffman, stated a petition had been circulated some time ago requesting the area remain R -1, and was advised the adjoining area is recommended to stay R -1. Jack Rolfson, 4850 Kauffman, also wanted the R -i and the meaning of the poten- tial R -4 and C -2 was explained to him. No one further wished to speak and Councilman Tyrell moved to close the public hearing, seconded by Councilman Nunamaker and carried by unanimous vote. Following discussion by the Council, Councilman Tyrell moved to approve and adopt the recommendations of the Planning Commission for the area A listed above under items 1 through 11, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None AREA B: Gidley Street Area. Planning Director presented the following recommendations from the Planning Commission: 1. 9352 to 9412 Lower Azusa Rd. recom- mended C -M. 2. Vacant lot across alley from existing C -2 re- commend this one lot be C -2. 3. 4504 Cloverly o 9633 Gidley: recommend M -1. 4. 9610 to 9645 Gidley and 44;09 Temple City Blvd, recommend M -2. 5. 9401, 9415, 9425 Gidley and 4515 Clov- erly recommend M -1, 6. Residential triangle between Temple City Blvd. and Ellis Lane south of Lower Azusa Rd. recommend R -4. All other areas left R -1. Robt. Gordon, 9549 Bisby asked regarding zoning of his property. Mrs. Fred Paul, 9404 Lower Azusa, strongly protested recommended C -M and requested continuance of present R -1 zoning. Mr. Wheeler of 9364 Azusa Rd., Mr. Watson of 9412 and 9388 Lower Azusa Rd., Mrs. Nelson, 9368 Lower Azusa Rd., Gary Penny, 4533 Cloverly, Gary Pohlman, 4526 Cloverly, Robt. Oakes, 4527 Cloverly, Paul Fowler of 4515 Fiesta, John Mott 9518 Lower Azusa, Ray Parady 4540 Cloverly, all requested R -1 for the area in section 1. Allen Jaworski 9542 Bisbee requested 8 ft. walls between M -1 and R -1 zones and this matter will be referred to the Planning Commission. 669 Council Minutes, October 26, 1964, page 4 The following favored or were not opposed to recommendations of the Planning Commission in area 1: Ray Hotton 9334 Lower Azusa Rd., Howard Hanson 9376 Lower Azusa Rd., Joe Chaffers 9376 Lower Azusa Rd., Mr. Elmsly 9425 Gidley, Mr. Bronson 9538 Bisby, Carl Palmer 9415 Gidley, Hubert Cavanaugh 9609 Gidley. No one else came forward to speak. Councilman Nunamaker moved to close the public hearing, Council- man Dickason seconded, carried by unanimous roll call vote. Councilman Dickason moved to adopt the Planning Commission re- commendations with the exception of the area between Alessandro and Heleo on the south side of Lower Azusa recommended by them for C -M that it be continued as R -1, Councilman Tyrell seconded followed by the roll call vote to carry the motion: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None AREA C; Sereno Drive Area. Planning Director Cushman presented the following Planning Commis sion recommendations: 1. Rosemead Blvd. between Eaton Wash and Sereno Dr. recommended R -4. 2. Rosemead Blvd. between Sereno Dr and Southern Pacific Railroad recommended R -3. 3. balance of area to be R -2 with the exception of small lot single house areas listed below. 4. Acaso Drive west of Sultana- R -1. 5. 9045 to 9073 Acaso and 5003 to 5017 Sereno, R -1. 6. 4912 to 4972 Sereno and 4950 to 4975 Loma R -1, 7. 9109 to 9129 Blackley and 5152 Sereno R -1. 0 4833 and 4857 Encinita R -1. Councilman Nunamaker moved to open the public hearing, Councilman Dickason seconded and carried. Mrs. Nyan, 5039 Sereno spoke in opposition to R -2 and wanted R -1. Mr. Dodge, 4917 Sereno, prefers R -1. Paul Uhl 50581 Sereno wanted R -1. The following approved R -2 or wanted R-3: Jack Newman 5059 Sereno Dr. R, Waller 5130- 302 -32, Clyde Day 5026 Sereno, Gene Reisley 50o0 Sultana, Henry Knolte 5231 Sereno, Mrs. Davis 9014 Pentland, Mrs. Herman 9009 Pentland. No one else came forward to speak. Councilman Nunamaker moved to close the public hearing, Council- man Tyrell seconded, and carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamamer, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Harker moved to approve the Planning Commission re- commendations with one change making the first lot east of the lot fronting on Rosemead on the north side of Pentland R -3, Councilman Tyrell seconded, and carried by the Following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett recommended the Council instruct the City Attorney to draw an ordinance incorporating the changes as recom- mended by the Council. RECOMMENDED TREE PLANTING PROGRAM: City Manager Woollett presented the above program which is budget- ed and in conformance with the plan. Councilman Munamaker moved to approve the recommended tree planting program, Councilman Tyrell seconded, carried by the Following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None. 11. RESOLUTIONS NO. 64 -411 and 64 -412: annexation to County Mainten- ance Lighting District. The City Manager presented these two Resolutions granting consent and jurisdiction to the County of Los Angeles in the matter of the County Lighting Maintenance Dis- trict #1395 petition No. 46 -34 and petition No. 140 -94. Council- man Dickason moved to adopt Resolutions No. 64 -411 and 64 -412, Councilman Tyrell seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 670 Council Minutes, October 26, 1964, page 5 12. APPEAL FROM PLANNING COMMISSION DECISION: 4331 Fiesta. The City Manager presented this appeal and recommended it be set for public hearing on November 9, 1964, at 7:30 P. M. Council i Tyrell so moved, Councilman Harker seconded, and carried. 