The .regular meeting of the council of the town of Yarrow Point was
held on January 17, 1967 at 8:00 P. M. at the Town office at 4705
91st Avenue N E., Bellevue, Washington. Those in attendance were
John Helsell, Mayor; Councilmen Sheldon Dunning, Joseph Harlacher,
Harvey Rhoades; Glen Sparrow, Engineer; Roger Hamilton, Treasurer;
Kenneth Day, Marshal; and Lorraine Diede, Clerk.
The meeting was called to order by the Mayor.
A motion was made seconded and passed unanimously that the reading of
the previous minutes of the council be dispensed with as all those
councilmen present had received a copy of same and approved.
3. Report from the engineer: The assessment roll for the N. F. 34th
Street L. I. D. has been prepared and submitted to the clerk. There
was a discussion. Mr. Sparrow explained how the assessment roll had
been determined. The total amount is 05,000.00. Details in the clerk's
file.
Mr. Sparrow stated that a Stop �Work-order had been placed on the
garage being constructed by Mr. Robert Willis on Points Drive.
- Specifications have been prepared on the widening of 92nd Avenue
N. E. and they will be submitted for bid prior to the next meeting,
at which time a bid may or may not be accepted, as the council desires.
Mr. Sparrow stated there is not too much involved in the widening of
92nd. The inlets Ypvp to be. adjusted to grade. The sh ulder. area needs v
to be cleaned up. 7.,
7'. 'There was a discussion of the purchase of a used trailer for Marsha.'.
Do's use as Street Superintendent of the Town. Mr. Harlacher then made
a motion, seconded by Mr. Dunning that Mr. Day be authorized to purchase
a trailer at a cost of not more than 6150.00. The council will then
reimburse Mr. Day.
Renewal of Marshal Day's contract as Police Marshal and Street
Superintendent: A motion was made by Sheldon Dunning, seconded by
Joseph Harlacher and.passed unanimously that Marshal'Day-'s contract be
renewed for 1967.
A spraying permit Is to be obtained by Mr. Sparrow From the State for
spr&Y_i?ag Yarrow Point right of ways before the growinEseason begins.
Marshal T)a�r handed his report to the clerk for file. This report was
thi�ouz h Each• councilman and the mayor had previously
.received a copy of this report.
4. Reportfrom Town Attorney: The following is Mr. Robert's opinion on the
Austin Company's request for the town's agreement to a drawing they sub-
mitted of harbor lines in Yarrow Bay: (T4ken by telephone 1/1't67 by Mrs.
Diede).
Advise the town not to agree to anything for the reason that Mr.
Bowler of the State of Washington Department of Natural Resourses says

that he does not believe under the AttorneyGeneral's ruling that
private parties can really agree and make it legal. There is only one
way - a court to adjudicate (to try in court) through a quiet title
action. Mr. Bowler.is writing a letter to the 'Town of Houghton and
a carbon copy to the Town of Yarrow Point and the Austin Company,
recommending that this is the only possible way to resolve the problem.
It would be a friendly suit.
A letter was then read to the council from Mr. Engstrom of the
Austin Companysag'giffttng that no action be taken at present, since it
has become apparent that several property owners involved will not go
along without assurance or at least an indication of their aide
boundaries before approving a request for establishment of the inner
harbor line.
9. Vouchers: A motion was made by Joseph Harlacher, seconded by
SHeldon Dunning and passed unanimously that the following warrants
be paid:
Current Expense Fund #013 through #024
Street Expense Fund #276 through #279
L. I. D. #1 Construction Fund #14 and #15
L. I. D Fund #1 - #5,
Mr. Helsell then announced to the council that -'he will be unable to
continue as Mayor since he will be gone from the town for �9 �em�Rths
in the summer. After discussion, Mr. Dunninw offered to / ayo Pro
Tem during that time and the council: unanimously: -.agreed that this would
be a fine idea and Mr,Ielselould then remain as Mayor. This was
agreed by all concerped .