13. RELEASE OF INDEMNITY BOND #M359791 in amount of $6000. The Asst. City Manager explained this was given by Steve Kral Corp. etal covering temporary traffic detour on Grand Ave. Councilman Tyrell moved to release Indemnity Bond #M359791 in the sum of $6000, given the City by Steve Kral Corp. etal cover- ing temporary traffic detour on Grand Ave., Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 14. SET PUBLIC HEARINGS: CURB & GUTTER: east side of Halifax, Daines to Olive. City Manager Woollett recommended a public hearing be set for November 9, 1964, at 7 :30 P. M. on the above petition. Council- man Tyrell so moved, Councilman Harker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 15. PARKS & RECREATION COMMISSION RECOMMENDATIONS: A. request joint meeting during month of November. The Council set Monday, November 16, 1964, at 7:30 P. M. for a joint meet- ing with the Commission. B. AMERICAN LITTLE LEAGUE: The Asst. City Manager presented the Commission's recommended approval of plans for an announcer's booth at Live Oak Park. Also to grant permission' to the Le® §ue•to add a maximum of three sprinkler heads on north dia- mond, the City to pay for the heads and the League to furnish the material and labor. Councilman Nunamaker moved to approve both of these recommendations, Councilman Harker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None C. Recommend approval of plans for Temple City Park with changes. Asst. City Manager Koski presented the plans submitted by Fickes & Fickes together with the changes recommended by the Commission. Following discussion Councilman Tyrell moved to approve the proposed design with changes as recommended by the Parks & Recreation Commission and authorize preparation of plans and specifications, and authorize the staff to go to bid, Councilman Dickason seconded, carried by roll call vote as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None D. Live Oak Park Development Plans: Mr. Koski presented the plans for the rest rooms at Live Oak Park with minor changes recommended by the Commission, and recommended the Council approve and go to bid, Councilman Nunamaker so moved, Councilman Harker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Mr. Koski then presented the plans for additional parking re --- commended by the Commission for Live Oak Park. Following dis- cussion Councilman Nunamaker moved to approve the recommenda- tion and go to bid, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 16. RESOLUTION! NO. 64 -410: warrants & demands. City Manager Woollett presented the above Resolution and recomt- mended the Council adopt. Councilman Dickason moved to adopt Resolution No. 64 -410, warrants and demands in the sum of 671 1 Council Minutes, October 26, 1964, page 6 $51,413,03, Nos. 5680 through No. 5723, Councilman Merritt se- conded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 17. CORRESPONDENCE: L. A. Co. Boundary Commission: The City Manager presented proposed annexation #64 -3 to City of San Gabriel and #69 to the City of South El Monte. Councilman Tyrell moved to receive and file, Councilman Dickason seconded, and carried. 1 8 . TIME FOR THOSE I N THE AUDIENCE `.:!HO WISH TO SPEAK: No one came forward at this time. 19. MATTERS FROM CITY OFFICIALS: Councilman Dickason gave a brief resume of his trip to Mexico Cit on the Leac!ue of California Cities tour. Councilman Nunamaker advised Mr. Gunst asked him to present a request to form a committee to put on a fair in the park and raise money for a community center. The City Attorney stated it would require an amendment to our present ordinance. It was suggested if the Council indicates support of this proposal that either Mr. Koski or Mr. Woollett and also the Chairman of the Parks & Recreation Commission be on the Committee, and they all get together and report back to the Council before any decision is made. Also that the Parks & Recreation Commission make a recommendation to the Council concerning the amending of the Park ordinance of regulations. Councilman Nunamaker recommended those going to Mexico on the Sister City trip sign up so arrangements for visas, transportatic and rooms can be made. Councilmen Harker, Nunamaker, Mayor Merritt and City Attorney Shatford are going as of now. City Manager Woollett presented Resolution No. 64 -413 appointing part time employees for the recreation program. Councilman Tyrell moved to adopt, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell commended Al Lindberg, David Recupero and Vic Kobett for the fine "Open House" held on Sunday Oct. 25. 20.
